Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor (see Appendix Q,Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a Iicensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application,that the homeowner certify that he/she understands the responsibilities of a Supervisor. Mrs. Bonney has requested information and a preliminary indication of whether or not a building permit for a single family dwelling would issue for the vacant lot on Pinewood Avenue. The deed to the Fernwood lot is attached as Exhibit "A" , the Pinewood lot deeds are attached as Exhibit "B" . As requested, copies of all deeds for the surrounding lots since 1952 are enclosed. Specifically the following: 55 Fernwood -Avenue (Map 289, Parcel 103) attached hereto as Exhibit "C" ; 31 Fernwood Avenue (Map 289, Parcel 105) attached as Exhibit "D" ; 54 Pinewood Avenue (Map 289, Parcel 106) attached as Exhibit "E" ; 30 Pinewood Avenue (Map 289, Parcel 107 ) , attached hereto as Exhibit "F" . As can be seen, the Bonney' s did not own more than two adjoining lots. The plan subdividing these parcels dates back to August 1928 and is recorded at the Barnstable County R=The a eeds in Plan Book 38, Page 91, at hed hereto as Exhibit "G".. onney' s obtained the first lot, Parc 1041Eby a deed dated October , enants by the entirety from atherine Davidson. This lot contains approximately 14,800 square feet. The Davidson title reference is the' Estate of Rosco Davidson, Barnstable Probate Docket No. 32375. Rosco Davidson died on December 25, 1950. Ms. Davidson is the original grantor for all the adjoining lots. The Bonney' s owned this lot together until Mr. Bonney' s death in February of 1999., Currently Mrs. Bonney owns the lot individually. Mr. Ralph Crossen September 24, 1999 Page Two The Pinewood lot (Parcel 159) which is the subject of this inquiry was obtained by Mr. and Mrs. Bonney by a deed from Katherine Davidson dated August 15, 1956. This lot contains approximately '14,500 square feet. They owned this lot as tenants by the entirety until July 14, 1988 when the lot was conveyed to Mr. Bonney, see deeds attached hereto as Exhibit "B" . Mr. Bonney owned this lot up to his death in 1999. By way of his Last Will and Testament, Mrs. Bonney now owns the lot individually. The situation can be summarized as follows: The vacant Pinewood Lot was held in common ownership with the Fernwood lot from 1956 up to 1988. From 1988 to February of 1999 the lots were separately owned. Due to the passing" of Mr. Bonney, the lots are now owned by Mrs. Bonney. A review of the zoning for this area indicates the following: The area is located in Zoning District RB which currently requires a minimum lot size of 43,560 square feet. This went into effect in 1985. on 4- 4 .2 (2 ) Nonconforming Lots, states that an increase in zoning shall not apply for a period of five years from the effective date so long as four conditions are met. These lots satisfy the four conditions. Additionally the Pinewood lot was conveyed out of common ownership in 1988 which is within the five years allowed by the zoning ordinance. The conveyance of the lot into separate ownership within the five year period after the increase in area requirement confers permanent protection on the lot.
