Massachusetts General Laws chapter 152 requires all employers to provide workers' compensation for their employees.
Pursuant to this statute, an employee is defined as"...every person in the service of another under any contract of hire,
express lied,oral or written."

An employer is defined as "an individual,partnership, association, corporation or other legal.entity, or any two or more
of the foregoing engaged in a joint enterprise, and including the legal representatives of a deceased employer, or the
receiver or trustee of an individual,partnership, association or other legal entity, employing employees. However the
owner of a dwelling house having not more than three apartments and who resides therein, or the occupant of the
dwelling house of another who employs persons to do maintenance, construction or repair work on such dwelling house
or on the grounds or building appurtenant thereto shall not because of such employment be deemed to be an employer."
MGL chapter 152, §25C(6)also states that"every state or local licensing agency shall withhold the issuance or .
renewal of a license or permit to operate a business or to construct buildings in the commonwealth for any
applicant who has not produced acceptable evidence of compliance with the insurance coverage required."
Additionally,MGL chapter 152,.§25C(7)states"Neither the commonwealth nor any of its political subdivisions shall
enter into any contract for the performance of public work until acceptable evidence of compliance with the insurance
requirements of this chapter have been presented to the contracting authority."

Dear Tom:
This correspondence is sent on behalf of our client, 77 Old Yarmouth Realty, LLC,
with reference to its proposal remodel the interior of the existing structure located at 77 Old
Yarmouth Road in Hyannis. As was described,at the January 15, 20,04 Site Plan Review
hearing on this matter, the applicant proposes to move the existing,two bedroom second story
apartment to the first floor and convert"`the apartment.into a•one bedroom apartment. The
remaining area within the structure will be utilized for long term storage associated with the
applicant's clothing store, Puritan Clothing, located on Main Street in Hyannis.
As you will recall, this matter was discussed at the January 15, 2004 Site Plan Review
meeting and was reviewed as Project No. 002-04. I enclose herewith a copy of the Site Plan
Review minutes of that meeting. For your reference, the minutes pertaining to this project
commence on Page 9. In addition, I have also enclosed the proposed site plan prepared by
Down Cape Engineering as well as the proposed interior floor plans which were initially
submitted with the site plan review application.
Although you and I discussed that the apartment use could proceed by right as an
accessory use if it were restricted to use by an employee of Puritan Clothing, at this time, our
client would prefer to go forward at the zoning level to allow for an unrestricted use of the
unit. As such, it is our intention to file with the Zoning Board of Appeals to allow for this
proposal. The property is located within the B Zoning District and multifamily apartments are
allowed by right subject to several additional dimensional requirements. Because of the 1985
Board of Health variance restricting septic flow on the site, the property can only

Cape Cod seeking feedback regarding a proposed expansion of the existing facility.
❖ The existing facility was constructed in 1980's.
❖ There are two entrances—One on the NE side across from 4C's&the other by
the CC Conservatory allowed by easement.
•e• A committee of five (not yet appointed) shall review the alterations and expansion
to the existing facility.

This correspondence is sent on behalf of our client, 77 Old Yarmouth Realty, LLC,
with reference to its proposal remodel the interior of the existing structure located at 7-7—Old)
tY.armo li_Road--in'_HyannisI As was described at the January 15, 2004 Site Plan Review
hearing on this matter, the applicant proposes to move the existing two bedroom second story
apartment to the first floor and convert the apartment into a one bedroom apartment. The
remaining area within the structure will be utilized for long term storage associated with the
applicant's clothing store, Puritan Clothing, located on Main Street in Hyannis.
As you will recall, this matter was discussed at the January 15, 2004 Site Plan Review
meeting and was reviewed as Project No. 002-04. I enclose herewith a copy of the Site Plan
Review minutes of that meeting. For your reference, the minutes pertaining to this project
commence on Page 9. In addition, I have also enclosed the proposed site plan prepared by
Down Cape Engineering as well as the proposed interior floor plans which were initially
submitted with the site plan review application.
Although you and I discussed that the apartment use could proceed by right as an
accessory use if it were restricted to use by an employee of Puritan Clothing, at this time, our
client would prefer to go forward at the zoning level to allow for an unrestricted use of the
unit. As such, it is our intention to file with the Zoning Board of Appeals to allow for this
proposal. The property is located within the B Zoning District and multifamily apartments are
allowed by right subject to several additional dimensional requirements. Because of the 1985
Board of Health variance restricting septic flow on the site, the property can only
accommodate one (1) apartment. As you and I discussed previously, because the language in
the Zoning Bylaw is in the plural (apartments) we will be requesting relief to allow for one
apartment. In addition, we will also be requesting zoning relief for the additional dimensional

requirements associated with the multi-family use as set forth in Section 240-21(A)(9).
As noted on Page 12 of the Site Plan Review minutes submitted herewith, I believe that
confirmation of what, if any, zoning relief is required was the only outstanding Site Plan
Review related issue. However, I would request that you please review the enclosed minutes
together with the proposed site plan and floor plan and advise us what, if any, additional
information is required to obtain Site Plan Review approval so that we may proceed to file with
the Zoning Board of Appeals. Certainly, please do not hesitate to contact me with any
questions, comments or should you require any additional information.

77 Yarmouth Road, Hyannis , owned by Mr. Richard Landry was
approved for office use only, in December of 1985 . A variance
from the Board of Health Interim Groundwater Protection
Regulation was granted for this office use only.
This building now contains two bays , and it appears that it
is to be sold or leased to a rustproofing/car detailing
business . This building was never approved for such use,
because it is very close to the public supply wells .
Please do not issue the occupancy permit or allow anyone to
use the building except for the approved office use, and
clearance from the Board of Health.
Your cooperation in this matter is essential in protecting
our public supply wells .

I was informed that an automobile washing, services, and repair establishment
d/b/a Elegante' Enterprises, previously located,at4,77 Old arinoutli-Road' Hyannis
listed as Parcel 53, on Assessor's map 344 has`nbw moved to a building at" the
end of Joaquim Road, Hyannis.
The facility does not have a Groundwater Discharge Permit from the Department
of Environmental Quality Engineering.
A facility such as automobile washing, service, and repair establishment
contradicts what is allowed under the present Town Zoning Regulations.
Please remove this type of business from the building if they are in violation
of any Zoning Bylaw.
