Dear Mr.Bornstein,
This letter is a follow-up to our conversation regarding the posting of a Stop Work Order gn March
25, 2005 at the above referenced property for construction in the third floor attic area.
This building has been the subject of a number of special permits in the past. Last year relief was
requested under special permit appeal#2004-39 to use&occupy the third floor attic area. After
much discussion with the Zoning Board of Appeals regarding the previous special permits and
previous attempts to gain relief to use this space,it was your decision to withdraw the request for
relief without prejudice at the public hearing. One of the issues at the hearing that was discussed at
length was the fact that this building exceeds t1Le floor area ratio allowed in this zoning distri,t. This
is one of the reasons for the Stop Work Order.
To come into the.Building Department and obtain a permit with your full knowledge of the past
history of this locus is certainly.disingenuous. Building Permit#79682 has been rescinded and
voided due to the lack of relief from the Board of Appeals. We regret any inconvenience this may
cause to yourself or your client.
You may appeal this decision to the Zoning Board of Appeals. If you wish to do so please contact
this office at 508-862-4038 so that we may assist you.

Dear Mr.Bornstein:
After a review of our zoning and,especially,the.history of your building at the above address,I have the
following information for you:
I. The building was built under the interpretation of a prior building inspector that the third level,
because it is under 50%of the floor below,did not count as a floor.
2. The building permit was not challenged within six years even though you did visit the Zoning
Board of Appeals for a.variance request on the use,which is very different.
3. Based on the above facts,I would consider the structure protected under 40a and for lack of any
direction to the contrary,a preexisting non-conforming. . Section 4-4.7 removes
variance situations from 4-4 consideration,but not structures in this category.
4. Section 4-4.4(1)B.says that if the use is conforming and the structure isn't,and expansion is
proposed,it is to be allowed as a matter of right as long as it does not increase the degree of
non-conformity of the building.
S. Since the use of the third floor does not increase the non-conformity of the structure and the use
is conforming(office use is being proposed),it can be allowed.
6. Consequently,I am enclosing an updated certificate of occupancy for the building.
