What this would entail in terms of the renting of rooms would be, in general, a restriction on items that might individually or collectively constitute a kitchen. Specifically, no microwave ovens or hot plates would be allowed. The refrigerators --are acceptable, as are small sinks with cabinetry below. In- addition -to requiring your tenants to remove their hot plates and microwaves, the single cabinet should also be reduced to the approximate size of a bathroom vanity. The railing that you installed and the sheet rock you removed to allow a second means of egress from Unit 3 would also be conditions of the Building Commission. Since the property is a single-family residence which has a pre-existing use renting to three lodgers or boarders, there would be no need for a secondary means of egress. In other words, you need not go to the time and expense of installing the second floor deck and staircase down to ground level. The ad was for a year round efficiency, $750.00 per month. I met Mrs. Dodunis at the property above stated and she showed me the apartment. It was one large room with a kitchen and a bathroom. The kitchen consisted of a large counter with a sink, cabinets above and below and a microwave. I asked her how many apartments there were in the house and she said"4". This one was the only one available at this time, she told me. I sent Mr. Dodunis a letter asking him to either prove the apartments were legal, or restore the house to a single family house again. He answered saying he felt his lawyer had done so in 1997. After meeting with his lawyer it was determined the use of this property was strictly a single family house. After Mr. Dodunis received the tickets from my department, he called and made arrangements for myself and Robin Giangregorio to meet with him at the property. We did so on February 3, 2006. He showed us the entire house which consisted of his apartment and 5 other small apartments. Mr. Dodunis insisted he had the right to have the apartments and that was how he had purchased the property in 1983. Mrs. Dodunis told Linda there were 5 units in the house. Mr. Dodunis claimed that his attorney, Phil Boudreau had previously resolved the issue with Ralph Crossen. In 1972, the ZBA denied John H &Anni Milne's request to construct an apartment. Mr. Dodunis met us on Feb. 3 and gave us a tour of every unit. Unit 1 - Rented to the same person for 8 years. Unit 2 - Rented 1 yr(because former long-term tenant died last year) Unit 3 — Empty Unit 4— Empty used as storage but still has a kitchen. Unit 5 - Rented 18 years to same person. Previously, these units were rented for$350- $425 including utilities but Mr. Dodunis now charges $650.00 including utilities due to the increase in fuel expenses this year. Two units on the second floor of the original 1929 structure share a bathroom in a common hall; one of these units is currently empty. The other three units are on the second floor of the 1972 addition(one of these is also empty). Each section of the house has a distinct entry from the outside leading to a stairway and an interior door into the primary first floor unit. There is a garage and shed on site. A large backyard is neatly manicured. It's apparent that the apartment units are outdated at least in terms of d6cor but as a whole they seemed clean and orderly. He proposes to live on the bottom floor and rent the second floor. He stated that of nine houses in the area, four are duplex homes and his house is located between two of them. Mr. Milne said" that he had hoped to convert his single family home into a duplex six years ago, but is just now .able to do so - if his petition is granted. He claims hardship because of the fact that his home has three rooms on the first floor with bedrooms upstairs. They have two small boys and this entails a lot of running up and down. He now proposes to add two bedrooms and convert the upstairs roomp into a one-bedroom apartment, and to rent the same. Prior to the change in the Zoning By-Law, duplex apartments were allowed in the area. A neighbor who was present raised the question of sufficient off-street parking and Mr. Milne assured the Board he would makeprovisions for off-street parking. Miss Rogean, whose father is owner of property on the street stated that hw father could not appear but wished to go on record as objecting to any more duplex houses in the area. The Board also received a letter from William J. and Paulette C. Babner who recently purchased a home directly across from the Milne home on Owen 5t. They stated that they bought their home because of the new zoning which does not permit duplex 4e491e#selas 4mp"ad houses in the area, so they are strongly opposed to Mr. Milne's petition. The Board also received a letter from Mrs. R. F. Trotto, another property owner in the neighborhood to say she was opposed to a new duplex in the neighborhood but would not object if it" were just an addition. The Petitioner if effect seeks a Variance. The Board found no hardship in this case as defined in Chapter 4QA of the Zoning Enabling Act. It was the opinion of the Board that the granting of this Variance would be a step towards changing the character of the neighborhood and would be a derogation of the Zoning By-Laws and detrimental to the public good. As you are aware,.-"in addition to the single family, use by the Dodunis family, the property has been rented to up to five individuals over at least the past 20 'years. It is located in an RB Residential District which previously had, allowed the renting of rooms to up to three non-family members. The Dodunis family intends to continue this grandfathered use. It is agreed that two of the five rooms previously rented out will now be used only incidental to the single family residence by the Dodunis family, or any short term visitors (friends/relatives) they may have. Since the property is a single family residential dwelling, there is no need for a second means of egress from the second floor. Mr. Dodunis well understands that the use of hot plates, microwaves and toaster ovens not only pose a fire hazard, but could be part of establishing a "kitchen", which certainly is not allowed. It should be noted that there are no stoves in any of the units, but there have been a few small microwaves which Mr. Dodunis, on behalf of his boarders, would like to keep. I have drafted a letter for. Mr. Dodunis to sign, specifically terminating the tenancy at will in two of the five units, as the boarders are tenants-at-will who pay on a monthly basis on the first of each month. The legal notice required would demand vacancy by July 1, 1997. Ralph Corssen - 2 - May 12, 1997 I have also drafted a letter for Mr. Dodunis to sign to the remaining tenants, indicating that their hot plates and toaster ovens must be removed immediately and permanently. Further, I drafted a notice for Mr. Dodunis to frame the place in a conspicuous area in the house, reinforcing . the total ban on toaster ovens and hot plates. It is my understanding that the use of a refrigerator in the units is not prohibited. I discussed with Mr. Dodunis your request that the sinks and any cabinetry thereunder in the respective units be of a somewhat limited nature. I believe your comment was to the effect that a large sink with eight feet of counter underneath goes a long way towards being a kitchen. In order to fully comply with the Town requirements, I have asked Mr. Dodunis to measure all of the cabinets under the sinks in- the three units in question, so that I may present them to you at a future date.
