Our File 05-49 Dear Tom: As a follow up to my recent letter to you, I did some additional title work on the property and report the following: The land was conveyed by William H. Peak to Edward P. Conway by deed dated July 29, 1946 and recorded in Book 652, Page 29 on that date. The land was described therein as the second parcel and shown on the plan recorded in Plan Book 74, Page 85; Edward P. Conway conveyed the land to Pauline Stokes by deed dated March 25, 1957 and recorded on March 26, 1957 in Book 968, Page 461. The land was described therein as Parcel 2 as LOT 3 on a new plan filed in Plan Book 134, Page 23 . Pauline Stokes had the land registered in Land Court Case No. 29536 and the Land Court Plan No. 29356A showed the land as Lot 3 thereon. Pauline Stokes conveyed the land to Dennis Carey by deed dated July 19, 1973 and registered as Document No. 177, 245 . Dennis Carey conveyed the land to the applicant by deed dated April 12, 2005 and registered as Document No. 998, 731. My title search indicated that at no time since the above deed in 1946 to the current date was there any common ownership of the land with any adjoining land. I have reviewed the zoning history of the Town at the Town Clerk' s office, beginning with the initial zoning by law enacted at the March 5, 1928 town meeting and found no by law provision V introducing a front yard setback prior to or contemporaneous with the recording of the deed in 1946 to Edward Conway as above described. I have therefore concluded that, pursuant to the protection afforded the lot under the provisions of MGLc40A, s . 6, fourth paragraph, there is no front yard setback applicable to the lot and the building permit should issue, since the lot meets the minimum area requirement of 5, 000 square feet and minimum frontage requirement of 50 feet and has been in separate ownership from adjoining land at each zoning change since 1946 as required by the said statutory provision. Our File 05-49 Dear Tom: I understand that there is a problem with the application for the building permit based on a determination that a part of the building violates the setback requirement as required by the local Zoning By-Law. The lot has been in ownership separate from adjoining land since at least 1961 when the Land Court Plan showing the Lot was prepared. As I understand it the setback from Route 28 is over 100 feet based on the By-Law requirement that was inserted in 1984 and the Southwest corner of the foundation as presently located on the lot is approximately sixteen feet from the sideline of Pitcher' s Way as laid out by a Taking in 1968 by the Town. Attached are copies of the Minutes of 1974 Town Meeting which adopted a change in the intensity regulations adding the provision which is now in our By-Laws namely "where a lot abuts on one or more than one street, front yard setback shall be applicable from all streets . " As you can see from the Minutes in which there is discussion by then Chairperson of the Planning Board, Joseph Reardon, the Building Commissioner in enforcing the By-Law to make a determination as to whether or not tie front of the house as suggested by the owner is in fact the front to conform to the requirements, i.e. the By-Law was enforced in a manner that would require the setback from only one street and not from the other street that makes the corner. A If you agree that the corner lot provision inserted in 1974 does not apply to the locus since it was in existence prior to the 1974 By-Law change as well as the 1984 By-Law change which required 100 foot setback from Route 28, under the provisions of G.L. Chapter 48, Section 6 the lot would be immune from those increased requirements and you may issue a Building Permit using Route 28 as the front yard setback and allowing the Pitcher' s Way setback to be a sideline setback and that would then allow the house to be considered conforming to the applicable setback requirements and you may issue the Building Permit.
