On December 6 19 JB_ The Board of Appeals,fqu id
Attorney Richard Curley presented,,his .petition which is. a reques't for;.a variance
to allow an existing single-family, vacant residence to be used-solely. as & law'
office. The house is new, has never been occupied,. and is a one-story ranch with
a walk-out basement and attached garage.,, The.petitioner: has this. property.under a
purchase and sales agreement and the.`topograpliy`of the land together with the
close proximity of this ..property to. business uses Imakes -this house.undesireable
for use as a residence. The owner has had the house for sale for more than one
year. and, has not been able to 'find a:buyer: The petitioner does not''plan ,to make
any external changes to the house and Mr.Curley and his associate,. Mr Schulz will.
occupy the building and do not ;plan ,to add any_more_,professional employees... . At, the.
present time,: 'they:have two full-time secretaries; one part-time secretary and.this,
makes a total of five persons who would occupy the :office, at. one time'. •The proposed
use will not generate noise or. congestion_ and Mr. Curley,,said the building will
retain its residential appearance. Parking can be provided for. ten cars and the
petitioner suggested a stipulation similar to that required for the professional.
residential district in Hyannis.which requires four parking spaces for each professional
employee The petitioner is .agreeable to-`ea:restriction requiring eight parking..spaces
on the property which would, be> reached by".a driveway leading .to:''the rear' parking area. F
Mr. and Mrs. Catignani were present to voice their 'objectons to the _granting of the
petition and said they own property immediately abutting the locus in: question and.
feel the proposed use would :be detrimental to .the neighborhood;-. Mr., Richard Gould,
an abuttor., spoke in favor ,of the petition and said, he had observed the traffic
situation at Mr. Curley's; present law office on West Main St., Iiyann _s and. had found.
that there were at the most, three or four cars parked thereat: one time and he had,
no objection to the granting of the;;petition.: Harry ,Nickolaow, an abuttor,. spoke in

favor of the petition and'. the Board. received several'letters also' in;:favor 'of. the, .
proposed use. Mr. Curley did not wish a rebuttal to answer Mr. Cat.ignani';s, objections
and the'Board .took the matter under :advisement. .
The Board-found that the. `proposed use as a -law office.would serve as a. desireable
buffer be.tween. the business use which is on one side of the locus in.-question and the ,
reside tial. use which is on 'the, Dther side. This house is locaated on property which

because of. its. topography, does ,not -lend itself to use as a residence. The house
has been built very close to a heavily travelled road-and therefore has no appreciable
front yard. The land to -the rear of the house slopes sharply :downward and,.cannot
be considered desireable for a backyard. The topography of the land together with
the location of this property which directly abutts many business uses ,makes it unique .
to the residence B zoned district in which it is located, and hardship: does exist as
evidenced by the fact that this.,property has been ,for sale for more'than a .year as
a residence and has not 'been sold. The Board found.there, would be .no `detriment to .the,
neighborhood nor ;derogation of thezoning .by-laws if the vacant house, is used for a '
law office and voted unanimously to allow the petitioner's request fora variance
subject to the following restrictions
1. No more than two professionals shall occupy the building.:
2. Wherever possible, pervious material such' as 'gravel 'or crushed stone
shall be used instead ofrpaving for the.driveway and parking area.-
3. Eight parking spaces shall be provided at the, rear of the property.

Attorney Richard Curley presented his petition which is a request for a variance
to allow an existing single-family, vacant residence to be used solely as a law
office. The house is new, has never been occupied, and is a one-story ranch with
a walk-out basement and attached garage. The petitioner has this property under a
purchase and sales agreement and the topography of the land together with the
close proximity of this property to business uses makes this house undesireable
for use as a residence. The owner has had the house for sale for more than one
year and has not been able to find a buyer. The petitioner does not plan to make
any external changes to the house and Mr. Curley and his associate, Mr. Schulz will
occupy the building and do not plan •to add any more professional employees. At the
present time, they have two full-time secretaries, one part-time secretary and this
makes a total of five persons who would occupy the office at one time. The proposed
use will not generate noise or congestion and Mr. Curley said the building will
retain its residential appearance. Parking can be provided for ten cars and the
petitioner suggested a stipulation similar to that required for the professional
residential district in Hyannis which requires four parking spaces for each professional
employee. The petitioner is agreeable to a restriction requiring eight parking spaces
on the property which would be reached by a driveway leading to the rear parking area.
Mr. and Mrs. Catignani were present to voice their objections to the granting of the
petition and said they own property .immediately abutting the locus in question and
feel the proposed use would be. detrimental to the neighborhood. Mr. Richard Gould,
an abuttor, spoke in favor of the petition and said he had observed the traffic
situation at Mr. Curley's present law office on West Main St. , Hyannis and had found
that there were at the most, three or four cars parked there at one time and he_ had
no objection to the granting of the petition. Harry Nickolaow, an abuttor, spoke in
favor of the petition and the Board received several letters also in favor of the
proposed use. Mr. Curley did. not wish a rebuttal to answer Mr. Catignani's objections
and the Board took the matter under advisement.
The Board found that the proposed use as a law office would serve as a desireable
buffer between the business use which is on one side of the locus in question and the
residential use which is on the other side. This house is located on property which

because of its topography, does not lend itself to use as a residence. The house
has been built very close to a heavily travelled road and therefore has no appreciable
front yard. The land to the rear of the house slopes sharply downward and cannot
be considered desireable for a backyard. The topography of the land together with
the location of this property which directly abutts many business uses makes it unique
to the residence B zoned district in which it is located, and hardship does exist as
evidenced by the fact that this property has been for sale for more than a year as
a residence and has not been sold. The Board found there would be no detriment to the
neighborhood nor derogation of the zoning by-laws if the vacant house is used for a
law office and voted unanimously to allow the petitioner's request for a variance
subject to the following restrictions:
1. No more than two professionals shall occupy the building.
2. Wherever possible, pervious material such as gravel or crushed stone
shall be used instead of paving for the driveway and parking area.
3. Eight parking spaces shall be provided at the rear of the property.

My name is Michele Capozzi-Pollock. Approximately 6 years ago you (or someone in the
Engineering Dept.) assisted myself and my husband, John Pollock, with a problem we
experienced with our road, Pleasant Park Ave., which is a dead-end and private road. We are the
last house on the dead-end, which you enter from West Main Street. The road that runs parallel to
our house is Pine Street, although you cannot get to it from Pleasant Park Ave.
In December of 2000, J. Kevin O'Haire, Trustee of Wing Farms Realty Trust, purchased 72 Pine
Street - a commercial property directly abutting our property. Kevin O'Haire and Doug Lebel
used the premises for their business. Sometime in 2001, O'Haire and Lebel "clear cut" at the end
of our road to put in drains and gravel with absolutely no notice to the abutters. Along with
myself and my husband, my neighbors, Lisa Bailey and Joseph Solgovic (owners of 43 Pleasant
Park Ave.), contacted the Town immediately to have the work stopped, as it looked as though they
were trying to cut a road through to Pine Street and all the privacy we had was now gone. The
Town came down and spoke with Mr. Lebel and it was agreed that the entrance to the gravel
area was to be used for "LIMITED ACCESS ONLY". Mr. Lebel agreed and, for the most part,
abided by that for the next 7 years. However, in October of 2008, the property was again sold and
the new owner(Michael P. Donovan, Trustee of 72 Pine Street Realty Trust) moved his business
in in January, 2009. Driveway markers have been put in and when it snows, the "driveway" is
plowed. Cars are now traveling down the road at an excessive speed, which is narrow and
sufficient for one vehicle, and proceed to park in the "driveway".
My concern is the fact that we do own a home on a dead end. We have an 8 year old daughter
who plays on the road; my neighbor as an 8 month old who will be playing on the road soon
enough, and having to worry about cars when we never had to is upsetting.
In addition, the address of the business is 72 "Pine Street", not Pleasant Park Ave. We need to
have the LIMITED ACCESS enforced. The Pine Street property owner should access the
back part of their property from the Pine Street entrance and Pleasant Park Ave. should remain a
dead end and blocked off.
For your reference, attached is a copy of my deed and the current deed pertaining to the property
in question, as well as the plans referred to in the deeds, as recorded in Plan Book 394, Page 33

Please assist us in this matter and advise us as to how this issue can be resolved, or direct us to the
appropriate Town department.

I remember visiting this site when the clearing was performed by Mr. Lebel. The situation is complex at best. I was
able to visit the site because the clear cutting was done in the direct vicinity of Pine Street which is a town
accepted road. As I mentioned back then; Pleasant Park Ave is a private way. This makes it very difficult for the
town to enforce restrictions as to the usage of the way. Since you indicated this was to be a "limited use" road for
the owners of#72 Pine Street, there may be some regulations that may be enforceable by the town. I will forward
your email to Robin Anderson in the Building Department. She is the Town Zoning Enforcement Officer. If the
licensing of the business operations at 72 Pine Street included the limited use of Pleasant Park Ave, Robin might
be the individual to investigate and enforce this restriction.
You need to understand that since this road is not considered a town accepted road, there is very little the town
can do as far as enforcement. We are usually instructed to notify citizens that the usage of a private way is a civil
matter and refer you to your attorney. That said, if 72 Pine Street is operating under a business license, the town
may have acquired regulations that may be enforceable under that license. I would also like to remind you that
even though Pleasant Park Ave was only partially constructed from West Main Street to your property, the actual
plans of record show it proceeds out to Pine Street. We refer to this section as a"paper road"which means there
is a legal definition to it and even though it was never constructed in entirety. It always carries the possibility of
being constructed out to Pine Street. The town has little or no say in the matter since the layout was designed on
records dating back to 1926. These paper roads just don't go away because they were never built. This is private
property/road and anyone who has legal right to use it could develop it out to Pine Street without abutters
permission. they would just be exercising their rights they acquired when they purchased their land. The town
does regulate the area where it comes out to Pine Street since Pleasant Park Ave would need to be constructed
into the Pine Street layout to make it passable. The town conceivably could permit this construction if an applicant
decides they wish to exercise their right of usage of this land. The town would required that it be constructed to
some standard, however, I am not at liberty to define that construction. The proposal would need to come from
the applicant.
As you can see, I am repeating this information because when something is legally defined like Pleasant Park
Ave, it runs the potential of being constructed at anytime. These roads a generally defined as common areas for
usage by the abutters if they have the legal right to do so. If there are deed restrictions regarding usage, these
types of restrictions are usually not enforceable by the town unless the town, during a license hearing requires the
i owner to restrict the usage. I am currently loaded with projects and am having a difficult time to set the necessary
time aside for something like this but I will follow-up with a review of the documents you mentioned. I will forward
your concerns to Robin to see is she has any legal authority to regulate this way. Unfortunately, I don't see much
