Ayparently, Aticio's Landscaping & Painting are your current tenants. yesterday afternoon they were reported to be traveCing down Mulberry towing a trailer when some of their equipment in the trailer snagged the overhead telephone wires. This resulted a detachment of the gutters on the house located at 83 MuC6erry. I am informed that there is a witness who saw the entire incident (not the subject property owner). My findings are as follows : 1. The tenant maintains that the property has only been occupied by he and his wife and at no time have any other persons resided there. This seems to be consistent with my observation of vehicles at the property during both weekdays and weekends as the vehicles are not consistent. The tenant does agree that he has a large extended family who often visits on the weekends which may give a false appearance of overcrowding. With this being said I believe the notice of violation (chapter 240 - 11 A) and subsequent fine was issued without enough tangible evidence and should be reconsidered. 2. It is obvious that Mr. Amaral has parked commercial vehicles on the premises at various times and with various intensity over the last year. I have made it clear to Mr.Amaral that since he has obviously aggravated at least one neighbor, the presents of commercial vehicles at the property will only facilitate more complaints. These complaints will likely deteriorate our relationship with zoning enforcement and result in more citations and or fines. I'm not sure that the sporadic parking of commercial vehicles constitutes running a full scale business but I have made it clear that this practice cannot continue. 3. I would suggest to complainants that neighborhood speeding and or traffic violations should be reported to the police with as much detail as possible including the time, vehicle description and plate number if possible. 4. Impeding public access again should be reported to the police and any illegal business practices further investigated by zoning enforcement if you think it is warranted. After more follow through I have discovered that #83 Mulberry is located approximately five houses down from my property on the south side of the street. (my property is not visible from#83) There is a low phone wire at that location that could be caught by any delivery vehicle and should probably be raised. The fact that the property directly across from #83 is an eye soar with vehicles in disrepair and lack of general upkeep would leave me to believe that these complaints could be retaliatory in nature. The bottom line however, is this is not about a violation on a public way. It is about your rental property and tenants that are not cooperating with us. I continue to receive complaints about the storage of Champion Tree Work and Alicio's Painting trucks and equipment. I actually caught them there washing equipment on the side of Oak Street on an afternoon after receiving another complaint. To further clarify the situation, let me say that I am not pursuing a remedy with regards to the phone line issue and the alleged damage on Mulberry. And I also agree that the house number they provided is incorrect as I was unable to locate the subject house as well. At the time of this.report, I advised the person who contacted me that this is really a civil matter and they should be dealing with the truck driver or business directly or with an attorney and not through me. During that conversation, it was suggested that the property may be overcrowded (more than one family and or exceeding the occupancy proper bedrooms). (I have no evidence of a violation or compliance but I do know that Alicio is always there when I go by). Since I knew you are the owner, I thought I would contact you as a professional courtesy first. I believed that you would want to know about the complaints. I was hoping that you would intercede and inspire your tenants to behave without involving me since relocating the offending vehicles would benefit you as well comply with the ordinance. If overcrowding is an issue, this information would also benefit you by saving unnecessary wear and tear on your property and irritating your neighbors. If you inspected the property and found there to be overcrowding, it would likely have involved unsafe conditions; preventative action on your part could avert a tragedy and thereby a liability if a tragedy were to occur. Landlords are in fact responsible for their properties and all activities that occur there. if tenants do not abide by the conditions of a lease or otherwise utilize a property in a manner not consistent with the governing zoning (single-family ) a landlord may choose to order the tenant to comply and cease the offending activity or in the alternative choose to not renew a lease. If the landlord determines there to be a current breech of contract it is certainly within the landlord's right to to threaten or commence eviction. If a landlord does not cooperate with.Regulatory officials he/she has the right to state his/her case before a magistrate or judge during an appeal process. Again, I am respectfully requesting your assistance with this matter, I need assurance from you that the property is occupied by what ever.number of occupants is listed on the lease and no others.
