Mrs. Warburton has recently sought my advice in regard to her right to build upon a lot which she owns on Sea Street and which contains approximately 11,288 square feet of land. The lot in question adjoins another lot both of which are held in Common Ownership. My client informs me that she discussed this issue with a member of your staff in September and was advised that if she separated the Record titled to the two lots she could avoid the five year Building Limitation of General Laws Chapter 40A Section 6. I am enclosing herewith for your review a copy of the Plan which created the two lots. As you will note, the Plan was endorsed "Approval Not Reguired" under the Subdivision Law by the Barnstable Planning Board on August 6, 1984. At the time the Plan was endorsed, the applicable Zoning By-Law provided for a minimum area of 10 ,000 square feet an RB Zone. This requirement was increased to 43,650 square feet on May 31, 1985. .
