Dear Commissioner DeMatteo,
l very Much appreciate the time you took with me on the phone yesterday. As I indicated, I am trying
to help my son out with his property at 433 Ocean Street. It seems he is in one of those catch 22
situations with no clear resolution.
As I understand it,the plumber who installed the new heating unit and gas service failed to secure a
permit in advance of doing the work. Had he done so,this issues may have been flushed out
before work was completed. Right now, Stephen has a tenant who is holed up in a hotel, and the
daily rate is killing him.
As I further understand i:,the issue is the interpretation of the State Building Code by inspector-
Perry. I hope I am not incorrect in this assumption. The referenced section 3107.7 regarding the
protection of mechanical and electrical equipment is the language being used to deny the permit.
It is my interpretation, as well as that of my code consultant, Robert Sullivan Associates,that this
section applies to new construction and substantial alterations as defined in 780 CMR 3107.0. This
only makes sense as the entire house is below the flood plain, and the Code clearly doesn't intend
to prevent a homeowner from doing proper and appropriate repairs.
The statement that 3107.10 doesn't apply, and that 3107.7 stands alone is not, in my opinion,
correct or appropriate given the circurnstances.
My son has a new infart daughter who is having some health issues, and I request your
intervention to bring this to a conclusion. This problem is causing his family undue stress and
hardship at a time they can hardly afford it. He thought he was doing the right thing by employing a
licensed plumber, negotiating an alternative fuel source with the gas company, and doing the job
well.
It it helps, he is willing to raise-the new burneranother 8"to10"off th6floor and.,work with.Inspector
Perry to implement feasible improveents,,but little else is possible given the constraints of the
existing property. --
