Attorney Henderson said that this package was given to all registered bidders for 565, 557 and 549 Ocean St. and that a similar package was given to those bidding on the other 5 properties. There were no extras of that one but he showed me the last page,which also was a copy,of your letter. In addition he made a statement,before he started the bidding,that it was the building commissioner's opinion that all 8 properties were single family homes,period-but that any purchaser would have rights under the Zoning By-law to go to the ZBA. In answer to questions,he also said that there were some provisions under the ordinances for renting to lodgers but that the Building Dept.would have to be consulted in that case. The lots are shown on Assessor's Map 324 as Parcels 43, 45, 48-2, 49, 113, 114 and 117. They are addressed as 493, 503, 511, 525, 535, 549 and 557 Ocean St., Hyannis. Each lot is improved with a wood frame house. These were originally individual units of the"Sun `n' Surf Motel,"which was built in the 1960's. According to Assessor's records, each house has contained six bathrooms since the mid-1970's. Building Department records show that at various times during the 1970's and 1980's, dormers were added to many of the structures. According to Building Department records, the interiors consist of six motel-type units with their own bathroom. The buildings are now used as lodging houses for six lodgers each. There have been reports that the basements are also occupied. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 1, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 25, 1996, at which time the Board found to grant the Special Permit with conditions. Board Members hearing these appeals were Richard Boy, Emmett Glynn, Ron Jansson, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Benjamin E. Zehnder represented the Applicants. The Board and Attorney Zehnder agreed to have Appeal Number 1996-119 through Appeal Number 1996-125 heard together. Also present was Marie Dempsey. Hearing Summary: Attorney Zehnder gave a history of the property stating it was formerly known as the Sun `N Surf Motel and owned by Richard Vendola. The property was foreclosed upon by the bank, Cape Cod Bank and Trust Co., who then resold the units to the Petitioners. There is a total of seven buildings. One building is owned by Ms. Dempsey, three are owned by Mr. Breitkopf and three units are owned by a corporation. Mr. Breitkopf is a principle of Secured Capital Corp. of NY and Ms. Dempsey is related to an officer of Secured Capital Corp. of NY. The properties are being operated conjunctively but individually owned as investment property. The properties were built in the early 1960s and have always been used as a motel or lodging house. The property has never been given relief from zoning. The lodging licenses that are currently on the property were issued until August 11, 1996 and extended to December 31, 1996 while the I `'toning Board of Appeals Decision and Notice Appeal No. 1996-121 Jack Breitkopf applicants are applying for zoning relief. The Applicant would like to use this property as it has been historically used since the property has been in existence. Attorney Zehnder showed the Board the Assessor's Maps of the vicinity of the locus which shows there are three hotels, and many, many lodging houses, including several bed and breakfast homes. The use is very typical for the area and granting the Special Permit would not be detrimental to the neighborhood. The property is now being renovated. Regarding parking, Mr. Zehnder indicated that since the Petitioner is limited to 6 lodgers,they feel they only need 6 spaces, the owners are allowing "cross use"of the property to make up the differences in parking requirements. There is an undeveloped lot (Assessor's Lot 44) and the applicants would be willing to make spaces available on that lot if the Board felt it necessary. Public comments: Chairman Gail Nightingale indicated there are twenty-six (26) letters in the file in opposition to these appeals. Their names were read into the record. Marie Dempsey(the applicant) spoke in support of the appeal. Also speaking was Attorney Charles Sabatt. He represented a number of abutters who in the Yachtsman Condominiums across the street. They are in opposition to these appeals. He stated that the houses need to be owner occupied if they are to rent rooms as that is clearly what the Zoning Ordinance allows for. He explained how there is not adequate parking for lodgers in this highly congested area. If the Board grants their request, there is the potential for 42 lodgers at any given time which equates to the potential of 42 cars. This area cannot handle that influx. Also, there are no sidewalk available. Attorney Sabatt told the Board that there have been many police calls to the area and to grant the relief would be in derogation of the spirit and intent of the Zoning Ordinance. Also speaking in opposition was Hugh Findlay. In rebuttal, Attorney Zehnder stated the historical use of the property has always been as a lodging house. As far as the parking issue, to grant the relief would not be more detrimental to the area as it is already congested. He stressed that the Special Permits would be within the spirit and intent of the Zoning Ordinance. The Board was concerned with the number of calls to the police station. Attorney Zehnder explained that those tenants are no longer in the units and have been evicted. Findings of Fact: Based upon the testimony given during the public hearing on Appeal Number 1996-121, the Board unanimously found the following findings of fact: 1. The applicant is Jack Breitkopf. 2. The property in issue is 557 Ocean Street, Hyannis, MA on Assessor's Map 324, Parcel 43 in an R.B Residential B Zoning District. 3. The Petitioner is seeking a Special Permit to allow the renting of rooms to not more than six lodgers in a multi-unit dwelling. The applicant is also seeking a Special Permit for the Reduction of Parking Requirements. 4. The lot itself provides for six parking spaces although the Town of Barnstable Zoning Ordinance requires 1.2 parking spaces for each lodger. 5. The area of Ocean Street and Gosnold Street experiences congested traffic in the summer due to its location near the Hyannis Terminal of the Steamship Authority and its location near the various public beaches in the area. 6. To grant the relief being sought for six lodgers would be in derogation of the spirit and intent of the Town of Barnstable Zoning Ordinance with regards to the parking regulations. 7. Given the parking situations, the granting of the relief for six lodgers would be detrimental to the neighborhood. Decision: Based upon the positive findings a motion was duly made and seconded to grant the relief as follows: 1. The property is to be used for not more than four lodgers at any one time. 2. The Petitioner must comply with all rules and regulations that would be imposed by the Licensing Authority with reference to the operation of a lodging house. —3. A lodging house permit must be secured at all applicable times for the site. 4. All six parking spaces shown on the plans submitted must be utilized for the use of the Petitioner's lot. This parking is dedicated for this unit only and not to be shared with adjoining lots. 2 'IZoning Board of Appeals Decision and Notice Appeal No. 1996-121 Jack Breitkopf 5. There shall be no backing out onto Ocean Street. Parking is to be so constructed that the cars exit from the lot head-on only. The plans are to be approved by the Building Commissioner. 6. The Special Permit shall run with the owner only. In the event the owner transfers his interest in the property, the Special Permit shall terminate. The vote was as follows: AYE: Elizabeth Nilsson, Ron Jansson, Emmett Glynn, Richard Boy, and Chairman Gail Nightingale NAY: None ORDER: In Appeal Number 1996-121,the Special Permit has been granted for four lodgers. This decision must be recorded at the Registry of Deeds for it to be in effect. The relief authorized by this decision must be exercised in one year. The lots are shown on Assessor's Map 324 as Parcels 43, 45, 48-2, 49, 113, 114 and 117. They are addressed as 493, 503, 511, 525, 535, 549 and 557 Ocean St., Hyannis. Each lot is improved with a wood frame house. These were originally individual units of the"Sun 'n' Surf Motel,"which was built in the 1960's.According to Assessor's records, each house has contained six bathrooms since the mid-1970's. Building Department records show that at various times during the 1970's and 1980's, dormers were added to many of the structures. According to Building Department records, the interiors consist of six motel-type units with their own bathroom. The buildings are now used as lodging houses for six lodgers each. There have been reports that the basements are also occupied. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 1, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened September 25, 1996, at which time the Board found to grant the Special Permit with conditions. Board Members hearing these appeals were Richard Boy, Emmett Glynn, Ron Jansson, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Benjamin E. Zehnder represented the Applicants. The Board and Attorney Zehnder agreed to have Appeal Number 1996-119 through Appeal Number 1996-125 heard together. Also present was Marie Dempsey. Hearing Summary: Attorney Zehnder gave a history of the property stating it was formerly known as the Sun 'N Surf Motel and owned by Richard Vendola. The property was foreclosed upon by the bank, Cape Cod Bank and Trust Co., who then resold the units to the Petitioners. There is a total of seven buildings. One building is owned by Ms. Dempsey, three are owned by Mr. Breitkopf and three units are owned by a corporation. Mr. Breitkopf is a principle of Secured Capital Corp. of NY and Ms. Dempsey is related to an officer of Secured Capital Corp. of NY. The properties are being operated conjunctively but individually owned as investment property. The properties were built in the early 1960s and have always been used as a motel or lodging house. The property has never been given relief from zoning. The lodging licenses that are currently on the property were issued until August 11, 1996 and extended to December 31, 1996 while the ��9met Zoning Board of Appeals Decision and Notice Appeal No. 1996-121 Jack Breitkopf applicants are applying for zoning relief. The Applicant would like to use this property as it has been historically used since the property has been in existence. Attorney Zehnder showed the Board the Assessor's Maps of the vicinity of the locus which shows there are three hotels, and many, many lodging houses, including several bed and breakfast homes. The use is very typical for the area and granting the Special Permit would not be detrimental to the neighborhood. The property is now being renovated. Regarding parking, Mr. Zehnder indicated that since the Petitioner is limited to 6 lodgers, they feel they only need 6 spaces, the owners are allowing"cross use"of the property to make up the differences in parking requirements. There is an undeveloped lot(Assessor's Lot 44)and the applicants would be willing to make spaces available on that lot if the Board felt it necessary. Public comments: Chairman Gail Nightingale indicated there are twenty-six(26) letters in the file in opposition to these appeals. Their names were read into the record. Marie Dempsey (the applicant) spoke in support of the appeal. Also speaking was Attorney Charles Sabatt. He represented a number of abutters who in the Yachtsman Condominiums across the street. They are in opposition to these appeals. He stated that the houses need to be owner occupied if they are to rent rooms as that is clearly what the Zoning Ordinance allows for. He explained how there is not adequate parking for lodgers in this highly congested area. If the Board grants their request, there is the potential for 42 lodgers at any given time which equates to the potential of 42 cars. This area cannot handle that influx. Also, there are no sidewalk available. Attorney Sabatt told the Board that there have been many police calls to the area and to grant the relief would be in derogation of the spirit and intent of the Zoning Ordinance. Also speaking in opposition was Hugh Findlay. In rebuttal, Attorney Zehnder stated the historical use of the property has always been as a lodging house. As far as the parking issue, to grant the relief would not be more detrimental to the area as it is already congested. He stressed that the Special Permits would be within the spirit and intent of the Zoning Ordinance. The Board was concerned with the number of calls to the police station. Attorney Zehnder explained that those tenants are no longer in the units and have been evicted. Findings of Fact: Based upon the testimony given during the public hearing on Appeal Number 1996-121, the Board unanimously found the following findings of fact: 1. The applicant is Jack Breitkopf. 2. The property in issue is 557 Ocean Street, Hyannis, MA on Assessor's Map 324, Parcel 43 in an R.B Residential B Zoning District. 3. The Petitioner is seeking a Special Permit to allow the renting of rooms to not more than six lodgers in a multi-unit dwelling. The applicant is also seeking a Special Permit for the Reduction of Parking Requirements. 4. The lot itself provides for six parking spaces although the Town of Barnstable Zoning Ordinance requires 1.2 parking spaces for each lodger. .5. The area of Ocean Street and Gosnold Street experiences congested traffic in the summer due to its location near the Hyannis Terminal of the Steamship Authority and its location near the various public beaches in the area. 6. To grant the relief being sought for six lodgers would be in derogation of the spirit and intent of the Town of Barnstable Zoning Ordinance with regards to the parking regulations. 7. Given the parking situations, the granting of the relief for six lodgers would be detrimental to the neighborhood. Decision: Based upon the positive findings a motion was duly made and seconded to grant the relief as follows: 1. The property is to be used for not more than four lodgers at any one time. 2. The Petitioner must comply with all rules and regulations that would be imposed by the Licensing Authority with reference to the operation of a lodging house. 3. The above referenced properties are 3 single-family homes with#557 being owner- occupied. This office realizes#565 has had numerous complaints going back to at least 2001. There have been no problems brought to my attention within the past year at this address. I met with the owners of these properties on June 19,2003 so I could view the properties myself. The owner of#565 admitted there had been problems with a group they had rented to last summer. The owner has taken steps to not rent to that particular group in the future. In the pictures you provided there appears to be eight cars in the parking area beside the house. How many people this could translate to is hard to come to because of all the variables involved.We have kept an eye on the property by driving by early in the morning and in the early evening and also requested the police keep an extra eye on the property for over crowding.We found no evidence of any over crowding. So far this year the group renting the house at the time the pictures were taken was an environmental group doing studies in the area. The interior of the house shows no signs of it being abused or over crowded. The interior is clean and well kept and the owners wish that it stay in this condition. As a result,they have become more selective in choosing their tenants. There is a notation on the picture that there is no parking for this property and the abutting lot is the Town's property. The assessor's maps show there is a minimum of 30 feet from the house to the property line,not against the house as indicated in the picture. If the occupants were parking on Town property,it would constitute trespassing and this would be enforced by the Police Department,not the Building Department. I have also visited#557 and#549 Ocean Street in Hyannis. These dwellings are similar in layout and are in just as good condition if not better and just as well maintained as#565.#557 Ocean Street is owner occupied and is not rented out in any manner at this time.#549 Ocean Street is rented on a weekly basis by the owners who occupy#557 Ocean Street. The zoning ordinance allows a person to rent rooms to not more than 3 non-family members by the family residing in the single-family dwelling. The ordinance does not restrict a homeowner to only renting to three people. It is my opinion that these houses are within their bounds of the zoning ordinance.There is no prohibition of renting a dwelling in the manner that is currently occurring. This letter is a demand for enforcement pursuant to Massachusetts General Laws, Chapter 40A, Section 7 and Section 13. The above described parcels are located within an RB Residential District for which the principal permitted use is a single family residential dwelling. One of the accessory uses permitted within an RB District is the "renting of rooms for not more x . than three (3) non-family members by the family residing in a single-family dwelling." Thomas Perry Page 2 June 4, 2003 According to my clients for the past several years each of the above referenced properties, and in particular 565 Ocean Street have been occupied during the summer and especially on weekends by large groups of as many as twenty (20) or thirty (30) young people. There have been ongoing continuous parties, noise, drinking, and generally offensive and loud conduct. There are cars and vehicles parked all over the area including a town owned parcel directly abutting 565 Ocean Street. The use of these properties by these uncontrolled groups has had a significant deleterious effect upon the residents of the Yachtsman Condominium most of whom are families with children. The quiet enjoyment of their properties has been significantly disrupted and the values of their properties diminished by the ongoing disruptions emanating from the above referenced properties. In 1996 the owner of the three properties applied for special permits from the Barnstable Zoning Board of Appeals to permit him to rent each of the dwellings to six (6) lodgers. The Barnstable Zoning Board of Appeals denied the requested relief, notwithstanding the fact that according to the assessor's records each of these structures contains six (6) bedrooms and six (6) bathrooms. Nonetheless, under the applicable zoning regulations quoted above the owner of the above structures are limited to the renting of rooms to no more than three (3) non-family members by a family residing within each of the dwellings. Since 1996 these properties, and again in particular 565 Ocean Street, have been the subject of ongoing investigations and enforcement actions by your office. Most recently on March 20, 2003 you sent a warning notice to Ms. Arlene C. Latimer the owner of 565 Ocean Street in which you admonished her that if there were further problems with the property that you would take immediate action "...to vacate the building." I regret to advise you that since your letter there has been no abatement of the problem and during each weekend the properties are occupied by large, boisterous, loud, and obnoxious groups. I am enclosing herewith for your reference a photograph of 565 Ocean Street taken on May 1, 2003 which shows numerous vehicles parked outside of the property and on the parcel owned by the Town of Barnstable as evidence of the occupancy of the structure. It would appear that the property owners of the above referenced parcels are operating in violation of current zoning in that they are renting to more than three (3) dodgers and it would appear that there is no family which is resident within the dwelling acting as the landlord or supervisor of the residents' conduct. i I Thomas Perry Page 3 June 4, 2003 By reason of the foregoing, I hereby request that you undertake one or more of the following actions: 1. Issue a cease and desist order to each of the property owners prohibiting them from renting any of the property; and/or 2. Revoke the occupancy permits for each of the dwellings; and/or 3. Take appropriate enforcement through an equitable action filed in the Barnstable Superior Court or elsewhere to restrain and enjoin the owners from renting these dwellings; and/or 5. The lots are shown on Assessor's Map 324 as Parcels 43,45,48-2,49, 113, 114 and 117. They are addressed as 493, 503, 511, 525, 535, 549 and 557 Ocean St., Hyannis. Each lot is improved with a wood frame house. These were originally individual units of the"Sun 'n' Surf Motel,"which was built in the 1960's:According to Assessor's records, each house has contained six bathrooms since the mid-1970's. Building Department records show that at various times during the 1970's and 1980's, dormers were added to many of the structures. According to Building Department records, the interiors consist of six motel-type units with their own bathroom. The buildings are now used as lodging houses for six lodgers each. There have been reports that the basements are also occupied. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on August 1, 1996. A public hearing before the Zoning Board of Appeals was duly advertised and notices _ sent to all abutters in accordance with MGL Chapter 40A. Board Members hearing these appeals were Richard Boy, Emmett Glynn, Ron Jansson, Elizabeth Nilsson, and Chairman Gail Nightingale. Attorney Benjamin E.Zehnder represented the Applicants. The Board and Attomey Zehnder agreed to have Appeal Number 1996-119 through Appeal Number 1996-125 heard together. Also present was Marie Dempsey. Hearing Summary: Attorney Zehnder gave a history of the property stating it was formerly known as the Sun W Surf Motel and owned by Richard Vendola. The property was foreclosed upon by the bank, Cape Cod Bank and Trust Co., who then resold the units to the Petitioners. There is a total of seven buildings. One building is owned by Ms. Dempsey, three are owned by Mr. Breitkopf and three units are owned by a corporation. Mr. Breitkopf is a principle of Secured Capital Corp. of NY and Ms. Dempsey is related to an officer of Secured Capital Corp. of NY. The properties are being operated conjunctively but individually owned as investment property. The properties were built in the early 1960s and have always been used as a motel or lodging house. The property has never been given relief from zoning. The lodging licenses that are currently on the property were issued until August 11, 1996 and extended to December 31, 1996 while the Zoning Board of Appeals Decision and Notice Appeal No. 1996-121 Jack Breitkopf applicants are applying for zoning relief. The Applicant would like to use this property as it has been historically used since the property has been in existence. Attorney Zehnder showed the Board the Assessor's Maps of the vicinity of the locus which shows there are three hotels, and many, many lodging houses, including several bed and breakfast homes. The use is very typical for the area and granting the Special Permit would not be detrimental to the neighborhood. The property is now being renovated. Regarding parking, Mr. Zehnder indicated that since the Petitioner is limited to 6 lodgers, they feel they only need 6 spaces, the owners are allowing"cross use"of the property to make up the differences in parking requirements. There is an undeveloped lot(Assessor's Lot 44)and the applicants would be willing to make spaces available on that lot if the Board felt it necessary. Public comments: Chairman Gail Nightingale indicated there are twenty-six(26) letters in the file in opposition to these appeals. Their names were read into the record. Marie Dempsey (the applicant) spoke in support of the appeal. Also speaking was Attorney Charles Sabatt. He represented a number of abutters who in the Yachtsman Condominiums across the street. They are in opposition to these appeals. He stated that the houses need to be owner occupied if they are to rent rooms as that is clearly what the Zoning Ordinance allows for. He explained how there is not adequate parking for lodgers in this highly congested area. If the Board grants their request, there is the potential for 42 lodgers at any given time which equates to the potential of 42 cars. This area cannot handle that influx. Also, there are no sidewalk available. Attorney Sabatt told the Board that there have been many police calls to the area and to grant the relief would be in derogation of the spirit and intent of the Zoning Ordinance. Also speaking in opposition was Hugh Findlay. In rebuttal,Attorney Zehnder stated the historical use of the property has always been as a lodging house. As far as the parking issue, to grant the relief would not be more detrimental to the area as it is already congested. He stressed that the Special Permits would be within the spirit and intent of the Zoning Ordinance. The Board was concerned with the number of calls to the police station. Attorney Zehnder explained that those tenants are no longer in the units and have been evicted. Findings of Fact: Based upon the testimony given during the public hearing on Appeal Number 1996-121, the Board unanimously found the following findings of fact: 1. The area of Ocean Street and Gosnold Street experiences congested traffic in the summer due to its location near the Hyannis Terminal of the Steamship Authority and its location near the various public beaches in the area. 6. To grant the relief being sought for six lodgers would be in derogation of the spirit and intent of the Town of Barnstable Zoning Ordinance with regards to the parking regulations. 7. Given the parking situations, the granting of the relief for six lodgers would be detrimental to the neighborhood.. It is owned by Marula Trust, and has been in essentially the same ownership since it was constructed in 1965. It contains a 2,415 sq. ft. gas station. which has an inspection station and indoor service area (each occupying one bay,) and is located in the HB Highway Business Zoning District, with a small portion of the lot in the B.Business District. The applicant is requesting.a variance to allow construction of a 40' x.50' canopy over the gas pump islands. A 100' setback is required under the zoning ordinance and the applicant proposes a 2' setback. History/ Present Request: Since the site is located in the GP Groundwater Protection District, where underground tanks and auto repair are prohibited, the gas station is a pre-existing nonconforming use. The applicant previously requested approval of two islands with a canopy in-1983, which was denied due to the setback requirement(Appeal No. 1983-76.) A variance for two full service islands (with no canopy)was granted later that year(Appeal No. 1983-104.) Another petition for a canopy was denied in 1986 (Appeal No. 1986-57) in part on the grounds of being detrimental to an overly congested area. In 1991, an application was made for a car wash and mini-mart on the site. The applicant also proposed to move the pumps back 35'from the road and relocate the building behind the 100' setback. These were considered by the Building Commissioner at the time as permitted accessory uses with the issue before the Board was the variance for the canopy within the front setback. This application was denied by the Zoning Board of Appeals (Appeal No. 199140.) Variance: In consideration for the Variance, the applicant must substantiate those conditions unique to this lot that justify the granting of the relief being sought. Staff Review& Recommendation: The proposed 2' setback will bring the canopy practically adjacent to Route 132. This is a very busy section of roadway, with entrances to Festival Mall, Crossroads Condominiums, Cooke's Seafood, Red Lobster, etc. all within a very short stretch. A canopy could pose an additional distraction in this area, particularly given possible lighting and signage, the proposed large size and lack of adequate setback to Route 132; In 1991, one of the findings made by the Board was"The fact that the town has recently widen(ed)the roadway surface of Route 132 in this area, within the legal right of way established for the road, does not constitute a Variance condition in itself." The property is located in the GP Groundwater Protection District, where 50% of the site is required to be pervious and 30% left in its natural state. This could be accomplished at least in part by removing some of the pavement to the rear of the lot, which apparently is unused for parking or circulation. If the Board finds to grant this variance, they may wish to consider the following conditions: 1. There shall be no further pavement of the lot. 2. No use other than a gas station is permitted without specific authorization from the Zoning Board of Appeals. No sale of items other than those relating to use as a gas station will be permitted. 3. There shall be no increase in the number of pumps at the gas station. 4. All signs must meet the requirements of the Town of Barnstable zoning ordinance. The applicant's site is shown on Assessor's Map/Parcel Number 273/079, commonly addressed as Texaco Gas Station, Route 132, Hyannis, MA, and is zoned HB, Highway Business District and GP, Groundwater Protection Overlay District. The applicant's request was heard by Board members: Gail Nightingale, Richard Boy, Bruce Burlingame, Gene Burman and Chairman Luke Lally. Summary of Evidence: The applicant was represented by Attorney Thomas McNulty. ' Also present were; Kevin Wentworth, 'the station operator, Mr. Micale, project engineer, Mr. McDonough, traffic consultants and Roger Salman, representative of Star Enterprise. Attorney McNulty presented the request for a Variance and discussed the plans to improve the site which included the rebuilding of the station and the inclusion of a food-mart and a car wash facility. He suggested that no Special Permit is needed to accomplish the plans, only a variance from the required 100 foot front yard setback onto to Route 132 for the location of the canopy structure is needed. Attorney McNulty noted that a 1986 request for the construction of a canopy was denied but that this request is a new proposal. The Board questioned the Variance conditions suggested. Specifically the Board discussed the applicants interpretation that Variance conditions exist by the facts that part of the roadway right-of-way is being used by the applicant in the operations of the gas station and that the expansion (widening) of the roadway has infringed upon the uses of the site. The Board also examined the plans as related to the Groundwater Overlay District and the requirement of that overlay district that no more than 5.0% of the total land area shall be made impervious and that a minimum of 30% shall be retained in a natural state. The plans presented showed 75% of the site was impervious. In further review of the plans, the Board questioned the additional uses (mini-mart and car wash) being proposed and the required extent of development, in terms .of parking requirements and paved movement area needed to accommodate the proposed additional uses. The public was invited to speak. Joseph Bartell, representing the Festival at Hyannis discussed the desire for unified green Y space between the two developments. He suggested the desire for an attractive landscape as the site borders on to the driveways of the Festival. Michelle Flaherty of the New England Car wash Association was present to discuss the image of the car wash industry. She submitted a letter and report dealing with the standards being developed for the car wash industry. Ms. Flaherty in her testimony before the Board is not against the petition, but is present to inform the Board. The station operator, Kevin Wentworth, spoke in support of the. petition. Finding of Facts. At the September 28, 1991 meeting, the Zoning Board of Appeals made the following finding of facts as related to Appeal #1991-40 1. The plan presented is less detrimental than the existing site conditions. 2 . The plan submitted, was processed through Site Plan Review and was found "approvable" by Site Plan Review Committee. 3. Variance conditions, as required under Section 10 of Chapter 40A have not been demonstrated to the Board. 4 . Although the relocation of the gas pump islands further off of Route 132 would be a positive move, the proposed accessory use is an over intensification of the site, given its size and .location, and would create definite public safety problems in the area. 5. Within the HB, Highway Business District, Accessory Uses (Section 3-3.6(2) of the Zoning Ordinance) are not itemized. Other proposed uses to the principal use would require a Special Permit as per Conditional Uses (Section 3-3.6 (3) ) . i 6. Route 1.32 is one of the most heavily travelled roads on. Cape Cod. This project as proposed will generate traffic and further create problems in the area. 7 . This canopy will provide protection and comfort for the customers of the station. The pumps are located within the setback area of Route 132, being a non-conforming use. The proposed canopy will be 32' x 56' and cover both of .the islands. The petitioner comes right to. the lot line and sideline of the road. lay- out. The Board has serious concerns over the canopy use - this would encourage a self-service station and would substantially increase the traffic on this already congested road. This petitioner appeared before the Board and the site was the subject of a variance to allow the construction of two parallel gasoline islands within the setback area. The Board granted the variance with the restriction.of the installation of canopies, Appeal No. 1983-104. Our concerns at that time to allow no canopies sti11 exists, specifically, that. it would encourage a self-serve gas station. Gail Nightingale moved to deny the petition as it would/substantially more detrimental to an already overly congested area; to allow this would be in derogation of the spirit and intent of the zoning by-laws as they relate to the safety and welfare of the inhabitants of the Town. Appeal No 1983-104-_...._._. 2 2 ., Page ... of On - December 1 , _ __ -__ _- ,_ ._ 19 .._ , The Board of Appeals found Attorney Peter O'Keefe represented the petitioner, Kevin Wentworth, owner of the gas station located on Route 132, Hyannis in a Business Zoned District. The petitioner is appealing for a variance from setback requirements to construct two parallel gasoline .islands. One existing gasoline pump island' is within the setback encroachment - which pre-exists zoning -- this will be removed and replaced with two parallel islands - identi®1 to the one presently on the site '(34X4X6) - one of these two projected islands will be seven feet closer to Route 1 32, and the other one will be 20 feet further back from Routn_1.32. . The existing structures on this lot govern or determine where we can put the second gasoline pump island - specifically, the existing garage, loading dock, underground storage, etc. , all of which were built. in 1965. Since that time the public need has changed considerably, as well as the traffic patterns in the area. We are not putting in any major structures - there will be no new lights, signs, or pumps, and the visibility from the road will remain as it is now. If this variance is denied, it will be a severe hardship - the station cannot. serve the public, in the future, with only one gas- oline pump island, without adding congestion, due to vehicles entering and exiting the station on Route 132. This can be solved by adding the two parallel! islands which will create a better traffic flow pattern. This station . .is one of the last independently owned stations 'in the neighborhood - it provides a service to the community, that the company owned stations eliminate, namely the service aspect. It is critical that we have these two pumps so that we might maintain service to . our customers, and also continue to employ our current staff of ten. This is a well-run station with the owner on the premises - i:t is kept neat and clean. The visual impact will be minimal traffic congestion will be eliminated. The petitioner states that currently there is no self service; however, he contemplated using the outside island for self service, but this is not a must - one pump would be self service and one to'be,. attendant service. The petitioner would accept the restriction that both islands be full service. A letter has been submitted by Fire Chiefs Richard Farrenkoof=_of the Hyannis Fire Distria stating that he requires a canopy over the self-service islands. The peditioner desires: to have both the is ands and he will provide full service, thus eliminating the need for a canopy.The Board voted unanimously .to grant the petitioner a variance for two full service islands only. hestricts 6he installation of a canopy (s) . The applicant explained that he is tryina to.imDrove the facility so that it will meet the requirements of .the . community. The proposed canopy would be 32 x 56 and would cover the entire island area directly to the lot line. Mr. Lallu said,he is in sympathy with Mr. Wentworth and realizes that he is trying to get easier egress. Also mentioned was the fact . that this would involve a large investment for;Texaco. The Board felt that they. . would like definitive measurements from the petitioners. Mary Anne Strayer, Vice-Chairman of the Planning Board spoke in reference to this appeal and told the Board that the Planning Board voted to change the setbacks on Route 132 from 501- 100' running from the Airport Rotary to the Mid Cape Highway. Paul Brown, Chairman of the Planninq Board requested to view the plans. The Board voted unanimously to deny the petitioner a variance because it was in complete derogation of Section L, Appendix B (1) , front yard setback in Business District along Route 132 shall be 50 feet. As quoted from the"law", an employee is defined as every person in the service of another under any contract of hire, express or implied, oral or written. An employer is defined as an individual,partnership, association, corporation or other legal entity, or any two or more of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. However the owner of a. dwelling house having not more than three apartments and who resides therein, or the occupant of the dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer. MGL chapter 152 section 25 also states that every state or local licensing agency shall withhold the issuance or renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any applicant who has not produced acceptable evidence of compliance with the insurance coverage required. Additionally,neither the commonwealth nor any of its political subdivisions shall enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance requirements of this chapter have been presented to the contracting authority.
