An employer is defined as"an individual,partnership,association,corporation or other legal entity, or any two or more of the foregomg.engaged in a joint enterprise, and including the legal representatives of a deceased employer,or the receiver or trustee of an individual,partnership, association or other legal entity, employing employees. This house at 55 Seabrook is not being used as anything but a one family home except that I agreed to rent the upper portion of the home to Carol Sircello for$1,100.00 instead of the $1,300 she had originally agreed to pay with the understanding that my sister, my self and my kids,and friends would occasionally occupy the downstairs portions for brief periods. She has been so unhappy with anybody being there that I have now discontinued letting any friends stay there. Neither I nor my sister have stayed there. The only change that was made was to replace the garage door which had nearly wom through a support beam with French Doors so that the room will be used as a recreational room for our family when we move there in five years. Ms. Sircello had complained of the noise of the garage door and she knew of this change and its purpose. All renovations to the downstairs were done by the previous owner and I purchased the building in the condition you see. I have been preparing to cover exposed insulation in the lower area. The bathroom was as you see it and the home was sold to me in this condition. All further use of this area is discontinued as you mandated. I would contemplate(and have contemplated)modifying the unit for temporary rental utilizing existing government programs offered by Barnstable if you would permit that. As Ms.Sircello knows the unit was used only for less than ten days over the entire year and I had informed her that nobody would use it further even before your notice. In essence, we were to be guests in my own home during these brief stays which became ever briefer as it became clear Ms. Sircello would neither pay her lower rent nor allow the reasonable visits agreed to. Please be assured it is not being rented out as a two family and I would follow all procedures were it to be so altered. In fact,as Ms. Sircello well knows, I agreed to the reduction in rent to her,with some minimal use by family and friends,as a favor to her. Instead we are in the midst of eviction actions as she has not paid her security deposit due last February or portions of the rent over the last months since July. I shall only allow the house to be used as a single home unless we can agree with you on other alterations with you. I would appreciate such a permit. I would appreciate help and not be used as a two family wit ppropriate authorization. Every dwelling unit, and rooming unit shall have as many means of exit as will allow for the safe passage of all people in accordance with 780 CMR 104.0, 105.1, and 805.0 of the Massachusetts Building Code. 105 CMR: 410.354: Metering of Electricity and Gas. (A) The owner shall provide the electricity and.gas in each dwelling unit unless (1) Such gas or electricity is metered through a meter which serves only the dwelling unit, except as allowed by 105 CMR 410.254 (B); and (2) The rental agreement provides for payment by the occupant. 105 CMR 410.355: Provision of Oil. The owner shall provide the oil used for heating and/or hot water in each dwelling unit unless such oil is provided through a separate oil tank which serves only that dwelling unit, provided however, that 105 CMR 410.000 shall only apply to tenancies created or renewed after July 1, 1994. It has been brought to our attention that the fill gauge on the tank is inaccurate stating that is near or at empty when actually this tank is full. This must be corrected within fourteen (14)days and show proof of the problem being corrected to this department. 105 CMR 410.402: Grade Level. No room or area in a dwelling may be used for habitation if more than 1/2 of its floor-to-ceiling height is below the average grade of the adjoining ground and is subject to chronic dampness. 105 CMR 410.280: Natural and Mechanical Ventilation. The owner shall provide for each habitable room, and room containing a toilet, bathtub or shower, ventilation to the outdoors consisting of: (A) windows, skylights, doors or transoms in the exterior walls or roofs that can easily be opened to a minimum of 4% of the floor area of that habitable room or room containing a toilet,bathtub or shower....(B)Mechanical ventilation capable of exhausting air..... There have been no plumbing or building permits pulled on the basement dwelling unit. Therefore, this letter is being copied to the Building Department for further processing. You may request a hearing before the Board of Health if written petition requesting same is received within ten (10) days after the date the order is served.
