The applicants are seeking to expand the existing dwelling and detached accessory garage with a proposed addition to the dwelling and demolition of the garage,and rebuilding a new attached garage. A new deck is also being proposed to the rear of the'dwelling. The dwelling is a two-story,three-bedroom structure with a living area of 1,515 _—sq.ft.The_detached-garage-is-described-as-being 200-sq-ft.—and-in-poor-condition. — — Procedural &Hearing Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on May 24,2004. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened August 18,2004,at which time the Board found to grant the appeal Board Members deciding this appeal were: Sheila Geiler,Jeremy Gilmore, James Hatfield and Acting Chairman Richard L.Boy. The applicants who were present at the public hearing were represented by Attorney Brian Wall. Also present to assist,was Ms Arlene Wilson of A.M.Wilson Associates,environmental consultant. Acting Chairman Richard L.Boy noted that only four members were present and that a positive vote of all four members would be required for the grant of the appeal. Mr.Wall stated that he understood this and was willing to proceed with the four member board. Mr.Wall explained that this appeal was request for a special permit to allow for the expansion of the single family dwelling not in conformity to the required 35 foot setback from wetlands. He cited that the dwelling predates zoning and now does not conform to the required setbacks from wetlands and required front yard setbacks. They would eliminate the front yard setback encroachment with the demolition of the detached garage. However,they would be more encroaching into the wetland setback with the additions and decks being proposed. The closest point of the proposed structure is 19.6 feet to wetlands. Mr.Wall noted that a letter was submitted from the site engineer,Arne H. Ojala documenting that the first floor elevation was 10.66 feet and that that elevation met the requirements for flood proofing. Mr.Wall presented elevation of the proposed building and remarked that this would be a great improvement to the neighborhood especially given that the home was directly across for the Kennedy Memorial, a very popular area with-visitors and local residents.He also submitted pictures of the existing site and buildings,noting that the conditions for the garage were poor and in needed of being improved. Mr.Wall cited that the proposal was before the Conservation Commission and it was approved subject to a reduction in the outdoor parking area. The plan before the Zoning Board for approval is that revised plan showing a reduced outdoor parking area. The Acting Chairman asked for public comment and a Mr.Robert Carr asked if the new addition would be taller than the existing structure and it was noted that the roof line would be slightly higher.
