We BARNSTABU NUAR � t6s9. 1Ep MP+ Town of Barnstable Zoning Board of Appeals Decision and Notice Appeal 2005-48—259 North Street Limited Partnership Modification of Special Permit 1994-56 To allow a further reduction in required on-site parking by 13 spaces Summary: Granted with Conditions Petitioner: North Street Limited Partnership Property Address: 259 North Street,Hyannis,MA. Assessor's Map/Parcel: Map 308,Parcel 073-002 Zoning: 0-2 Office Zoning District Relief Requested &Background: The property is a 0.85-acre parcel developed with two office structures. The first structure closest to North Street was built in 1987 and has 15,311 sq.ft. of usable floor area. That structure is a four-level building consisting of a partly-exposed basement, a first-level entry floor, a full second level and an attic space above that level. At that time,bulk regulations for the B District permitted a maximum building height of two(2) stories. In 1994, the applicant requested three forms of relief. One of those appeals (Appeal 1994-56) sought to construct a second 8,000 sq.ft. one-story building on the property and a reduction in the required on-site parking for both the new and the existing building on the property. The Board granted the appeal providing a reduction in parking for both the existing building and a proposed new building, an 8,000 sq.ft. one-story office structure. That permit did not grant any relief for the attic space in the original building, as that area exceeded the number of permitted stories. The relief also limited the use of both structures to office use only(not including banks or medical offices). The permit conditioned the larger structure to a maximum of three offices, and a single-level structure to one office. In 2001, the applicant requested and was granted a modification of Special Permit 1994-56. That modification allowed for a second office suite to be created within the 8,000 sq.ft. one-story structure (Appeal 2001-107). Relief Requested: In Appeal 2005-48, the applicant has requested a further modification of Special Permit 1994-56, Conditions No. 1, 2, and 3, issued for parking relief. With respect to the requested modification of Special Permit 1994-56: • Condition No. 1 of the 1994 Special Permit provides for a reduction of the required on-site parking spaces from 79 to 32. Today the applicant seeks relief for an additional 13 on-site parking spaces. I r� • Condition No. 2 of the special permit specifically does not grant any relief for the use of the attic space and the applicant seeks use of that 3,168 sq.ft. located within the attic. • Condition No.3 limits the use of the site to office use only,not including banks or medical, and restricts the total number of offices to three in the larger structure, and one in the single level structure. Today's relief seeks to have a total of six business uses on the property. The one-level 8,000 sq. ft. structure is to have two office suites and the four-level 15,389 sq.ft. structure is to have four suites. In addition, to modifying those conditions of the 1994 permit,the applicant also sought a seeking special permit pursuant to Section 240-93 Nonconforming Buildings or Structures Not Used as Single or Two- family Dwellings to allow for the expansion of the pre-existing nonconformity in the structures as they now do not conform to the district's maximum floor area ratio for the 0-2 Zoning District. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on June 09, 2005. An Extension of the Time Limits for holding the public hearing and for the filing of the decision was executed between the applicant and the Board Chairman. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened July 27, 2005 and continued to August 24, 2005 and to September 14, 2005, at which time the Board found to grant the modification to the required parking only, subject to conditions. Board Members deciding this appeal were, Sheila Geiler,Jeremy Gilmore,Randolph Childs,James R. Hatfield and Acting Chairman Gail Nightingale. Attorney Mark H. Boudreau represented the applicant. At the opening of the hearing,he noted that no additional building was being contemplated by the request. A proposed change in uses,the addition of suites and the desire to use the attic space triggered the need for added parking. He cited that under the current 0-2 office zoning District regulations,the attic should be usable as-of-right. He cited that the changes would require an additional 13 on-site spaces. The modification being requested is for relief from the 13 required spaces triggered by the proposed changes. The Board and Mr. Boudreau reviewed the site plan and discussed the nature of the changes with respect to the buildings. It was noted that the attic level is accessable by both elevator and by stairways. Municipal parking is provided on the lot adjacent and the buildings are accessed from that municipal land. The Board determined that a site visit would be in order and scheduled that visit for August 02, 2005. The hearing was continued to August 24, 2005. At the contimmace, the Board noted that the locus was recently rezoned by the Hyannis Village Zoning Distirct amendment that transferred certain special permits from the authority of the Zoing Board to the Planning Board and it was determined to seek the Town Attorney's opinon on the issue of the Board's authority to act on this permit. The hearing was continued to September 14, 2005. At the Board hearing of September 14, 2005, a September 6, 2005 letter from Town Attorney Robert D. Smith, cited that it was within the authority to render a decision on this appeal as Section 402-24.1-2(1) provides a transitional provision for proposed development that has received site plan review or special permit prior to July 14, 2005. This proposal's site plan was administratively approved by the Building Commissioner on July 13, 2005. 2 C The Board discussed the nature of the relief being requested and it was noted that given the recent changes, it would only be ruling upon the relief of parking and would not render any other relief in conjuction with this permit. The applicant's representative stated that this is the only relief the applicant would need as the rezoning provided for the proposed uses and for the use of all of the existing floor area of the buildings located on the lot. During the proceedings,public comment was requested however no one spoke in favor or in opposition to the request. Findings of Fact: At the hearing of September 14, 2005,the Board unanimously made the following findings of fact: 1. Appeal 2005-048 is that of 259 North Street Limited Partnership for property addressed 259 North Street,Hyannis,MA, as shown on Assessor's Map 308 as Parcel 073-002. The property is in the 0-2 Office Zoning District. The applicant is seeking a Modification of Special Permit 1994-56 as previously modified by Appeal 2001-107. The applicant is seeking permission to further modify that permit to allow for added parking relief created by; an increase in the number of permitted suites (business)to six, and use of 3,168 sq.ft. that exists within the buildings. 2. The property is a 0.85-acre parcel developed with two office structures. In 1994,the applicant was granted Special Permit 1994-56 that allowed for a reduction in the required on-site parking. 3. The site plan has been administratively found approvable by the Building Commissioner on July 13, 2005. 4. The application falls within a category specifically excepted in the ordinance for a grant of a Special Permit and after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good or the neighborhood affected; and 5. A September 6,2005 letter from Town Attorney,Robert D. Smith,cited that it was within the authority of the Board to render a decision on this appeal as Section 402-24.1-2(1)provides a transitional provision for proposed development that has received site plan review or special permit prior to July 14, 2005. This proposal's site plan was administratively approved by the Building Commissioner on July 13,2005. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the appeal with the following conditions: 1. This modification is issued for the 0.85 acre parcel developed with two buildings; a four-level, 15,311sq.ft office building built in 1988 and a one-story 8,078 sq.ft., office building built in 2001. 2. Use of the site is limited to no more that six (6) separate uses (suites): • four(4) of which shall be office use only not including banks or medical offices; • one(1) of which is limited to personal services not to exceed 3,168 sq.ft.; and 3 • one(1)of which is limited to institutional/educational use not to exceed 7,200 sq.ft. 3. Both structures shall be required to comply with all current building and fire codes and all heath regulations applicable to the proposed uses. 4. The applicant shall at all times maintain the 32 on-site parking spaces located fully on the 0.85 acre lot. Those spaces shall not be gated off from the public parking area nor marked as reserved for specific business. 5. Except as modified herein,all prior conditions of Special Permit 1994-56 shall remain in full force and effect. 6. The site shall conform to the site plan as approved by the Site Plan Review Committee on July 13, 2005, initialed by the Chairman and made a part of this decision by this reference. Development Activity: To add a 40 ft. by 200 ft. one story commercial office building (8,000 sq. ft. gross floor area) to the site that has an existing office building (with 14,244 sq. ft. of existing usable) and for which a variance is sought to permit the attic to be usable (2,400 sq.ft ) . Procedural Provisions: Section 5-3.3 Special Permit Background Information:-- - - The locus is on the south side of North Street between Sea Street Extension and Basset Lane, Hyannis and adjacent- to.the Town of Barnstable North Street/Basset Lane Parking Lot. The applicant is requesting a Special Permit , for the reduction of required on-site parking for the entire project site. This appeal is being considered together with Appeal No. 1994-55, a request for a variance to the maximum building height to allow the use of the "attic" space in the existing building. - Site Plan Review is scheduled to consider this project at its meeting of June 16, 1994. Final action -is due June 23, 1994: Procedural Summary: Filing Date: May 2, 1994; To ZBA Mtg. of 6/22/94 The petition was heard by Board Members T. DeRiemer, D. Bliss, E. Nilsson, R. - Jansson and Chairman R. Boy. ZBA"meeting of June 22, 1994: Mr. Bornstein representing himself is requesting a special permit. 'This site presently:,has two building foundations on it.. Two buildings of two stories each. They have .sewer, water and electricity. The request is to size down to one"story instead of two,and merge the two foundation into one building. 1 Decision and Notice - Appeal No. 1994-56 Special Permit Reduction of Parking: Bornstein Mr. Bornstein explained that he has a financial company who wants to rent and would definitely provide 25 good paying jobs. Arthur Traczyk The Old Williams Building is still there. The earlier Special Permit for reduction of parking question as to validity and he is trying to make it valid now. Mr. Bornstein said he would withdraw his right to have a second story on the buildings and would-allow a condition of only one tenant. Regarding the issue of landscaping Mr. Bornstein said that he had given the town 10,000 dollars for site improvements to landscape and.redesign and add parking. Public Comment: . Joseph Chili, a landlord, tenant and merchant on Main Street spoke in opposition citing problems with parking. Understanding that Mr. Bornstein would utilize the public parking lot to accommodate his overflow cars Mr. Chili said that lot had been slowly given away by the town and there was no more room to give. He informed that a car dealer and tour busses use it also. Jeff Taylor of Cellar Leather and Pam Chapel of Common West both spoke in opposition citing the same reasons as Mr. Chili. Mr. Bornstein rebuttal was that merchants may be short sighted. He again reiterated about the year round jobs that would be provided and reminded the shop owners that people with good jobs buy more merchandise on their lunch hours and after work. He stated that offices let out at 5:00 PM and would not interfere with the tourists who frequently come after dinner to walk on Main Street. Mr. Jansson reminded Mr. Bornstein that he needed 79 parking spaces not 30. Mr. Bornstein said he was allowed 80 spaces. He has 52 or 53 and when we paid the town to redo the parking lot was partially suppose to go for an .additional 30 parking spaces. Mr. Jansson reminded Mr. Bornstein that the permit- that he was referring to was granted by the Selectman's Office and had not been recorded and therefore was in question as to validity. Mr. Bornstein: ` The only issues Site Plan Review has is the landscape plan and the dumpster and I explained to Cathy Maloney that until the Board of Appeals tells me what to 'do with the building, I can't go forward with the final drawings.. Then after I need the architect plans., I am willing to grant what ever they wish, just make it a condition. R. Jansson: Site Plan Review Committee has addressed a letter to this Board dated June 16, 1994 in which there are several concerns to be addressed tomorrow. Impact on Senior Citizens Housing, adequacy of dumpster area, . ,potential use of the attic space, clarification of relationship of this project and the town parking lot, walkway, landscape, sprinkler main location. Mr. Bornstein is to submit additional documentation regarding these things .tomorrow. Art Traczyk: Additionally the Legal Department may need to look at the easements over the town land to get to the back property where there is additional parking. Chairman Boy: Postponed this hearing until July 6 at 7:15 PM ZBA Meeting of July 6, 1994: 2 ~ Decision and Notice - Appeal No. 1994-56 Special Permit Reduction of Parking: Bornstein As Mr. Jansson was not in attendance, Chairman Boy told Mr. Bornstein that they would continue and in the event that the missing vote impacted Mr. Bornstein's appeal negatively, then they would continue this hearing until Mr. Jansson could attend. Mr. Bornstein agreed. A letter from Arthur Traczyk was read into the record (see file) for updating information. Essentially it said final approval of landscaping would be with Site Plan Review and the building would be limited to office space only. E. Nilsson responded that there should be a condition regarding liability and adverse possession on the public land that MR. Bornstein will maintain. A. Traczyk advised that a conditions might be imposed that the Town Attorney decision should it be ranted. review this aspect of the g Findings: 1. Development Activity: To add a 40 ft. by 200 ft. one story commercial office building (8,000 sq. ft. gross floor area) to the site that has an existing office building (with 14,244 sq. ft. of floor area) and for which a variance is sought to permit the attic to be usable (2,400 sq.ft.) . Procedural Summary: The application was filed in the Town Clerks office and the Zoning Board of Appeals on May 2, 1994 and a public hearing was duly scheduled and opened at the Zoning Board of appeals meeting of June 22, 1994. The petition was heard by Board Members T. DeRiemer, D. Bliss, E. Nilsson, R. Jansson and Chairman R. Boy. ZBA meeting of June 22, 1994: Mr. ,Bornstein representing himself is requesting a special permit for the reduction of parking. This site presently has two building foundations in addition to the existing building. The two foundations were originally for buildings of two stories each. They have sewer, -water and electricity. . Mr. Bornstein explained that he has' a financial company who wants to rent and would definitely provide 25 good paying jobs. -Arthur Traczyk commented that the existing building (previously so-called Williams Building) is part of the total project. The previous Special Permit for reduction of parking for the original project had questions as to validity; and he, Mr Bornstein, is trying to make the new total proposal, including the request for parking reduction, completely valid now. Mr. Bornstein said he would withdraw his right to have a second story on the new proposed building and would allow a condition of only one tenant. Regarding the issue of landscaping Mr. Bornstein said that he had already given the town $10,000- dollars for site improvements to redesign and add parking and landscaping. Public comment was then invited. Joseph Chili, a landlord, .tenant and merchant on Main street spoke in opposition citing problems with parking. Understanding that Mr. Bornstein would utilize the public parking lot to accommodate his overflow cars Mr. Chili said that the town lot had been slowly given away by the town and there was no more room to give. He informed the Board that a car dealer and tour busses also use it. Jeff Taylor of cellar Leather and Pam chapel of common West both spoke in opposition citing the .same reasons as Mr. chili. Mr. Bornstein's rebuttal was that merchants may be short sighted. He again reiterated about the year round jobs that would be provided and reminded the shop owners that people with good jobs buy more merchandise on their lunch hours and after work. He stated that offices let out at 5:00 PM and would not interfere with. the tourists who frequently come after dinner to walk on Main Street. Mr. Jansson reminded Mr. Bornstein that he needed a total of�-79-parking-spaces Cnot30,a Mr. Bornstein said he was allowed 80 spaces. He originally had52=6r r53_on-his'.site and when he paid the town to redo the parking lot it was partially supposed to go for the right to use an additional 30 town parking spaces. Mr. Jansson reminded Mr. Bornstein that the permit that he was referring to was granted by the Selectman,s Office and had not been-recorded and therefore was in question as to validity. Mr. Bornstein commented that the only major issues Site Plan Review has is the landscape plan and -the dumpster location, and that until the Board of Appeals resolves the parking reduction issue he cant go forward with the final concept drawings, after which he needs detailed architectural plans. He is willing to grant what ever the Board wishes - just make it a condition. R.` Jansson noted that the Site Plan Review Committee has addressed a letter to this Board dated June 16, 1994 in which there are several concerns to be addressed tomorrow. Art Traczyk additionally noted that the Legal Department may need to look at the easements over the town land to get to the back (south end) of Mr. . Bornstein's property where there is additional on-site parking. Chairman Boy, due to unresolved issues and the pending site Plan Review action, postponed this hearing until July 6 at 7:15 PM ZBA Meeting of July 6, 1.994: As Mr. Jansson was not in attendance, Chairman Boy told Mr. Bornstein that they would continue and in the event that the missing vote impacted Mr. Bornstein's appeal negatively, then they would continue this hearing until Mr. Jansson could attend. Mr. Bornstein agreed. A letter from Arthur Traczyk was read into the record (see file) for updating information. Essentially it summarized Site Plan Review resolution of most issues and that final detailed approval of landscaping is recommended to be with site Plan Review, if this appeal is granted, and that the building would be limited to office space. only. E. Nilsson responded that there should be a condition regarding liability and adverse possession on the public landscaped .land that Mr. Bornstein will maintain. A. Traczyk advised that a condition might be imposed that the Town Attorney review this aspect of the decision should it be, granted. Findings: A motion was made and seconded to accept the following finding of facts: 1. The applicant has offered to reduce the development intensity, on a lot that presently has two foundations capable of having an additional 10,000 sq. ft. of floor area to one building of 8,000 sq. ft. gross floor area. 2. The property abuts to the east the North Street public parking lot which is under utilized for most of the year. 3. The -two-foundations.-were_,in-place_-priornto the applicants purchase of the property. 4. In this Zone (Business B District) it is common for retail stores and offices adjacent public parking to use that fact as a basis for requesting a reduction of zoning required parking requirements. 5. Applicant has_ already contributed to the town in excess of $10,000 to redesign and landscape the parking lot to which these buildings abut. 6. During this period,I have worked with DPS, Board of Building .Regulations (BBRS) and Architectural Access Board (AAB) staff to become familiar with the history of each .unit; discuss remedies for existing challenges and plan a course for future successes. We have made significant progress in just a few short months,but there is much that.lies ahead. As the former Building Commissioner for the Town of Belmont, I recognize the importance of continued communication between this office and municipal inspectors. Consequently, it is my intent to periodically issue a notice that I have titled Commissioner's Memorandum which details topical issues and advices municipal inspectors of on-going activities. This is the first in a series of memorandums. House Bill 4550 House Bill 4550.is an Act Relative to Fire Safety in the Commonwealth that was signed by Governor Romney on Tuesday, August 17, 2004 during a ceremony which took place at the site of the Cocoanut Grove fire. The provisions of the bill take effect in 90 days (November 17, 2004) with the exception of the ticketing provision, which becomes effective on March 1, 2005. A copy of the bill may be downloaded by visiting http://www.mass.g_ov/legis/laws/seslaw04/slO4O3O4.htm. All building officials are encouraged to become familiar with the contents of the bill. f ' Formal training on the contents of the bill, resultant regulations and the role of both building and fire services will be offered in the near future. In the interim, the following plain language summary is provided for your information. The summary is provided courtesy of the Department of Fire Services (DFS). Enhanced Sprinkler Requirements The bill mandates sprinklers in all existing places of assembly designed or used as a nightclub, dance hall, discotheque or bar with occupancy.of 100 people or more. Requires that sprinkler design plans be submitted no later than 18 months after effective date of new law and that sprinkler installation be completed within 3 years. Exemptions: places of assembly principally used as a house of worship, restaurant,lecture hall,auditorium, and government or educational buildings. Requires sprinklers in such existing places of assembly that have an occupancy of less than 100 if the owner exceeds the maximum capacity of two or more times in one year or exceeds the capacity in excess of 1/z the maximum limit. Mandates sprinklers in a new or substantially altered building that includes a nightclub; dance- hall, discotheque or bar with a capacity of 100 persons or more which also contains one or more residential units. Allows the Building Code to mandate more stringent sprinkler requirements than this. Establishes accelerated capital depreciation deduction to allow recapture of costs from 39 years to 5 years as a way to ease the financial burden of sprinkler installation. New Procedures Requires establishments that serve alcoholic beverages on the premises to submit, on an annual basis, a fire and .building safety certificate of inspection to the Alcohol Beverage Control Commission as a condition of issuance or maintenance of the alcoholic beverage license. Creates new non-criminal procedures.for local and state fire and building code enforcement officers to issue "code violation notices," similar to a traffic.ticket that will notify the owner of the existence of a code violation. This will simplify the enforcement efforts and create a paper trail to identify habitual offenders and those who ignore the codes. Violations that are not corrected will result in the suspension or revocation of local and state permits, certificate or licenses associated with the premises. Enhanced Criminal Penalties Establishes specific criminal penalties for certain dangerous conditions in a public assembly building including: blocked ingress or egress; failure to maintain or the shutting off of fire protection systems; storing flammables or explosives or use of fireworks or pyrotechnics without a permit and exceeding occupancy limits. The first infraction will result in a.fine of not more than$5,000 and/or by imprisonment of not more than 21/i years. Subsequent infractions will result a fine of not more than $25,000 and/or imprisonment of up to five years. Creates a specific statutory crime for those individuals who willfully or wantonly violate provisions of the state building or fire codes when a violation results in significant injury or death. Violations will result in a fine of not more than$25,000 and/or imprisonment of up to five years. Creates enhanced penalties targeted at those individuals who, habitually do not comply with orders to correct fire or building code violations. Punishment for violations of this law will be a fine of up to $1,000 and/or by imprisonment of up to one year. Monetary Assistance Provides a $10,000,000 grant for the acquisition of firefighting equipment for local fire departments. Adds $1,078,666 in grant money to communities for student awareness fire education programs (SAFE). Includes$450,000 for fire and building inspector training programs Directs that portion of all fines,penalties or assessments received under the new code violation procedures be used for local and state enforcement, training and education of code enforcement officers. Future Program and Regulatory Development Calls for a special commission to investigate the feasibility of creating a mandatory municipal fire inspection program similar to the statewide program for building inspectors. Requires the appropriate Boards and Commission to continue to develop regulations and programs relating to: nightclub employee fire safety training, enhanced regulation of pyrotechnics, door and egress requirements,balanced design standards. Establishes an advisory council to make recommendations regarding the use of flame retardant building materials Seventh Edition of the State Building Code The Code for Single and Two Family Dwellings, based on the 2003 International Residential Code is nearing completion and is expected to be available sometime after the turn of the year following public hearings towards the end of this year. Development of the Base Code, modeled after the 2003 International Building Code, for all other building types is continuing. It is expected that work will conclude mid to late.next year with public hearings towards the end of 2005. Continuing Education Recently the DPS provided a Swimming Pool Safety,Seminar that was attended by over 200 municipal inspectors throughout the commonwealth. The seminar explored the safe construction and maintenance of both public and private swimming pools with a particular focus on enclosure requirements. It is hoped that the seminar's contents can be condensed into an informational bulletin for posting on the department's website. Coan and Thomas Gatzunis, Commissioner State Fire Marshal Department of Public Safety Date: September 1,2004 Subject: Licensed Sprinkler Contractors The Office of. the State Fire Marshal and the Department of Public Safety both have received numerous questions regarding licensed sprinkler contractors, journeymen, and apprentices. These licenses are all issued by the Department of Public Safety. The Department of Public Safety issues three types of licenses to members of the sprinkler industry, which are described below. A license is required when installing any part of a sprinkler system (e.g. pipe, hangers, sprinkler heads_, couplings.etc.). Sprinkler Contractor (SC): issued to the principal of the company, and a sprinkler contractor license is required to pull a permit under the State Fire Code or the State Building Code. The permit can be applied for by a person working " for the contractor;but a copy of the SC license should accompany the permit. Sprinkler Journeyman'(Sft A sprinkler journeyman must work for a sprinkler contractor. A sprinkler journeyman cannot operate a company and contract installation work. M r Sprinkler Apprentice (SA): issued to personnel working for a sprinkler contractor learning the sprinkler industry trade. A sprinkler apprentice must work under the direct supervision of a sprinkler journeyman. Further, MGL c. 146, §85A clearly identifies that ,a sprinkler contractor may employ multiple apprentices, but only one apprentice can be employed for each sprinkler journeyman, and the apprentice must be under the direct supervision of a sprinkler journeyman. During the June 24, 1998, meeting of the Bureau of Pipe fitters, Sprinkler fitters and Refrigeration Technicians, the Board determined that there is no restriction on the number of apprentices working under the direct supervision of a sprinkler journeyman on a job site provided that the one to one employment ratio has been satisfied. To provide further clarification, the Board has indicated that direct supervision means on the floor and general vicinity of the work-taking place. For example, the apprentice could not be working on the 3rd floor while the journeyman is working on the 4th floor. In this example, direct supervision would not be satisfied under the law. The Department of Public Safety and the Office of the State'Fire Marshal take the installation of automatic sprinklers seriously, and we are asking for your cooperation in reviewing licensed personnel during regular inspections. In the event that fire department personnel or local building officials are on site completing inspections, a review of professional licenses should be completed based on the descriptions above. Further, a sprinkler contractor may employ "non-licensed" personnel to run errands as may be necessary.
