In accordance with Condition No.6 of ther permit he is seekingBoard approval for the transfer, The subject'property is a.57:.acre parcel improved with a two-story,residential dwelling currently being used as an 8 bedroom rehabilitation and recovery. house. In March of 1996,the Board granted Special,Permit:No. 19,96-10.3 to modify a pre=existing nonconforming use and to legitimize the use of an 8 unit lodging house used as rehabilitation and recovery house. At that'time,the Board found that use of the.property or a lodging,house was preexisting:nonconforming. In February of 1.999, Board granted transfer of the Special Permit to- Kenneth J. O'Donnell(Appeal,No. 1.999-12)to continue the use of ther site as a:rehabtitation.and recovery house. All conditions of the l996 permit remained in full force andr effect: Procedural'&Hearing Summary Special Permit No 2013-052 to transfer Special Permits 1995-163 and 1996-012 was filed at the Town Clerk's Office,and Growth Management'Department offices on September4,2013. A public hearing before the Zoning Board`of Appeals<was duly advertised and notice sent to all abutters.and Interested"parries'in accordance with MGL Chapter 40A: The hearing was opened October 9,201.3 at which time the Board found fo granftransfer of the;Special'Permit subject to conditions. Board Members deciding this appeal were Board Chair Craig G.'Larson,William fl. Newton,Alex M. Rodolakis,George T.Zevitas;and David A. Hirsch. Attorney Mark Boudreau;represented the Applicant before the Board. Hwindicated the Applicant intended to continue to run the rehabilitation facility using he established modekand that there had ' eera--no-past-complaints4o"e4-0wr{-or-the-police=-He-discussed4he,designated-eAtactpersen,; who would lrkety be.a three-year resident of the dwelling. Findings of Fact At the hearing of October9,2013 the Board unanimously made the:following findings of fact for Special Permit 2013-052,a request to transfer Special Permits 1995463 and 1996-012; 1. In Appeal No.2013-052,,Saleh Ahmed Akkawi is requesting the transferl of Special Permit No. 1.995-163 and No. 199942, issued for the operation of a�preexisting.nonconforming use an eight-room single-occupancy odging house at 805 Pitcher's Way, Hyannis. 2. The subject property is shown on Assessor's Map 271 as Parcel 160. It is in.a Residential C-1 zoning district. The property is serviced by Town water.and aprivate septic:system. 3. Mr.Akkawi;is under agreement to purchase the property and has submitted:a-signed copy:of a Purchase and Sales,Agreement to the Board. 4. The lodging house has;submitted to and complied with all required inspections and there has been no police activity at the house. 5. The conditions of the existing.'Special Permits state that the.permit"may not be transferred without consent of the Townof.Barnstable Zoning Board of Appeals to an activity related to rehabilitation,social service or special needs type ground home use or for a use permitted by the terms of this Special Permit, and in accordance with the terms and:conditions set forth herein.' 6. After an evaluation of all the`evid.ence Presented,the proposal.futfrlls.the spirit and intent of the Zoning Ordinance and would not represent a substantial detriment to the public good:or the neighborhood affected. 7. The lot is located across the street from the Water Pollution Control Facility. According to the Assessors Records, 805 Pitchers Way was built in 1985, and today houses eight individuals in a two story, 10 room structure with 7 bathrooms. A review of the 1983 and 1985 Zoning Ordinance shows documentation that the area was zoned RC-1 and permitted as of right"Renting rooms for not more than six(6) lodgers by a family resident in the dwelling.: Section 1-4.c. The Lodging House provisions of the Zoning Ordinance was amended on November 07, 1987 by Town Meeting Article 12. That article revised lodging to permit only 3 lodgers as- of-right as accessory to a single family use and permitted by Special Permit the renting of rooms to up six lodgers in a single family dwelling. A review of the Lodging House License issued to the locus revealed that Patricia Flaherty has held a lodging licensed for 805 Pitchers Way for a number of years. Lodging House License No. 51 was issued in 1995 to Patricia Flaherty. The Applicants mailing address was 350 Bearses Way, Hyannis. The application form restricted the capacity to 8 rooms. This appeal is related to Appeal No. 1995-162. It appears the applicant is seeking a Special Permit to permit a modification to a pre-existing non-conforming use and to legitimize current use of a 8 unit lodging house used as a rehabilitation and recovery house. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on October 16. 1995. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened on November 29, 1995, continued to January 24, 1996 and to March 27, 1996, at which time the Board found to grant the appeal with conditions. An extension of time to file the decision was recorded with the town clerk. Board members hearing this appeal were Ron Jansson, Emmett Glynn, Gene Burman, Elizabeth Nilsson, and Chairman Gail Nightingale. Alternate Board Member Tom DeRiemer had been in attendance at all of the hearings on this appeal and replaced Ron Jansson at the March 27, 1996 continuance and decision. The Board and the applicant agreed to have Appeal No 1995-162 and Appeal Number 1995-163 heard together, although they differ in location, the nature of use and requested relief are identical. t Zoning Board of Appeals-Decision and Notice ' Appeal Number 1995-163-Flaherty-805 Pitchers Way Hearing Summary: Patricia Flaherty represented herself at the opening of the hearing. She owns both houses and both have lodging within and on-site parking. For the past nine years, Ms. Flaherty has operated the homes for rehabilitation activities and special needs population. The homes have been inspected yearly by licensing and health departments. Recently, Ms. Flaherty applied for a building permit and it was noted that the uses do not conform to today's zoning requirements in terms of the number of permitted lodgers. In 1986, Ms. Flaherty bought 949 Pitchers Way and was told by the Building Inspector at that time that there would be no problem in operating the home. She then purchased 805 Pitchers Way and again received a license and was told she could run another lodging home for rehabilitation activities and special needs population. The Board expressed concern that she does not actually live in either of the dwellings, and therefor was not in compliance when she bought the property and is still not in compliance Ms. Flaherty explained her operation of the dwellings were homes for rehabilitation activities and special needs population providing a safe environment away from temptation for newly recovering alcoholics. There is a support system available. The residents must work and/or do community service in order to live there. Ms. Flaherty stressed that this is more than a place to live but also a support home emotionally, spiritually and educationally. She noted that in her nine years of operating there has never been a problem with the police or with any neighbor. She is a nurse and a counselor to the residents. Public comment was requested and Richard Kennedy, an abutter, did not have any problem with the use of the dwelling but was concerned with the number of people allowed and questioned who will set the limit? Ken O'Donnell who has been a resident for the last five months stressed that it was a"quiet place" with no known problems with any resident. The Board expressed concern for safeguards in this type of dwellings and uses. Ms. Flaherty stated that she has installed strict rules on all tenants and that a trustworthy person is in charge at all times. The homes have regular house meetings, are self governing, share care for each other and have an 11:00 PM curfew. The Board commended Ms. Flaherty and the work she does but noted that safeguards and regulations should be put in place to protect the inhabitants and neighbors. The Board continued the appeal to January 24, 1996, to allow the Planning Department and the Licensing Department to address the issue and draft appropriate regulations or conditions that could be put in place to assure rehabilitation activities that would meet the needs of the population are met. At the Hearing of January 24, 1996, Attorney Michael Murphy represented the Petitioner. The Board continued the hearing to March 20, 1996 to receive the Town's staff report. At the March 20, 1996 hearing the Board again continued the appeal due to illness of one of its members. The appeal was continued March 27, 1996. At the March 27, 1996 continuance, reports from Planning staff and the Licensing agent were reviewed. Attorney Murphy noted that he has been working with the planning staff to draft possible condition for the board to consider. It was noted that the planning staff was in full agreement with the conditions. The Board noted it saw a problem in that although this individual operating the home has a fine reputation there are no assurances that afterwards, her successor to the special permits would have her quality and integrity. Finding of Facts: Based upon the testimony given during the public hearing on this appeal, the Board unanimously found the following findings of fact: 1. The Applicant is Patricia J. Flaherty. The property in issue is .58 acres and located at 805 Pitchers Way, Hyannis, MA, on Assessor's Map 271, Parcel 160 and in an RC Residential C-1 Zoning District, and in a Groundwater Protection District. 2. The Applicant is seeking a Special Permit under Section 4-4 to modify a pre-existing non-conforming use to run a rehabilitation group home for eight lodgers. 2 Zoning Board of Appeals-Decision and Notice r 'Appeal Number 1995-163-Flaherty-805 Pitchers Way 3. The use is a service to the Town of Barnstable and would not be detrimental to the neighborhood and would be within the spirit and intent of the Town of Barnstable Zoning Ordinance. Decision: Based upon the positive findings a motion was duly made and seconded to grant a Special Permit to Patricia Flaherty for the continuation of lodging for up to eight single occupancy lodging units within the dwelling provided the use of this structure shall remain as a group home for rehabilitation activities and special needs population and complies with all of the following conditions: 1. A set of house rules shall be maintained and enforced by the applicant on all tenants. 2. An on-site"Contact Person" shall be required. The dwelling shall comply with all applicable building and health codes. 5. Parking shall be provided in accordance with the site plan submitted to and approved by the Site Plan Review Committee. The rear of the lot shall be screened so as to prevent vehicle lights from shining off-site. 6. This Special Permit may not be transferred without the consent of the Town of Barnstable Zoning Board of Appeals to an activity related to rehabilitation, social service or special needs type ground home use or for a use permitted by the terms of this Special Permit, and in accordance with the terms and conditions set forth herein. 7. If the dwelling is to be utilized for any other purpose other than rehabilitation, social service or special needs type group home use, it can only be used in compliance with the principal permitted uses in the Zoning District where the property lies. It is improved with a two-story, residential dwelling currently being used as an 8 bedroom rehabilitation and. recovery house. The property is located in a RC-1 Residential C-1 Zoning District and is serviced by Town water and a private septic system. In March of 1996, the Zoning Board of Appeals granted Special Permit Number 1995-163 to permit a modification to a pre-existing nonconforming use and to legitimize the use of an 8 unit lodging house used as a rehabilitation and recovery house. The Board granted this special permit with several conditions. At the hearing, the Board expressed a concern over the qualifications of any subsequent property owner operating this home and thus imposed Condition#6 which states: "This Special Permit may not be transferred without consent of the Town of Barnstable Zoning Board of Appeals to an activity related to rehabilitation, social service or special needs type group home use or for a use permitted by the terms of this Special Permit, and in accordance with the terms and conditions set forth herein." The applicant intends to continue the current use of this site as a rehabilitation and recovery house and is seeking Zoning Board of Appeals approval to transfer Special Permit Number 1995-163 to him. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on December 21, 1998. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened January 20, 1999, at which time the Board granted the requested relief with conditions. Hearing Summary: Board Members hearing this appeal were Gene Burman, Gail Nightingale, Elizabeth Nilsson, David Rice, and Chairman Emmett Glynn. Attorney Charles Sabatt represented the applicant, Kenneth O'Donnell, who was present. Attorney Sabatt addressed the Board. He reported the applicant is in the process of purchasing this property. The Special Permit issued by the Zoning Board of Appeals in 1995 to Patricia Flaherty for the o Town of Barnstable-Zoning Board of Appeals-Decision and Notice Appeal Number 1999-12-O'Donnell Permission to Transfer Special Permit No. 1995-163 subject property specifically states"This Special Permit may not be transferred without consent of the Town of Barnstable Zoning Board of Appeals to an activity related to rehabilitation, social service or special needs type group home use or for a use permitted by the terms of this Special Permit, and in accordance with the terms and conditions set forth herein." The applicant intends to continue the current use of this site as a rehabilitation and recovery house and is seeking Zoning Board of Appeals approval to transfer Special Permit Number 1995-163 to him. As to standing, Attorney Sabatt explained there is a Purchase and Sales Agreement between Mr. O'Donnell and Ms. Flaherty, but before the transaction was completed, Ms. Flaherty died. After her estate is settled, the Executors of her will intend to complete the sale of this property to Mr. O'Donnell. This was documented in a letter submitted to the Board from Attorney William W. Thomas. Attorney Sabatt reviewed the conditions of Appeal Number 1995-163. The applicant has abided by all the restrictions of that Special Permit, kept all his licenses current, and undergone all inspections imposed by the Board and the Town with no violations noted. A review of Police Department files show calls to the home from the Police Department. Primarily, they relate to off premise matters, such as, attempts to serve restraining orders, motor vehicle accidents, medical needs, and are not reflective of the property itself nor do they reflect negative conduct of the occupants of the property. One of the calls resulted from the applicant himself calling the Police because an individual violated the"house rules" and he was ejected from the house. The Board and Attorney Sabatt discussed the pending transfer of this property and Special Permit 1995- 163. Attorney Sabatt stated the applicant would be agreeable to limiting the Special Permit to only the applicant and that it not be transferable. Public Comments: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the hearing of January 20, 1999, the Board unanimously found the following findings of fact as related to Appeal No. 1999-12: 1. The Petitioner is Kenneth J. O'Donnell. The property in issue is 805 Pitchers Way, Hyannis, MA as shown on Assessor's Map 271, Parcel 160. It is located in the RC-1 Residential C-1 Zoning District and the GP Groundwater Protection Overlay District. 2. The property is currently owned by Patricia J. Flaherty. A Purchase and Sale Agreement is on file between Kenneth O'Donnell and Patricia Flaherty, but it was not executed due to the death of Ms. Flaherty. A letter from the attorney representing the estate of Ms. Flaherty has been submitted to the file which indicates the property will (in all likelihood) be transferred to Mr. O'Donnell. 3. A Special Permit was granted in 1995 pursuant to Appeal Number 1995-163 and the applicant is seeking to transfer that permit in accordance with Condition#6 which states, "This Special Permit may not be transferred without consent of the Town of Barnstable Zoning Board of Appeals to an activity related to rehabilitation, social service or special needs type group home use or for a use permitted by the terms of this Special Permit, and in accordance with the terms and conditions set forth herein." 4. The applicant is requesting Special Permit 1995-163 be transferred to Kenneth J. O'Donnell. 5. The relief may be granted without substantial detriment to the public good and without nullifying or substantially derogating from the intent or purpose of the Zoning Ordinance. Decision: Based on the findings of fact, a motion was duly made and seconded to grant the relief being sought in Appeal No. 1999-12 with the following terms and conditions: 1. These lots are not contiguous and are located across the street from the Water Pollution Control Facility. The area is generally residential with lots ranging from 1/4 to 3/4 of a acre. In both Appeal No. 1995-162 and 163, it appears the applicant is seeking a Special Permit to permit a modification to a pre-existing non-conforming use and to legitimize current use of a 8 unit lodging house used as a sober house. The area is zoned RC-1, Residential C-1 Zoning District. Department Review: The applicant should be prepared to document that the use of each of the structures as an 8 unit lodging house was legally created and established under zoning with applicable building requirements met for the Town of Barnstable. According to the Assessors Records, 805 Pitchers Way was built in 1985, and today houses 7 families in a two story, 10 room structure with 7 bathrooms. 949 Pitchers Way was built in 1983/84, and today houses 7 families in a two story, 10 room structure with 7 bathrooms. A review of the 1983 and 1985 Zoning Ordinance shows documentation that the area was zoned RC- 1 and permitted as of right"Renting rooms for not more than six (6) lodgers by a family resident in the dwelling.: Section 14.c. The Lodging House provisions of the Zoning Ordinance was amended on November 07, 1987 by Town Meeting Article 12. That article revised lodging to permit only 3 lodgers as-of-right'as accessory to a single family use and permitted by Special Permit the renting of rooms to up six lodgers in a single family dwelling. A review of the Lodging House License issued to the locus revealed that: Patricia Flaherty has held a lodging licensed for 805 Pitchers Way for a number of years. Lodging House License No. 51 was issued in 1995 to Patricia Flaherty. The Applicants mailing address was 350 Bearses Way, Hyannis. The application form restricted a capacity of 8 rooms. Appeals No. 1995-162& 163 Flaherty The lodging License for 949 Pitchers Way was transferred in September 1993 from a Nancy M. Phinney to Patricia Flaherty (today Lodging House License No. 27). No room capacity was cited in the application. A Copy of the Building Permit may provide insight as to what was permitted. Section 7 of MGL Chapter 40 A provides for a 6 year limitation on deficit of a building permit duly issued.. However that statute of limitation does not apply to the use made of the property. The applicant has also identified the use as a "sober house". Is this operation permitted as per Section 3 of MGL Chapter 40A as an exempt use from Zoning? According to that Section, "No Zoning Ordinance ...shall regulate or restrict the use of land or structure for... educational... or nonprofit educational corporation ..". Is the use as a sober house exempt by the nature of a not-for- profit corporation? The Board may also wish to request floor plans and a site plan to review. Department Comments: If the use of these buildings was legally established, it should never have gone beyond 6 rooms rented by the family residing within. Transfer of the property should have retained the owner occupancy as required in the 1983 and 1985 Zoning Ordinance for a valid operation in conformance with zoning to have continued and to be a legal non-conforming use today. Any change in the nature of residence of the owner or increase in the number of rooms should have received a Special Permit at the time of the change to retain the legal non-conformity of the use.
