Another whole year has gone by and we still have the same uncompleted parking plan. There are no lined parking spaces or indications of where to park. According the the ZBA's decision, special permit no. 2014-012, the permit shall apply to the use of 112 west main street only. I am enclosing highlighted copies of the Growth Management approval and ZBA approval. The property has been renovated upstairs and in the basement without a permit and the upstairs is being occupied by a psychic reader and yoga studio. There is no secret in there operation for the have websites which I have also enclosed pages. Also there is no rhyme or reasoning to there parking, they do not have any designated parking spaces and the HC access is definitely not up to code. Furthermore, lot 124, which they claim has a variance, expired under state law is in residential zone and they continue to use it further congesting this small area. I have done all my renovations in accordance to the plans that I submitted and obtained all the required permits and it is not fair that these people can do whatever they want without any repercussions. Cardarelli 111 Holder Lane West Barnstable, MA 02668 Re:120 West Main Street, Hyannis, MA Dear Mr. Cardarelli: Please be advised that staff recently had an opportunity to review the as-built plan we requested concerning your property located at 120 West Main Street, Hyannis. Staff found that the as built plan(prepared by Steneck&Taylor- dated April 28, 2016) significantly deviates from the official site plan(prepared by Steneck&Taylor - dated May 15, 2014). The 2014 plan was approved by the Zoning Board of Appeals and is specifically referenced in the decision of the Special Permit 2014-026. It was determined the most concerning deviation is the shared site entrance to both 120 and 112 West Main Street. Deputy Fire Chief Dean Melanson advises that this reduction in the curb cut dramatically impedes his ability to readily and quickly maneuver emergency equipment into and around the two properties. This is an unacceptable risk and as such you are now directed to restore the curb cut to the same condition and dimensions represented on.the approved plan dated May 15, 2014. N Immediate measures should be taken to rectify this situation on or before June 17, 2016. Mr. Cardarelli went through informal site plan review and submitted a proposed parking plan; and yes,the Special Permit issued for his tenants did bootstrap the parking plan. You sent my client a letter with a demand to submit an as-built plan in a very short time frame. He accommodated. He did not significantly deviate from the earlier plan and all parties, as far as I am ' aware, agree that the.current configuration of the parking lot is better and safer. A survey of the property revealed that the entrance to 120 and 112 West Main Street encroached on my client's property hence the measures that might client took. Now he is being asked to open up his land for his neighbor's use. I am at a loss to understand what is going on with 112 West Main Street. For two years now, the Town has been aware that the rear lot is being used illegally for commercial purposes. After more than a two dozen trips to the building department by me, I find the only evidence in the file of 112 West Main Street of any enforcement action against this owner is a February 29th, 2016 letter to 5/26/2016 age Page 2 of 2 the owner demanding that they cease the 3 or 4 additional businesses that they been operating at that site illegally for over a year. They are still operating on a temporary occupancy permit. Their parking was never completed yet I do not see repeated letters demanding "as-built" plans from that owner. At their Site Plan,they were informed that any additional tenants would require the installation of an elevator. No enforcement here. 1 do not see letters requiring that the owner cease and desist from the commercial use of the residential lot. This Town has sought to fine some owners in town for a one or two day use of abutting parcels for parking in a residential zone for the benefit of a commercial endeavor. This exact practice has been going on at 112 West Main Street for over two years with up to 22 cars parked on the residential lot at a time! The owners of 112 West Main Street have no legal rights to cross my client's land. It is they who should be widening the curb cut. I would ask that you send me the enforcement letter or letters that has/have been set to the owners of 112 West Main Street. If you can schedule a time to meet late next week or the following week, I would appreciate it. John Cardarelli is a responsible citizen of this Town and a respected businessman. He has continually come into Town Hall when asked and when not asked to conform to the many rules of this Town. He has called Deputy Fire Chief Dean Melanson directly to address issues on his property. The letters you have written to my client become a permanent part of the Town's file and paint him unfairly in an unfavorable light.
