o A copy of an offsite parking agreement with Cape Cod Melody Tent for parent events must be
provided.
o A copy of an offsite parking agreement with the Resort and Conference Center to allow parking
for up to 30 cars during the school day must be provided.
® Driveways must be marked in accordance with Town ordinance as "Fire Lanes" and as such,
parking in the driveways is not allowed.
• On street, offsite parking by students, including parking in driveways, shall not be allowed.
o Applicant must contact Department of Public Works and submit application to change area to
"School Zone" indicating signage location,type, 20 MPH speed zone, etc.
m Within one year from the.date of occupancy of the building,the School shall meet with the Site
Plan Review Committee to discuss the effectiveness of, compliance with, and potential
modifications to the School's Drop off and Pick Up Plan referenced herein below, and the
School's parking and traffic circulation protocols.
o Drop Off and Pick-Up Plan as set forth in Response 2 in Memorandum from Randall C.Hart,
VHB to Sturgis Charter School dated April 13, 2011 and depicted in the memorandum's Figure 1
"Revised Pick-Up/Drop-Off Plan Details"must be followed. (Response 2 and Figure 1 are
attached to this approval letter.)
o Site Plan Review approval is contingent upon the Applicant's execution of a Memorandum of
Understanding with the Town which establish policies for the following,without limitation: the
use of striped fire lane areas by buses for drop-off/pick up; student parking protocol; student
lunch protocol;traffic flow on site; and,hours of operation and usage during evenings and
summer months.
® Applicant must obtain all other applicable permits, licenses and approvals required.
® Upon completion of all work, a registered engineer or land surveyor shall submit a letter of
certification,made upon knowledge and belief in accordance with professional standards that all
work has been done in substantial compliance with the approved site plan(Zoning Section 240-
105 (G)). This document shall be submitted prior to the issuance of the final certificate of
occupancy.

Vanasse Hangen Brustlin,Inc.(VHB)has prepared this supplemental memorandum to
respond to comments.outlined in the Town of Barnstable peer consultant(Vanasse&
Associates,VAI)letter issued on April 7,2011 regarding the proposed Sturgis Charter
Public School.project to be located along West Main Street in Hyannis,Massachusetts. For �
ease of review,each of the comments made in the VAI letter has been repeated and the
subsequent response is provided:
Comment 1: Trip Generation; Based upon observations of drop-off activity and the number of
students bused to the school, the initial trip-generation estimates appear low. On Friday morning,
March 25,2011,approximately 40 students arrived by bus and the remaining students were either
dropped-off or walked to the school. With a peak hour estimate of only 54 exiting vehicles projected
at the new school,,this number does not reflect the high drop-off activity which occurs at the existing.
school. In addition, the amount of walking students at the new school may be less than the existing
school due to itsilo6dtion. The VHB esfiriiates'wei-e based upon standard trip rates published by the
Institute of Transportation Engineers, but the data utilized,appears not to reflect actual conditions
at the school,as the existing school seems to accommodate low bus ridership and a significant drop
off activity.It is recommended that vehicle-trips estimates be revised based upon actual conditions at
the school. The actual percent of bus ridership at the existing school should be documented based on
field observations.
Response l: Traffic counts at the existing Sturgis Charter Public School were collected on.
Monday April 111'between the hours of 7-9AM and 2-4PM to confirm the traffic activity at
the existing facility and to compare actual counts to the projections made by standard RE
procedures for the proposed facility. The traffic counts collected are included in the
Appendix of this document and are summarized.below in Table 1. .

As shown in Table 2, the West Main Street and Site Driveway intersection is expected to
operate at LOS A during the weekday morning and evening peak hour periods for all
movements except the northbound left turn(left turn exiting the site). The northbound left
turn is anticipated to operate at LOS C during the weekday morning peak hour(7:30 AM to
8:30 AM)and the weekday afternoon peak hour(2:45 PM to 3:45 PM).
As shown in Table 2 operations for at the Scudder Avenue and Site Driveway intersection
is expected to operate at LOS A during the weekday morning and evening peak hour
periods for all movements. The only exception is the southbound left turn movement(left
turn from site)which is expected to operate at LOS B during the weekday morning.peak
hour(7:30 AM to 8:30 AM)and the weekday afternoon peak hour(2:45 PM to 3:45 PM).
Comment 2:Drop-Off and Pick-Up Plan; The initial drop-off and pick-up plan raised concerns as it
was proposed to have two-way drop-offs with queued vehicles blocking parking and students walk{ng
between drop-off vehicles. It appears that a new site plan has been developed and a new drop-of`'and
pick-up plan must be developed to provide safe conditions for the students. Drop-of and pick-ups fn
one direction will be the safest plan and the maximum expected queue should be identified. .
Response 2- Modifications to the original site plan outlined in the February 2,2011 V B
memorandum were introduced through discussion with representative of the Town of
Barnstable Department of Growth Management and the Fire Department. The revisions
were introduced to provide direct access for bus traffic to the curb of the facility which was
a directive of the Fire Department. The reconfigured site plain will allow the pick-up and .
drop-off activities staff vities to be better managed by sta of the Sturgis School who will be outside
monitoring/controlling all activities during the entirety of the morning drop-off and
afternoon pick-up periods. Under the revised plan,all buses will entef the site from
Scudder Avenue and will queue directly along the curb on the north side of the building
(refer to Figure 1 attached). In addition,all parent drop-off activities and car-pool activities.
will be directed,to enter the facility from West Main Street and exit at Scudder Avenue.
The designated pick-up and drop-off area for this movement will be in the vicinity of the .
cross-walk area near the building entry. This area will be monitored/controlled by
designated school personnel during the entirety of all pick-up/drop-off periods and a
controlled safe atmosphere will be maintained. The main parking area in front of the
building(north side) will be designated for employees/teachers,all of whom are required
to be at the school in advance of the morning drop-off period(before 7:30)and who are also
required to be on the campus during the afternoon pick-up(unti13:30 at minimum). As a
result,the northernmost parking bay will be largely inactive during the morning and
afternoon drop-off/pick-up period and therefore can be used for parent vehicle stacking.
Based on cprrent practice at the existing school,the longest anticipated queue of vehicles
would likely occur during the afternoon peak pick-up period and the maximum queue
expected would be approximately 5-7 vehicles. Students who are all to drive to the
school(school will hold lottery and only allow 45 students to drive),will be directed to
enter and exit the facility through the Scudder Avenue driveway and designated parking
spaces in the south west portion of the parking field will be provided for such students.
This configuration will keep student drivers away from the areas where pick-up and drop-
off activities will occur. Refer to Figure 1 for a demonstration of the intended pick-up and
drop off activities.
In addition,the depth of both driveways leading into the school site is substantial and
provides flexibility with potential morning drop-off and afternoon pick-up activities. As a
result, the Sturgis Charter Public School leadership will continually monitor site operations.
To the extent that adjustments are required to best accommodate safe and efficient access
for drop-off and.pick-up activities,they will be made. While we do not anticipate that it
will be necessary, if it is determined that one-way flow for all pick-up and drop-off
' activities would benefit site operations, it can be implemented.

PROJECT: STURGIS CHARTER PUBLIC SCHOOL(SPR#005-11)
LOCATION: 125 West Main St.,Hyannis,MA
I, Matthew Eddy, being a registered Professional Civil Engineer with the firm of BAXTER NYE ENGINEERING &
SURVEYING, Registered Professional Engineers and Land Surveyors, hereby certify that I have supervised the
preparation of the Civil Engineering Site Plans and specifications for the above named project and that,to the best of my
knowledge, information and belief, such Civil Engineering Site plans and specifications meet the applicable provisions
of the Massachusetts Building Code, Eighth Edition, as relevant to the site design, and generally accepted standards of
Civil Engineering practice in effect at the time of performance.
I further certify that I or persons under my supervision have:
1. Reviewed,for the limited purpose of checking for conformance with the design concept and compliance
with the information given in the Civil Engineering Site Plan construction documents,shop drawings,
samples and other submittals of the contractor(s)as required by the construction contract documents.
2. Reviewed quality control procedures for the code-required controlled Civil Engineering Site Plan materials;
and
3. Performed inspections at appropriate intervals during construction to become generally familiar with the
progress and quality of the contractor's work and to determine that the work is proceeding in general
accordance with the Civil Engineering Site Plan construction documents.
As of the date of this Certification,to the best of my knowledge,information and belief,the work has been substantially
performed and completed,with the exceptions noted below,in general accordance with:
— The Site Plans dated April 21,20111 as Approved by the Town of Barnstable.
— The Civil Site components of The Memorandum of Understanding executed between Sturgis Charter Public
School and the Town of Barnstable,dated July 11,2011.
This certification is for the purpose of checking for conformance with the design concept and general compliance with
the information given in the Approved Civil Engineering Site Plans. It is not to be considered a field control as-built of
all vertical and horizontal information shown on the Approved Site Plans nor is it to imply daily inspections of site plan
related work.
The following exceptions to the Approved Site Plans are noted:
1) The limit of clearing for sight distance looking eastbound along W.Main St.needs to be completed.
2) The final grade and stabilization of the Stormwater Management Basins need to be completed.
3) The final landscaping and stabilization of the project site needs to be completed.

MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding (MOLD entered into this day of July,2011, by
and between the STURGIS CHARTER PUBLIC SCHOOL, a.Commonwealth of
Massachusetts charter school,which received its charter from the Commonwealth of
Massachusetts in 1998 with its business address as 427 Main Street,Barnstable (Hyannis),
Massachusetts 02601 (hereinafter referred to as "Sturgis") and the TOWN OF
BARNSTABLE, an incorporated municipality,having a.business address of 367 Main Street,
Barnstable (Hyannis)Massachusetts 02601 (hereinafter referred to as the ""Town"). All of the
above are being collectively referred to in this Memorandum of Understanding as the"Parties".
WHEREAS, Sturgis is desirous of operating a second high school campus within the
Town of Barnstable to accommodate an additional 400 students in grades 9 through 12
(hereafter,the "School"), and;
WHEREAS,The William Sturgis Friends of Educational Foundation, Inc., a
Massachusetts non-profit corporation,has executed a purchase and sale agreement for a parcel of
land located at 125 Main Street, Hyannis, Massachusetts,shown as Parcel 2 on the plan recorded
with the Barnstable County Registry of Deeds as Plan Book 636, Page 4, which parcel of land
will be leased to Sturgis for its construction and use of the property as the School (hereafter,the
"Project"), and;
WHEREAS,the Town has expressed concerns about traffic and safety impacts from the
proposed second campus location as well as the impacts the proposed second campus would
have on the community's character, and;
WHEREAS, Sturgis and the Town have worked diligently to address the traffic safety
and community character impacts of the proposed second campus located at 125 Main Street,
Hyannis, MA, and;
WHEREAS,this Memorandum of Understanding is created for the purpose of ensuring
that the Town's concerns are adequately addressed.
NOW,THEREFORE, in consideration of the foregoing, the Parties agree as follows:
1. The Town shall not refer the Project or any aspect thereof,to the Cape Cod
Commission for mandatory or discretionary development of regional impact review or
any other type of review.
2. The Project shall be constructed in accordance with the following plans which have been
approved by the Town of Barnstable Site Plan Review Committee:
a. The civil site plan set entitled"Sturgis Charter Public School, 125 West Main
Street& Scudder Avenue Hyannis, Massachusetts"dated last revised on April 21,
2011,prepared by Baxter Nye Surveying and
Engineering, Inc., and consisting of 13 sheets (the"Site Plan Set").
b. The architectural plan set entitled"Sturgis C�AWd>, lic School West Campus

5. Sturgis shall maintain the vegetation to the east of the West Main Street access
driveway in the areas shown with diagonal striping on plan entitled"Sight Distance
Plan", Sheet C301 of the Site Plan Set,to provide adequate sight distances for vehicles .
exiting the West Main Street access driveway in accordance with the approved
Conservation Commission Order of Conditions.
6. As shown on the plan entitled "Layout and Materials Plan" (Sheet C300 of the Site Plan
Set), Sturgis shall stripe the pavement to the north of the school building as"Fire Lane".
Although striped as such, it is agreed and acknowledged that said area may be used by
school and Cape Cod Regional Transit Authority buses for morning student drop-off and
afternoon pick-up. During such time,the bus drivers must remain with the busses in the
event of an emergency. This area shall not be used for long-term bus parking. Cars shall
be prohibited, at all times, from parking in this area.
7. Prior to the Town issuing an occupancy permit for the Project, Sturgis shall install a
crosswalk, a STOP-sign, and a STOP-bar at the Old Main Street approach to West Main
Street. In addition, Sturgis has voluntarily agreed to deposit the sum of$5,000.00(Five
Thousand Dollars)toward pedestrian improvements to the Pitcher's Way/West Main
Street intersection. Since the total projected costs for said improvements are
approximately$150,000.00, said monies shall be held by the Town's Affordable
Housing/Growth and Development Trust Fund until such time as the additional monies
necessary to fund the Pitcher's Way/West Main Street intersection are obtained from
other sources.
8. Sturgis shall perform a traffic monitoring study one(1) year after the School has opened
in accordance with the"Traffic Monitoring Outline"Memorandum prepared by VHB,
dated April 13, 2011, attached as Exhibit D.

9. After one (1)month of opening the School to students, but prior to the expiration of two
(2)months from the date,of opening the School, Sturgis shall contact the Barnstable
Police Department to determine if there have been any complaints or incidents that may
have been reported at either the West Main Street or Scudder Avenue driveways. To
the extent that there are any incidents or complaints,the School shall consult with the '
Barnstable Police Department and the School's traffic engineer about corrective
measures.
10. Sturgis agrees that the hours of operation for the school facility and its use in the evening
and during the summer shall be in conformance with Exhibit E which is incorporated by
reference herein.
11. Sturgis agrees to enter into a separate agreement with the Town to establish Student
Parking Permit Protocols and to address other parking issues related to its campus located
at 427 Main Street, Hyannis, Massachusetts and the site of the temporary West campus to
be located at 434 Main Street, Hyannis,Massachusetts.
_12. This Memorandum of Understanding ("MOU") shall be binding upon the Town and
Sturgis, and its successors and assigns, for so long as the premises are used as an
educational school facility. This MOU may modified or amended only by a written
instrument executed by both the Town and Sturgis.
13. This MOU shall be interpreted under the laws of the Commonwealth of Massachusetts
and shall be enforceable in a.court of competent jurisdiction within the Commonwealth.

Students who request permission to drive their cars to Campus will be placed in a lottery
if the number of students requesting permission exceeds the number of on-site student designated
parking spaces (46 parking spaces). Priority in the lottery for student parking spaces will be
given to those students who list the members of the carpool that they will be bringing to School.
The School will offer incentives to students who arrange a carpool to come to School.
All students driving to Campus will be directed to enter and exit the Campus through the

Student Pick-up/Drop-off and Dismissal Procedure Protocol— 125 West Main Street
In order to provide safe conditions for the students, as well as to comply with directives
of the Fire Department and Town of Barnstable,the following pick-up and drop-off procedures
should be followed:
All buses will enter the campus from Scudder Avenue and will queue directly along the
curb on the north side of the building to allow students to be dropped off at the curb of the
facility. Buses will exit at West Main Street.
All parent drop-off activities and car-pool activities shall enter the campus from West
Main Street and exit at Scudder Avenue. The designated pick-up and drop-off area for this
movement will be in the vicinity of the cross-walk area near the building entry. This area will be
monitored and controlled by designated school personnel during the entirety of all pick-up/drop-
off periods and a controlled safe atmosphere will be.maintained.
Students who are allowed to drive to the school (i.e.,those having received a permit
through the parking lottery), will be directed to enter and exit the facility through the Scudder
Avenue driveway and park in the student-designated parking spaces. This configuration will
keep student drivers away from the areas where pick-up and drop-off activities will occur in the
middle of the property.

Off-Campus Lunch Protocol—125 West Main Street
Student safety is of paramount importance to Sturgis. Therefore, Sturgis has created this
policy for students who are walking off-campus during the lunch-period to purchase food and/or
beverages. Students walking off-campus will be instructed to remain on the south side(school-
side) of West Main Street where there are sidewalks leading to various food establishments.
These establishments are in the area of 187-215 West Main Street, in addition to the gas
station/convenience mart that is proposed to.open adjacent to the Campus. Presently,these
establishments include:New England Pizza, Cumberland Farms, Golden Fountain Chinese and
Papa John's Pizza. The School has made initial contact with the managers of these businesses
who very much welcome the prospect of additional patrons.
The assessed walk time to these facilities has been identified as five minutes or less and is
therefore deemed convenient based on the School's limited lunch period of 45 minutes.
Many students bring "brown-bag" lunches to school and eat inside the School.
Designated classrooms within the School will be made available for students who remain on-
campus during the lunch period. Additionally, students and staff may order lunch,which is
delivered each day,by area establishments.

As requested, the Sturgis Charter Public School will perform a traffic monitoring study one
year after the facility is open and operational. This study will summarize traffic generation,
drop-off activity,pedestrian traffic,and general safety conditions of the school driveways.
This document will be submitted to the Town of Barnstable. Details include:
• Conduct Manual turning movement counts and maximum queue s at both the West
Main Street and Scudder Avenue site driveways during the morning peak hour 7-
9AM and during the mid_afternoon school peak 2-4PM.
• Collect traffic data at the pick-up and drop-off areas on site including maximum
queue during the'pick-up and drop-off period.
• Collect pedestrian counts at both the West Main Street and Scudder Avenue site
driveways during the morning.peak hour 7-9AM and during the mid-afternoon
school peak 2-4PM.
• Review accident history of both site access driveways based on Town of Barnstable
Police data. Review any onsite accident data and any offsite pedestrian accident
data within one mile of the Sturgis West Main Street that involves a Sturgis student
when the school is in session.
• Review onsite parking activity during the morning peak drop-off and afternoon
pick-up periods. Also review student driver activity by observations both on
campus and off.
The results of the data collection will be summarized in the form of a memorandum that
will be submitted to the Town of Barnstable Department of Growth Management.

EXHIBIT E: HOURS OF OPERATION AND USAGE DURING EVENINGS AND SUMMER
1. School Year: The Sturgis' academic school year commences on or about
August 20Th and runs through on or about June 251h. The Commonwealth of
Massachusetts requires the academic school year to consist of a minimum of
182 school days; accordingly,in the event of a particularly snowy winter
and/or the need to cancel school during the school year,it may be necessary
to extend the academic year past June 25th.
2. Hours of Operation: Sturgis' students typically arrive between 7:50-8:15am
and,the majority of students depart between 3:10-3:30pm, Mondays through
.Fridays. Faculty, administrators and staff typically arrive around 7:30am and
depart around 5:30 pm, Mondays through Fridays. After school programs
are offered until 5:30 pm. .
3. Evening Events: Sturgis anticipates between 5-8 evening events for Sturgis'
parents at the School during the academic year.
4. Summer Usage: In the summer,when school is not in session (i.e.,
approximately June 26th—August 19th,see paragraph 1 above),Sturgis
agrees that the School will not be used for summer school,nor shall it be
rented for community usage. During this time,use of the School building will
be limited to Sturgis' administrators,staff,and faculty. Additionally,the
premises and building may be used / occupied by contractors or other
maintenance and service providers should any construction, renovations,
maintenance, repairs,etc...be necessary.

the north of the school building as"Fire Lane". Although striped
as such, it is agreed and acknowledged that said area may be
used by school and Cape Cod Regional Transit Authority buses
for morning student drop-off and afternoon pick-up. During such
time, the bus drivers must remain with the busses in the event of
an emergency. This area shall not be used for long-term bus
parking. Cars shall be prohibited, at all times, from parking in this
area.
7. Prior to the Town issuing an occupancy permit for the Project, Yes—see attachment 3
Sturgis shall install a crosswalk, a STOP-sign, and a STOP-bar at
the Old Main Street approach to West Main Street. In addition,
Sturgis has voluntarily agreed to deposit the sum of$5,000.00
(Five Thousand Dollars) toward pedestrian improvements to the
Pitcher's Way/West Main Street intersection. Since the total
projected costs for said improvements are approximately
$150,000.00, said monies shall be held by the Town's Affordable
Housing/Growth/Growth and Development Trust Fund until such time as
the additional monies necessary to fund the Pitcher's Way 1 West
Main Street intersection are obtained from other sources.
8. Sturgis shall perform a traffic monitoring study one.(1) year after Ongoing
the School has opened in accordance with the "Traffic Monitoring
Outline" Memorandum prepared by VHB, dated April 13, 2011,
attached as Exhibit D.
9. After one (1) month of opening the School to students, but prior to Due October 2012
the expiration of two (2) months from the date of opening the
School, Sturgis shall contact the Barnstable Police Department to
determine if there have been any complaints or incidents that may
have been reported at either the West Main Street or Scudder
Avenue driveways. To the extent that there are any incidents or
complaints, the School shall consult with the Barnstable Police
Department and the School's traffic engineer about corrective
measures.
10. Sturgis agrees that the hours of operation for the school facility Ongoing
and its use in the evening and during the summer shall be in
conformance with Exhibit E which'is incorporated by reference
herein.
11. Sturgis agrees to enter into a separate agreement with the Town No
to establish Student Parking Permit Protocols and to address
other parking issues related to its campus located at 427 Main
Street, Hyannis, Massachusetts and the site of the temporary
West campus to be located at 434 Main Street, Hyannis,
Massachusetts.

Students who request permission todrive their cars to Campus will be placed in a lottery if the number of
students requesting permission exceeds the number of on-site student designated parking spaces (46 parking
spaces). Priority in the lottery for student parking spaces will be given to those students who list the members of
the carpool that they will be bringing to School. The School will offer incentives to students who arrange a
carpool to come to.School.All students driving to Campus will be directed to enter and exit the Campus through
the Scudder Avenue entrance.

Student Pick-up/Drop-off and Dismissal Procedure Protocol-125 West Main Street
In order to provide safe conditions for the students, as well as to comply with directives of the Fire Department
and Town of Barnstable, the following pick-up and drop-off procedures should be followed:
• All buses will enter the campus from Scudder Avenue and will queue directly along the curb on the north
side of the building to allow students to be dropped off at the curb of the facility. Buses will exit at West
Main Street.

• All parent drop-off activities and car-pool activities shall enter the campus from West Main Street and exit
at Scudder Avenue. The designated pick-up and drop-off area.for this movement will be in the vicinity of
the cross-walk area near the building entry. This area will be monitored and controlled by designated
school personnel during the entirety of all pick-up/drop- off periods and a controlled safe atmosphere will
be maintained.
• Students who are allowed to drive to the school (i.e., those having received a permit through the parking
lottery), will be directed to enter and exit the facility through the Scudder Avenue driveway and park in the
student-designated parking spaces. This configuration will keep student drivers away from the areas
where pick-up and drop-off activities will occur in the middle of the property.

Off-Campus Lunch Protocol-125 West Main Street
Student safety is of paramount importance to Sturgis. Therefore, Sturgis has created this policy for students
who are walking off-campus during the lunch-period to purchase food and/or beverages. Students walking off-
campus will be instructed to remain on the south side (school- side) of West Main Street where there are
sidewalks leading to various food establishments. These establishments are in the area of 187-215 West Main
Street, in addition to the gas station/convenience mart that is proposed to open adjacent to the Campus.
Presently, these establishments include: New England Pizza, Cumberland Farms, Golden Fountain Chinese and
Papa John's Pizza. The School has made initial contact with the managers of these businesses who very much
welcome the prospect of additional patrons.
The assessed walk time to these facilities has been identified as five minutes or less and is therefore deemed
convenient based on the School's limited lunch period of 45 minutes.
Many students bring "brown-bag" lunches to school and eat inside the School. Designated classrooms within
the School will be made available for students who remain on-campus during the lunch period. Additionally,
students and staff may order lunch, which is delivered each day, by area establishments.
2. Hours of Operation: Sturgis' students typically arrive between 7:50-8:15am and, the
majority of students depart between 3:10-3:30pm, Mondays through Fridays. Faculty,
administrators and staff typically arrive around 7:30am and depart around 5:30pm,
Mondays through Fridays. After school programs are offered until 5:30pm.
3. Evening Events: Sturgis anticipates between 5-8 evening events for Sturgis' parents at
the School during the academic year.
4. Summer Usage: In the summer, when school is not in session (i.e., approximately June
26th- August 19th,see paragraph 1 above), Sturgis agrees that the School will not be
used for summer school, nor shall it be rented for community usage. During this time,
use of the School building will be limited to Sturgis' administrators,staff, and faculty-
Additionally, the premises and building may be used /occupied by contractors or other
maintenance and service providers should any construction, renovations,
maintenance, repairs, etc...be necessary.

INTRODUCTION
Vanasse Hangen Brustlin,Inc.(VHB)has prepared this supplemental memorandum to
respond to comments outlined in the Town of Barnstable peer consultant(Vanasse&
Associates,VAI)letter issued on April 7,2011 regarding the proposed Sturgis Charter
Public School project to be located along West Main Street in Hyannis,Massachuseits. For
ease of review,each of the comments made in the VAI letter has been repeated and the
subsequent response is provided: "
Comment 1: Trip Generation; Based upon observations of drop-off activity and the number of
students bused to the school, the initial trip-generation estimates appear low. On Friday morning,
March 25,2011,approximately 40 students arrived by bus and the remaining students were either
dropped off or walked to the school. With a peak hour estimate of only 54 exiting vehicles projected
at the new school, this number does not reflect the high drop-off activity which occurs at the existing
school. In addition, the amount of walking students at the new school may be less than the existing
school due to its location. The VHB estimates were based upon standard trip rates published by the
Institute of Transportation Engineers, but the data utilized,appears not to.reflect actual conditions
at the school,as the existing school seems to accommodate low bus ridership and a significant drop-
of f activity.It is recommended that vehicle-trips estimates be revised based upon actual conditions at .
the school. The actual percent of bus ridership at the existing school should be documented based on
field observations.
Response 1: Traffic counts at the existing Sturgis Charter Public School were collected on
Monday April 111h between the hours of 7-9AM and 2-4PM to confirm the traffic activity at
the existing facility and to compare actual counts to the projections made by standard ITE
procedures for the proposed facility. The traffic counts collected are included in the
Appendix of this document and are summarized below in Table 1.

As outlined in Table 1 above,the empirical counts conducted at the existing Sturgis Charter
Public School result in slightly higher traffic activity during the morning period(+17 trips
entering and+43 trips exiting)and lower traffic during the afternoon peak hour period(4
trips entering and-34 trips exiting) than that which was projected based on standard TTE
practices. As a result,and with consideration given for recent proposed modifications to
access patterns for drop-off and pick-up at the proposed school,which is discussed in detail
in Comment 2 below,VHB has updated the future condition traffic volume networks and .
driveway intersection operational analyses to reflect the actual traffic counts collected and
proposed access patbern revisions. Intersection operational analyses at the West Main
Street driveway were conducted assuming reuse of the existing fueling facility and
associated access modifications. The results of the updated driveway analyses are reflected
in Table 2 below:

As shown in Table 2, the West Main Street and Site Driveway intersection is expected to
operate at LOS A during the weekday morning and evening peak hour periods for all
movements except the northbound left turn(left turn exiting the site). The northbound left
turn is anticipated to operate at LOS C during the weekday morning peak hour(7:30 AM to
8:30 AM)and the weekday afternoon peak hour(2:45 PM to 3:45 PM).
As shown in Table 2 operations for at the Scudder Avenue and Site Driveway intersection
is expected to operate at LOS A during the weekday morning and evening peak hour
periods for all movements. The only exception is the southbound left turn movement(left
turn from site)which is expected to operate at LOS B during the weekday morning peak
hour(7:30 AM to 8:30 AM)and the weekday afternoon peak hour(2:45 PM to 3:45 PM).
Comment 2:Drop-Off and Pick-Up Plan; The initial drop-off and pick-up plan raised concerns as it
was proposed to have two-way drop-offs with queued vehicles blocking parking and students walkEng
between drop-off vehicles. It appears that a new site plan has been developed and a new drop-off and
pick-up plan must be developed to provide safe conditions for the students. Drop-off and pick-ups in
one direction will be the safest plan and the maximum expected queue should be identified.
Response 2: Modifications to the original site plan outlined in the February 2,2011 VHB
memorandum were introduced through discussion with representative of the Town of
Barnstable Department of Growth Management and the Fire Department. The revisions
were introduced to provide direct access for bus traffic to the curb of the facility which was
a directive of the Fire Department. The reconfigured site plan will allow the pick-up and
drop-off activities to be better managed by staff of the Sturgis School who will be outside
monitoring/controlling all activities during the entirety of the morning drop-off and
afternoon pick-up periods. Under the revised plan,all buses will enter the site from
Scudder Avenue and will queue directly along the curb on the north side of the building
(refer to Figure 1 attached). In addition,all parent drop-off activities and car-pool activities
will be directed to enter the facility from West Main Street and exit at Scudder Avenue.
The designated pick-up and drop-off area for this movement will be in the vicinity of the
cross-walk area near the building entry. This area will be monitored/controlled by
designated school personnel during the entirety of all pick-up/drop-off periods and a
controlled safe atmosphere will be maintained. 'The main parking area in front of the
building(north side)will be designated for employees/teachers,all of whom are required
to be at the school in advance of the morning drop-off period(before 7:30)and who are also
required to be on the campus during the afternoon pick-up(until 3:30 at minimum). As a
result,the northernmost parking bay will be largely inactive during the morning and -
afternoon drop-off/pick-up period and therefore can be used for parent vehicle stacking.
Based on current practice at the existing school,the longest anticipated queue of vehicles
would likely occur during the afternoon peak pick-up period and the maximum queue
expected would be approximately 5-7 vehicles. Students who are allowed to drive to the
school(school will hold lottery and only allow 45 students to drive),will be directed to
enter and exit the facility through the Scudder Avenue driveway and designated parking
spaces in the south west portion of the parking field will be provided for such students.
This configuration will keep student drivers away from the areas where pick-up and drop-
off activities will occur. Refer to Figure 1 for a demonstration of the intended pick-up and
drop off activities.
In addition,the depth of both driveways leading into the school site is substantial and
provides flexibility with potential morning drop-off and afternoon pick-up activities. As a
result, the Sturgis Charter Public School leadership will continually monitor site operations.
To the extent that adjustments are required to best accommodate safe and efficient access
for drop-off and pick-up activities, they will be made. While we do not anticipate that it
will be necessary,if it is determined that one-way flow for all pick-up and drop-off
activities would benefit site operations, it can be implemented.

Comment 3:Gap Study, The Gap Study analysis presented is not appropriate for the school study
as the data was collected in January, but most importantly, most of the school activity peaks within a
half-our period in the morning and afternoon and not an hour as the data suggests.
Response 3: An initial Gap Study was conducted along West Main Street in the vicinity of
the proposed site driveway in January 2011 in combination of traffic counts that were used
as the basis for the traffic impact assessment. January is a period when the Sturgis Charter
Public School would be in session so it is reasonable to review the potential gaps during
this period,even though not.a peak season traffic condition. The proposed school wi#
operate between September and June and will have little to no activity during peak
summer months when background traffic on the Cape and in this area is at its highest
levels. To further assess the potential gaps in existing flow along West Main Street,an
updated Gap Study was conducted on Monday April 11,2011.

Based on revised pick-up and drop-off patterns that will be enforced,also includes anticipated volume from reuse of fuel facility

As outlined in the table,the available gaps sufficient to allow safe left turn movement are
estimated to be 82 during the peak half hour in the morning and 101 during the afternoon
peak half hour based on the updated April,2011 count.
According to the Highway Capacity Manual Exhibit 17-5,the critical gap to accommodate a
left-turn maneuver from the side street is 7.1 seconds.The results of the gap study show
that there are approximately 82 available gaps greater than 7 seconds during the weekday
morning peak half hour and 101 gaps during the weekday afternoon peak half hour of
Sturgis Charter Public School traffic activity along West Main Street.
As a result of the revised site plans and designated drop-off/pick-up patterns,the peak
hour traffic distribution has been revised to reflect anticipated traffic flows that will be
realized based on Sturgis Charter Public School directives to bus operators,students who
drive,and parents who bring students to the campus. It should be noted that the peak left-
turn demand from the West Main Street Driveway is expected to be approximately 5 or less
vehicles during the critical half hour of operations during the weekday morning peak hour
and 5 or less during the critical half hour during the weekday afternoon peak hour.

Since the updated gap study was conducted in April,VHB has reviewed the seasonal
adjustment factors published by the Cape Cod Commission in their annual Traffic
Counting Report Based on this information,June traffic in this area would be expected to
be approximately 23% higher than that in April. As a result the gaps that were observed
during the April count were adjusted by 23% to estimate June conditions. Based on this
approach,there would be approximately 64 gaps in traffic in the peak AM half hour of
activity in and approximately 78 gaps in traffic in the peak PM half hour of activity
associated with the school.
As outlined in the narrative above and summarized in Table 3, the available gaps in traffic
at the West Main Street Site Driveway in April and June,during the critical morning half-
hour and the critical afternoon half-hour,are more than capable of meeting the anticipated
needs.
Comment 4 Stopping Sight Distance; The existing stopping sight distance on West Main Street
at the driveway looking east does not meet industry standards,but can be achieved with clearing of
vegetation and the fence to the east of the driveway. This land appears to be owned by the school and
it should be confirmed this can be completed.
Response 4_ The Proponent has applied for and received approval from the Town of
Barnstable Conservation Commission,by way of an Order of Conditions(attached for
reference in the Appendix),to do the clearing necessary to improve existing site lines at the
site driveway at West Main Street looking east With this approval established,the sight
distance to be implemented will meet/exceed industry standards when complete.
Comment 5: Fueling Station Parcel;As part of the site development plan, the eastern most fuel
station driveway will be closed and the turning radius for the school driveway will be within the
frontage of the fuel station parcel. Appropriate documentation or easements should be in place such
that this is not a problem when the parcel is redeveloped. In addition,a new cub-cut from the fuel
station parcel to the school access driveway is proposed. This may lead to cut-through traffic on the
school property and is not desirable.
Response 5_ The proposed access plan to West Main Street was initiated to put forward
access management strategies that are typically welcomed and encouraged on the Cape
and throughout Massachusetts. The proposed plan results in the consolidation of what
would be two closely spaced driveways(school drive and eastern fueling station driveway)
to a single point of access which minimizes the potential number of conflicts along this
section of West Main Street. The Proponent's ability to implement the proposed plan is
demonstrated in the attached document,Notice of Development Agreement
As a result of the proposed access configuration with the existing westerly access to the
existing fueling facility being consolidated on the Sturgis Charter Public School driveway
approximately 160 feet to the south of West Main Street,we anticipate only limited traffic
activity between the fuel facility and that of the Sturgis Charter Public School traffic.
Access to the fuel facility from the Sturgis Charter Public School driveway will not be
nearly as direct or convenient as that which will be available from the existing westerly feel
'facility driveway and therefore we expect that access into and out of the fuel facility along
the Sturgis Charter Public School driveway will be a minor movement However,to
minimize the potential for cut-through activity between the fuel facility and Scudder
Avenue using the Sturgis Charter Public School driveway,a series of signing initiatives will
be implemented including"NO Thru Traffic"signs along both site driveway entrances and
a"NO Right Turn" sign on the egress from the fueling facility to the Sturgis Driveway.
Refer to the proposed signing initiatives which are demonstrated Figure 2 attached to this
document in the Appendix.

moo'' Relocating the existing crosswalk that exists immediately west of the adjacent fueling
facility western driveway to a place closer to the proposed Sturgis Charter Public School
driveway is likely not necessary. Currently there are crosswalks located along West Main
Street to the east and west of the proposed Sturgis Charter Public School driveways. The
closest crosswalk to the proposed driveway is located approximately 275 feet to the west of
the proposed Sturgis Charter Public School driveway. A second crosswalk currently exists
along West Main Street approximately 470 feet to the east of the proposed Sturgis Charter
Public School driveway. Both crosswalks have likely been implemented at these locations
originally due to demonstrated need or desire by pedestrians to cross at each location. Both
crosswalk locations are established and on a straight section of roadway and appear to
have good visibility approaching from the east and west Moving the existing crosswalk
west of the site driveway to the area of the site driveway would take it from a straight
section of roadway and put it on a curve. Since the distance from the driveway to the
existing crosswalk location is relatively minor and there is likely established pedestrian
activity at the existing crosswalk location we do not believe that moving the crosswalk is
necessary. In addition,we suggest that the recommended signage for school zone ahead
(S4-5a)be placed further to the west along the eastbound approach to encompass the
existing crosswalk within the designated school zone area. In addition,Sturgis Charter
Public School will issue a directive to all students that may walk to school from the north
that the existing crosswalks are to be used for crossing West Main Street
The Proponent will install,a crosswalk,STOP-sign,and STOP bar at the Old Main Street
approach to West Main Street as this crossing will be an important pedestrian connection
for students to gain access to the restaurants located immediately to the west of this
intersection.
Students that may want to gain pedestrian access to the proposed school from the .
northwest will be directed to cross West Main Street at the existing crosswalk located 275
feet to the west of the Sturgis Charter Public School driveway. Crossing West Main Street
at the Pitcher'.s Way signalized will not be allowed. Instead to the extent that there are
students walking to the school from the northwest they will be directed to cross West Main
Street at the existing crosswalk located 275 feet to the west of the Sturgis Charter Public
School driveway.
Comment 8: Monitoring Study; It is recommended that one year after the school opening,a traffic
monitoring study be completed and submitted to the Town to document the traffic generation,drop=
off activity,pedestrian traffic and safety conditions of the school driveways. It is important to note
that at the West Main Street driveway there is not sufficient room for through traffic to bypass left
turning traffic into the school. This could result in some levels of congestion especially during the
morning period. A police detail should be provided at this location,should the police department
determine it is necessary after opening.
ResQonse 8: As requested,the Sturgis Charter Public School will perform a traffic
monitoring study one year after the facility is open and operational- This study will
summarize traffic generation,drop-off activity,pedestrian traffic,and general safety
conditions of the school driveways. This document will be submitted to the Town of
Barnstable.
After the school has been operational for 1 month,the Sturgis School will contact the
Barnstable Police Department to inquire about any complaints or incidents that may been
reported at the driveway that the school is unaware of. To the extent that there are any
incidents or complaints the school will consult with the Police department and VHB about
potential corrective measures.

Comment 6: School Zone Signage; It is unclear whether a school zone and appropriate signage will
''be established along West Main Street and Scudder Avenue. It,is strongly recommended that school
zones be established and follow industry standards. In addition, STOP-signs and street lighting
should be present at the West Main Street and Scudder Avenue driveways.
Response 6:As indicated on the attached site plan,Figure 2,school zone ahead signage is
proposed consistent with Mass Department of Transportation Traffic Management
regulations and those outlined in the October 6,2006 Amendment to the Manual of
Uniform Traffic Control Devices(M.U.T.C.D.). In addition,on the attached site plan,
(V/V STOP-signs and appropriate approach stripping is proposed along the site driveway
approach to both West Main Street and Scudder Avenue.
The Sturgis Charter Public School will operate generally between the hours of 7:30 AM to
3:30 PM each day of the week between September and June. During the school year,the
only activity that is planned for the proposed facility in the evenings are parent-type events
and they will be held on a very limited basis,between 3-5 times during the school year. All
other activities associated with the school will occur during typically daylight hours and
therefore a need for street lighting at the site access driveways is not anticipated at this
time. In addition,the general character of Scudder Avenue in the vicinity of the proposed
school is generally residential in nature and therefore street lighting would very likely not
be appropriate.
Comment 7: Pedestrian Access; There will be pedestrian trips generated to and from the school and
the sports practice locations will result in daily pedestrian traffic off-campus. It is recommended that
specific travel routes be identified to the practice field and provisions for safe crossings at major
roadways provided. Existing deficiencies should be identified. There are no crosswalks at the west
end rotary and this safety deficiency needs to be addressed. In addition, the following is
recommended:
• A crosswalk at the West Main Street School entrance should be considered. The
existing crosswalk at the westerly fuel station driveway could be relocated to the
school driveway.
• A crosswalk and STOP-sign should be installed at Old Main Street,as this
crossing connects to identified lunch locations.
• The signalized intersection of West Main Street and Pitchers Way should be
modified to accommodate pedestrian signals, crosswalks,and an opticom
emergency receiver.
Response 7:Figure 5A in the February 2,2011 VHB Traffic Memorandum incorrectly
suggested that some students may gain access to sporting facilities by walking. Access to
all sporting facilities from the proposed Sturgis Charter Public School will be by shuttle van
or bus,students will not be allowed to access sporting facilities by foot.
The Sturgis Charter Public School plans to issue a directive to all students that walking to
or from the proposed facility through the West End Rotary is not allowed. Sturgis Charter
Public School does not expect any students would originate from a location where
pedestrian access through the West End Rotary would be necessary,However,to the extent
that there are any students that are oriented to the residential neighborhoods in downtown
Hyannis they will be sent to the existing downtown campus location for schooling,or be
directed to a bus-pick-up/drop-off location to gain shuttle access to the facility if not
gaining access through typical parent drop-off or car pool.

PARKING LICENSE
This is an agreement made by TFG Hyannis Hospitality LLC (Resort), a Massachusetts
corporation having as its address,the Resort and Conference Center, 35 Scudder Avenue,
Hyarmis, MA 02601, and Sturgis Charter Public School. ("Sturgis"), a public school operating at
427 Main Street, Hyannis; MA 02601.
Recitals
The Resort operates on a site located on Scudder Avenue near West Main. Street in
Hyannis,.Massachusetts. Sturgis has an approved plan.by the Town of Barnstable Site Plan
Review Board to build.a second school campus on land near to the Resort site. It is agreed that.
in the event Sturgis is successful in its permitting and opens a second campus at.the proposed
site, which is between 125 West Main Street and Scudder Avenue, this agreement shall, take
effect, but not otherwise:
1. Subject to Sturgis successfully obtaining its required.municipal permits and
constructing its second school campus on the site identified above, the Resort grants to Sturgis 11.
license, revocable at the discretion of the Resort by 1.2 months in advance written notice to
Sturgis, to use during the school day a section, up to a maximum of 30 parking spaces, oifthe
Resort's parking lot located nearest the Scudder Street entrance to the Sturgis school. It is
anticipated that Sturgis will initially use these additional parking spaces in late August, 2013.
2. At the begimning of each school year while this Agreement is in effect, Sturgis
shall provide the Resort with the total number of parking spaces that Sturgis will use iii Resort's
parking lot during that school year in addition to the starting and ending dates that Sturgis will
use the parking spaces. Sturgis agrees to pay a fee of.$20/month for each of the parking spaces
that it requests to use during the school year. The payment of this annual fee will.be due on
October l of each year that this agreement is in place.
3. The area where Sturgis overflow parking shall be pennitted by the Resort shall be
identified as adjacent to the. Scudder Street entrance to Sturgis. Access to any other parking area
of the Resort property by vehicular traffic by Sturgis, its students, or its invitees is prohibited.
4. Sturgis shall notify in writing all parent, students,or other persons who may
potentially use the Resort parking lot of the following conditions of use:
• The Resort parking lot may be used for student parking on school days and
between the following hours only: 7:30 a.m. to 4:30 p.m.;
The Resort parking; lot is not to be used on any other occasion.or for any other
purpose and is only available during school hours on school days;
® Persons using the lot are to stay in the designated area only and are not to travel
onto any other portion of the .Resort property by vehicle or on.afoot;
® Sturgis shall respect, and shall take reasonable measures to instruct its students.
their parents and other invitees to respect, the.rights of the Resort.

Sturgis shall defend the Resort and its respective past, present and future officers,
directors; managers, shareholders, members, agents and attorneys with counsel reasonably
satisfactory to the Resort; and shall indemnify the :Resort and hold it harmless from and against.
any and all claims, demands;penalties, causes of action, damages, losses., liabilities. costs,
expenses, whether based on negligence or strict liability, including reasonable attorneys' fees of
any kind or nature whatsoever, involving personal injury or death or property darnage resulting
from. arising out of or in.any manner directly or indirectly related to the use of the Resort
parking areas by Sturgis and/or by its employees; students, parents, invitees and others for whose_
conduct Sturgis is legally responsible. So long as Sturgis is actively and continuously defending

against any such claim, each of the Resort shall have the right to participate in.the defense of the
claim with counsel of their choosing, but at the participating parties' expense. If and when
Sturgis is not actively and continuously defending against any such claim asserted with counsel
reasonably satisfactory to the Resort, the Resort shall have the right to assume the defense of the
claim. with counsel of their choosing, but at Sturgis' expense.
6. Sturgis agrees to maintain in full force and effect and at its sole cost a genera]
liability insurance policy providing coverage in minimum aniounts of$1 000,()00 per occurrence
and $3,000,000 in the aggregate covering Sturgis for any and all claims and incidents that. in ai-w
way arise out of the use of the Resort parking. lot as set forth above.
7. The Resort shall be named as additional insureds under the insurance policy
referred to in paragraph 6. Sturgis shall provide Resort with a Certificate of Insurance
evidencing the existence of the insurance coverage required of Sturgis' by paragraph 6, naming
the Resort as additional insureds, v y
S. In the event Sturgis has a grievance against the Resort. Sturgis ag.ree-s to submit
the dispute to nonbinding mediation before resort.in.?to litigation. If the parties are not able:to
agree on a mediator; the parties will jointly petition the Barnstable Superior Court to appoint a.
mediator. The cost of the mediator and any filings in court to be shared equally.
9. Subject to Sturgis' acceptance of the provisions in this Agreement. the Resort.
agrees to speak to all state and municipal authorities having permitting jurisdiction in favor of
Sturgis' efforts to obtain all required municipal permittinn necessary to build a. second campus
adjacent to the Resort site. y
10. Any notices that are required or permitted to be given.under this Agreement shall.
be in writing and shall be considered as given for purposes of this Agreement when received if
sent by hand, by nationally recognized overnight delivery service orVbv U.S. Express Mail; and
four days after being posted for delivery by first class, certified, U.S. mail, return receipt
requested, with postage and fees prepaid, whether or not delivery is accepted. Notices shall. be
sent to the party addressed at that party's address given at the head of this Agreement or to such
other address notice of which complying with these provisions has been given by that party to a]I.
other parties. Nothing in this provision shall be taken as prohibiting the giving of notices in any

11. All parties consent and submit to the jurisdiction of the Superior Court of the
Commonwealth of Massachusetts, sitting in Boston, and, if available,the United States District
Court for the District of Massachusetts, as the exclusive jurisdiction and venue for all legal
proceedings that may be brought under this Agreement. The parties irrevocably waive any
objection to jurisdiction and venue in such courts and waive anv claim that either of such courts
is an inconvenient forum.
12. This Agreement set forth the entire agreement of the parties; superseding any
prior or contemporaneous written amem.ent or oral discussions. The rights of the Resort under
this Agreement shall be binding upon and shall inure to the benefit of its legal representatives,
successors and assigns, but the rights of Sturgis under this Agreement shall not be assignable.
By signing, each signatory acknowledges that he/she has the authority to enter into the license.
and to bind the respective party and that the party has the right to enter into this license. No
amendment of the provisions of this Agreement shall be valid unless in writing and signed by all
parties. Massachusetts law shall govern the construction and enforcement of this Agreement
which shall not be recorded with the Barnstable County Registry of Deeds or the Barnstable
district of the Land Court; any recording of this Agreement shall automatically, and.without any
the execution of any further instrument, have the effect of revocation of the license hereby
granted to Sturgis. A reproduction of this Agreement made by photostatic, magnetic or other
electronic process shall be as admissible in administrative and judicial proceedings as an
original.

Melody Tent(the"Melody Tent"), a Massachusetts corporation having as its address, 130 Sohier

a Nlassachusetts limited liability company having as its address c/o Kevin C. Cain, Peabody &
Arnold LLP, 600 Atlantic Avenue, Boston, MA 0221.0-2216, and Sturgis Charter Public School
("Sturgis"), a public school operating at 427 Main Street, Hyannis,MA 02601.
Recitals
The Melody Tent operates a concert venue at a site located between West Main Street
and Scudder Avenue in Hyannis; Massachusetts. The Melody Tent leases its site from Smith
Heirs,the property owner. Sturgis has submitted plans to the"Town of Barnstable Site Plan
Review Board to build a second school campus on land adjacent to the Melody Tent site. It is
agreed that in the event Sturgis is successful in its permitting and opens a second campus at the
proposed site, which is between 125 West Main Street and Scudder Avenue, this agreement shall
take effect, but not otherwise:
1. Subject to Sturgis successfully obtaining its required municipal permits and
constructing its second school campus on the site identified above, and subject always to the
Melodv Tent's superseding requirements for its use of all of its parking spaces when a]Melody
Tent show is being held, the Melody Tent grants to Sturgis a. license, revocable at the discretion
of the Melody Tent by written notice to Sturgis, to use a section of the Melody Tent's parking lot
located nearest the West Main Street entrance to the Sturgis school site only on those evenings
when Sturgis needs overflow parking for parent events, such as PTO meetings. In all events, the
maximum number of times the Melody Tent parking lot shall be used by Sturgis for parking in a
school year is seven(7).
2. At the beginning of each school year while this Agreement is in effect, Sturgis
shall provide the Melody Tent with.a list of the dates on which it wishes to use the Melody Tent
parking tot. Sturgis shall not schedule a school event during which it wishes to use a designated
portion of the Melody Tent parking lot on an evening when the Melody Tent has a performance.
Upon receiving the list,the Melody Tent will notify Sturgis if there is a conflict. Any conflict
shall be resolved in favor of the Melody Tent,with Sturgis rescheduling events that conflict with
Mclody`Tent performances if it wishes use of Melody Tent parking during the school event. If
overflow parking is needed on a date not on the list furnished, Sturgis shall provide the Melody
Tent with 14 days advance, written notice of the request for use on the unscheduled date. The
`Melody Tent, not being under any obligation to grant the request, shall promptly notify Sturgis if
it can accommodate the request. Nothing in this paragraph shall be construed as increasing the
maximum number of times in a school year when Sturgis may use the designated portion of the.
Melody Tent parking lot.
3. The area where Sturgis overflow parking shall be permitted by the Melody Tent
shall. be identified and cordoned off by the Melody Tent. Sturgis agrees to reimburse the Melody
Tent for the cost of the temporary fencing/barriers/gates needed to cordon off the area. Access to

any other area of the Melody Tent property by vehicular or pedestrian traffic by Sturgis, its
students or its invitees is prohibited.
4• Sturgis shall notify in writing all parents or other persons who may potentially use
the Melody Tent parking tot of the following conditions of use:

Melody Tent and to Smith Heirs; and shall indemnify each of the Melody Tent Indemnitees and
hold each of them harmless from and against any and all claims, demands,penalties, causes of
action, damages, losses, liabilities, costs, expenses, whether based on negligence or strict
liability, including reasonable attorneys' fees of any kind or nature whatsoever, involving
personal injury or death or property damage resulting from,arising out of or in any manner
directly or indirectly related to the use of the Melody.Tent parking areas by Sturgis ancUor by its
employees,students,parents, invitees and others for whose conduct Sturgis is legally
responsible. So long as Sturgis is actively and continuously defending against any such claim,
each of the Melody Tent and Smith Heirs shall have the right to participate in the defense of the
claim with counsel of their choosing, but at the participating parties' expense. If and when

8. Sturgis specificatly recognizes that the Melody Tent, which has been in
continuous operation for more than 50 years, operates as a concert venire, with amplified sound,
audience noise, and brief periods of heavy traffic associated with a performance. Sturgis
acknowledges that none of the present and anticipated future uses of the Melody Tent property
constitutes a private nuisance actionable by Sturgis or by any of its agents, either alone or in
concert with others. Sturgis agrees to refrain from commencing; and shall take all necessary
measures to cause its employees, agents and invitees to refrain horn commencing, any
proceedings before any governmental authority in which it is asserted that Melody Tent
operations constitute a.private nuisance.
9. In the event the Sturgis school is in session when a concert or show is scheduled
at the Melody Tent; Sturgis will provide best efforts to direct primary traffic, inclusive of
students and faculty, to use the Scudder Avenue entrance/exit to the Sturgis property.
10. Inasmuch as Sturgis's operations overlap to some extent with the Melody Tent's
season, Sturgis agrees to apply best efforts not to schedule meetings and other activities at the
School during the Melody Tent's operating season, as it may be extended. The Melody Tent's
current season runs frorn June l to September 8. The Melody Tent shall notify Sturgis in the
event of any plans to extend its season.
11. In the event Sturgis has a grievance against.the Melody Tent, Sturgis agrees to

faculty parking needs at our central Hyannis campus at 427 and 434 Main Street and our parking plan for faculty
and students driving to this campus. As I never received a reply from you, I assumed that our attached plan was
accepted. I was surprised to see on the MOU Compliance Checklist that Paragraph#11 has"no"for
compliance.
Please let me know as soon as possible if my assumption about the acceptance of the plan that I submitted last
September 1 was or was not correct.

Per Health Department, classrooms and school lobby area are
designated eating areas. Students may wash hands in lobby
kitchenette or restrooms. Desks and tables must also be cleaned
at the end of the lunch period.

Within one year from the date of occupancy of the building, the Ongoing due September
School shall meet with the Site Plan Review Committee to 2013
discuss the effectiveness of, compliance with, and potential
modifications to the School's Drop off and Pick Up Plan
referenced herein below, and the School's parking and traffic
circulation protocols.
Drop Off and Pick-Up Plan as set forth in Response 2 in
Memorandum from Randall C. Hart, VHB to Sturgis Charter
School dated April 13, 2011 and depicted in the memorandum's
Figure 1 "Revised Pick-Up/Drop-Off Plan Details" must be
followed. (Response 2 and Figure 1 are attached to the site plan
approval letter dated July 6, 2011
Site Plan Review approval is contingent upon the Applicant's
execution of a Memorandum of Understanding with the Town
which establish policies for the following, without limitation: the
use of striped fire lane areas by buses for drop-off/pickup;student
parking protocol;student lunch protocol;traffic flow on site;and,
hours of operation and usage during evenings and summer months.
Applicant must obtain all other applicable permits, licenses and
approvals required.
Upon completion of all work,a registered engineer or land surveyor
shall submit a letter of certification,made upon knowledge and
belief in accordance with professional standards that all work has
been done in substantial compliance with the approved site plan
(Zoning Section 240-105(G)). This document shall be submitted
prior to the issuance of the final certificate of occupancy.
4. Sturgis shall implement and enforce the following protocols and Ongoing
procedures at the
School:
a. The Student Parking Permit Protocol attached as Exhibit A);
b. The Arrival/Dismissal Procedure Protocol (attached as Exhibit
B); and The Off-Campus Lunch Option Protocol (attached as
Exhibit C).
5. Sturgis shall maintain the vegetation to the east of the West Main Ongoing
Street access driveway in the areas shown with diagonal striping
on plan entitled "Sight Distance Plan", Sheet C301 of the Site
Plan Set, to provide adequate sight distances for vehicles exiting
the West Main Street access driveway in accordance with the
approved Conservation Commission Order of Conditions.
6. As shown on the plan entitled "Layout and Materials Plan" (Sheet
C300 of the Site Plan Set), Sturgis shall stripe the pavement to
the north of the school building as"Fire Lane". Although striped
as such, it is agreed and acknowledged that said area may be
used by school and Cape Cod Regional Transit Authority buses
for morning student drop-off and afternoon pick-up. During such
time, the bus drivers must remain with the busses in the event of
an emergency. This area shall not be used for long-term bus
parking. Cars shall be prohibited, at all times, from parking in this
area.
7. Prior to the Town issuing an occupancy permit for the Project, Yes—see attachment 3
Sturgis shall install a crosswalk, a STOP-sign, and a STOP-bar at
the Old Main Street approach to West Main Street. In addition,
Sturgis has voluntarily agreed to deposit the sum of$5,000.00
(Five Thousand Dollars) toward pedestrian improvements to the
Pitcher's Way I West Main Street intersection. Since the total
projected costs for said improvements are approximately
$150,000.00, said monies shall be held by the Town's Affordable
Housing/Growth and Development Trust Fund until such time as

the additional monies necessary to fund the Pitcher's Way 1 West
Main Street intersection are obtained from other sources.
8. Sturgis shall perform a traffic monitoring study one (1) year after Ongoing
the School has opened in accordance with the "Traffic Monitoring
Outline" Memorandum prepared by VHB, dated April 13, 2011,
attached as Exhibit D.
9. After one (1) month of opening the School to students, but prior to Due October 2012
the expiration of two (2) months from the date of opening the
School, Sturgis shall contact the Barnstable Police Department to
determine if there have been any complaints or incidents that may
have been reported at either the West Main Street or Scudder
Avenue driveways. To the extent that there are any incidents or
complaints, the School shall consult with the Barnstable Police
Department and the School's traffic engineer about corrective
measures.
10. Sturgis agrees that the hours of operation for the school facility Ongoing
and its use in the evening and during the summer shall be in
conformance with Exhibit E which is incorporated by reference
herein.
11. Sturgis agrees to enter into a separate agreement with the Town No
to establish Student Parking Permit Protocols and to address
other parking issues related to its campus located at 427 Main
Street, Hyannis, Massachusetts and the site of the temporary
West campus to be located at 434 Main Street, Hyannis,
Massachusetts.

Student Parking Permit Protocol —125 West Main Street
Students who request permission todrive their cars to Campus will be placed in a lottery if the number of
students requesting permission exceeds the number of on-site student designated parking spaces (46 parking
spaces). Priority in the lottery for student parking spaces will be given to those students who list the members of
the carpool that they will be bringing to School. The School will offer incentives to students who arrange a
carpool to come to School. All students driving to Campus will be directed to enter and exit the Campus through
the Scudder Avenue entrance.

In order to provide safe conditions for the students, as well as to comply with directives of the Fire Department
and Town of Barnstable, the following pick-up and drop-off procedures should be followed:
• All buses will enter the campus from Scudder Avenue and will queue directly along the curb on the north
side of the building to allow students to be dropped off at the curb of the facility. Buses will exit at West
Main Street.
• All parent drop-off activities and car-pool activities shall enter the campus from West Main Street and exit
at Scudder Avenue. The designated pick-up and drop-off area for this movement will be in the vicinity of
the cross-walk area near the building entry. This area will be monitored and controlled by designated
school personnel during the entirety of all pick-up/drop-off periods and a controlled safe atmosphere will
be maintained.
• Students who are allowed to drive to the school (i.e., those having received a permit through the parking
lottery), will be directed to enter and exit the facility through the Scudder Avenue driveway and park in the
student-designated parking spaces. This configuration will keep student drivers away from the areas
where pick-up and drop-off activities will occur in the middle of the property.

Off-Campus Lunch Protocol-125 West Main Street
Student safety is of paramount importance to Sturgis. Therefore, Sturgis has created this policy for students
who are walking off-campus during the lunch-period to purchase food and/or beverages. Students walking off-
campus will be instructed to remain on the south side (school- side) of West Main Street where there are
sidewalks leading to various food establishments. These establishments are in the area of 187-215 West Main
Street, in addition to the gas station/convenience mart that is proposed to open adjacent to the Campus.
Presently, these establishments include: New England Pizza, Cumberland Farms, Golden Fountain Chinese and
Papa John's Pizza. The School has made initial contact with the managers of these businesses who very much
welcome the prospect of additional patrons.
The assessed walk time to these facilities has been identified as five minutes or less and is therefore deemed
convenient based on the School's limited lunch period of 45 minutes.
Many students bring "brown-bag" lunches to school and eat inside the School. Designated classrooms within
the School will be made available for students who remain on-campus during the lunch period. Additionally,
students and staff may order lunch, which is delivered each day, by area establishments.

2. Hours of Operation: Sturgis' students typically arrive between 7:50-8:15am and, the
majority of students depart between 3:10-3:30pm, Mondays through Fridays. Faculty,
administrators and staff typically arrive around 7:30am and depart around 5:30pm,
Mondays through Fridays. After school programs are offered until 5:30pm.
3. Evening Events: Sturgis anticipates between 5-8 evening events for Sturgis' parents at
the School during the academic year.
4. Summer Usage: In the summer, when school is not in session (i.e., approximately June
26th- August 19th,see paragraph 1 above), Sturgis agrees that the School will not be
used for summer school, nor shall it be rented for community usage. During this time,
use of the School building will be limited to Sturgis' administrators, staff, and faculty.
Additionally, the premises and building may be used /occupied by contractors or other
maintenance and service providers should any construction, renovations,
maintenance, repairs, etc...be necessary.

One of the advantages of Sturgis' Hyannis location is the opportunity it affords us to interact
with the larger community. With parental permssion, students may leave the campus at lunchtime.
They understand that leaving to buy lunch in a local establishment is a privilege. It can be withdrawn
if the student behaves in a way which discredits the school's standing in the community or fails to
return from lunch ready to begin class on time. While out in the community, it is imperative that
students are aware of their surroundings. On crosswalks, one must never assume that cars will stop in
accordance with the signs. Wait for all traffic to come to a complete stop before crossing. Those
students who do not have a parent's permission or who lose lunch privileges eat in supervised
situations.
Sturgis offers a set lunch program that can be ordered in the morning prior to 8:20 a.m. Students who
opt for the set lunch program can pick up their lunch at the main office at the beginning of the lunch
period.
Student safety is of paramount importance to Sturgis. Therefore, Sturgis has created this policy

Students are allowed to bring a bag lunch and eat in the lobby and classrooms of Sturgis West. Students
are forbidden from eating lunch on the floor of the campus. The following classrooms are acceptable
places to eat lunch.

How to enter and exit Sturgis West

Pitchers Way to West Main Street. Papa John's Pizza will be directly in front of you. Take a left on West
Main, and then enter the school driveway by taking a right off of West Main.
Student Parking Permit Protocol—Sturgis West, 105 West Main Street
Students who request permission to drive their cars to Campus will be placed in a lottery if the number of

(46 parking spaces). The highest priority will be given to students taking the most students to school.

rule may be towed by local law enforcement. Students that violate this rule are also subject to
disciplinary measures at school.

respond to comments from the Town of Barnstable Department of Growth Management
regarding the proposed Sturgis Charter Public School project to be located along West Main
Street in Hyannis,Massachusetts. As discussed with representatives of Growth
Management,additional parking counts were conducted in four areas surrounding the
existing Sturgis Public Charter School located on Main Street in downtown Hyannis.
Figure 1 attached to this document identifies the four areas where supplemental parking
counts were conducted. These parking areas include the following parking lots:
• North Street Public Parking Lot(west portion of North Street Lot)
• Rockland Trust Parking Lot(North Street)
• Red Cross Parking Lot(South Street)
• Town Hall Parking Lot(west section only near school)
Traffic/Parking counts at the four parking areas identified above were conducted during
the hours of 7-9AM on Monday April 25,2011. Prior to initiating the supplemental counts,
VHB discussed the count program with representatives of Growth Management. In order
to save some cost associated with the supplemental traffic counts,VHB proposed that an
assumption would be made that all vehicles recorded in the parking areas identified below
who arrived during the morning peak hour would also leave during the afternoon peak
hour period as they are primarily teachers and students. This approach results in a highly
conservative assessment as the afternoon egress typically occurs over a longer period than
the morning peak(crush)period. The traffic counts collected are included in the Appendix
of this document and are summarized below in Table 1.

fair amount of Sturgis Charter Public School traffic and parking activity occurring at each
of the four lots where counts were conducted. As a result,the peak hour driveway
analyses that were prepared in response to the town's Peer Consultant in the April 13,2011
VHB Memorandum,Response to Peer Review Memorandum,have been updated to reflect the
increase in traffic that has been identified.
VHB has updated the future condition traffic volume networks and driveway intersection
operational analyses to reflect the actual traffic counts collected and proposed access
pattern revisions. Intersection operational analyses at the West Main Street driveway were
conducted assuming reuse of the existing fueling facility and associated access
modifications. The results of the updated driveway analyses are reflected in Table 2 below-:

West Campus 125 West Main Street Hyannis, MA 02601"dated
May 9, 2011,"prepared by Studio G Architects, and consisting C�J/0�
of 9 sheets.
3. Sturgis shall comply with the following conditions of Site Plan
Review approval, which the Parties agree are, at the Town's
discretion, independently enforceable in a court of competent
jurisdiction in the Commonwealth:
Approval is based upon site plans entitled "Sturgis Charter Public
School", 125 West Main Street & Scudder Avenue, Hyannis, IVIA,
dated February 16, 2011 consisting of 13 Sheets, with final
revisions to Sheets C 100, C200, C301, C401, C402, C403, C404,
C500, C600 and C601 on April 6, 2011; and final revisions to
Sheets C000, C300, C400 April21, 2011 per formal Site Plan
Review comments; Scale 1" =40', prepared by Baxter Nye
Engineering & Surveying, Hyannis, MA for Sturgis Charter Public
School Also, landscape, lighting, elevation plans entitled "Sturgis
Charter Public School West Campus" 125 West Main Street,
Hyannis, MA consisting of9 Sheets: G000, 1-1OO, A200,A201
and E04A dated May 9, 2011; A1OO.1 dated April
3,2011;A300,A301 dated April 6, 2011; and E004 dated April 1,
2011 prepared by Studio G_Architects, Jamaica Plain, MA.
Per Health Department, classrooms and school lobby area are
designated eating areas. Students may wash hands in lobby ��
kitchenette or restrooms. Desks and tables must also be cleaned
at the end of the lunch period.
A copy of an offsite parking agreement with Cape Cod Melody Yes—see attachment 1
Tent for parent events must be provided.
A copy of an.offsite parking agreement with the Resort and Yes—see attachment 2
Conference Center to allow parking for up to 30 cars during the
school day must be provided.
Driveways must be marked in accordance with Town ordinance
as"Fire Lanes" and as such, parking in.the driveways is not
allowed.
On street, offsite parking by students, including parking in ngo �4
driveways, shall not be allowed.
Applicant must contact Department of Public Works and submit
application to change area to"School Zone" indicating signage
location, type, 20 MPH speed zone, etc
Within one year from the date of occupancy of the building, the Ongoing due September
School shall meet with the Site Plan Review Committee to 2013
discuss the effectiveness of, compliance with, and potential
f
modifications to the School's Drop off and Pick Up Plan
referenced herein below, and the School's parking and traffic
circulation protocols.
Drop Off and Pick-Up Plan as set forth in Response 2 in
Memorandum from Randall C. Hart, VHB to Sturgis Charter mr _��
School dated April 13, 2011 and depicted in the memorandum'sFigure 1 "Revised Pick-Up/Drop-Off Plan Details" must be `followed. (Response 2 and Figure 1 are attached to the site plan `
approval letter dated July 6, 2011
Site Plan Review approval is contingent upon the Applicant's
execution of a Memorandum of Understanding with the Town
which establish policies for the following, without limitation: the
use of.striped fire lane areas by buses for drop-off/pickup;student
parking protocol;student lunch protocol;traffic flow on site;and,
hours of operation and usage during evenings and summer months.
Applicant must obtain all other applicable permits, licenses and
approvals required.
Upon completion of all work,a registered engineer or land surveyor
shall submit a letter of certification,made upon knowledge and
belief in accordance with professional standards that all work has
been done in substantial compliance with the approved site plan
(Zoning Section 240-105(G)). This document shall be submitted
prior to the issuance of the final certificate of occupancy.
4. Sturgis shall implement and enforce the following protocols and Ongoing
procedures at the
School: ,
a. The Student Parking Permit Protocol attached as Exhibit A);
b. The Arrival/Dismissal Procedure Protocol (attached as Exhibit 4
B); and The Off-Campus Lunch Option Protocol (attached as
Exhibit C).
5. Sturgis shall maintain the vegetation to the east of the West Main Ongoing
Street access driveway in the areas shown with diagonal striping
on plan entitled "Sight Distance Plan", Sheet C301 of the Site
Plan Set, to provide adequate sight distances for vehicles exiting
the West Main Street access driveway in accordance with the
approved Conservation Commission Order of Conditions.
6. As shown on the plan entitled "Layout and Materials Plan" (Sheet
C300 of the Site Plan.Set), Sturgis shall stripe the pavement to
the north of the school building as"Fire Lane". Although striped
as such, it is agreed and acknowledged that said area may be
used by school and Cape Cod Regional Transit Authority buses
for morning student drop-off and afternoon pick-up. During such
time, the bus drivers must remain with the busses in the event of
an emergency. This area shall not be used for long-term bus.

7. Prior to the Town issuing an occupancy permit for the Project, Yes—see attachment 3
Sturgis shall install a crosswalk, a STOP-sign, and a STOP-bar at
the Old Main Street approach to West Main Street. In addition,
Sturgis has voluntarily agreed to deposit the sum of$5,000.00
(Five Thousand Dollars) toward pedestrian improvements to the
Pitcher's Way/West Main Street intersection. Since the total
projected costs for said improvements are approximately
$150,000.00, said monies shall be held by the Town's Affordable
Housing/Growth and Development Trust Fund until such time as
the additional monies necessary to fund the Pitcher's Way 1 West
Main Street intersection are obtained from other sources.
8. Sturgis shall perform a traffic monitoring study one (1) year after Ongoing
the School has opened in accordance with the "Traffic Monitoring
Outline" Memorandum prepared by VHB, dated April 13, 2011,
attached as Exhibit D.
9. After one (1) month of opening the School to students, but prior to Due October 2012
the expiration of two (2) months from the date of opening the
School, Sturgis shall contact the Barnstable Police Department to
determine if there have been any complaints or incidents that may
have been reported at either the West Main Street or Scudder
Avenue driveways. To the extent that there are any incidents or
complaints, the School shall consult with the Barnstable Police
Department and the School's traffic engineer about corrective
measures.
10. Sturgis agrees that the hours of operation for the school facility Ongoing
and its use in the evening and during the summer shall be in
conformance with Exhibit E which is incorporated by reference
herein.
11. Sturgis agrees to enter into a separate agreement with the Town
to establish Student Parking Permit Protocols and to address
other parking issues related to its campus located at 427 Main
Street, Hyannis, Massachusetts and the site of the temporary
West campus to be located at 434 Main Street, Hyannis,
Massachusetts. /

STURGIS CHARTER PUBLIC SCHOOL
Student Parkinq Permit Protocol —125 West Main Street
Students who request permission todrive their cars to Campus will be placed in a lottery if the number of
students requesting permission exceeds the number of on-site student designated parking spaces (46 parking
spaces). Priority in the lottery for student parking spaces will be given to those students who list the members of
the carpool that they will be bringing to School. The School will offer incentives to students who arrange a
carpool to come to School. All students driving to Campus will be directed to enter and exit the Campus through
the Scudder Avenue entrance.

Student Pick-up/Drop-off and Dismissal Procedure Protocol-125 West Main Street
In order to provide safe conditions for the students, as well as to comply with directives of the Fire Department
and Town of Barnstable, the following pick-up and drop-off procedures should be followed:
• All buses will enter the campus from Scudder Avenue and will queue directly along the curb on the north
side of the building to allow students to be dropped off at the curb of the facility. Buses will exit at West
Main Street.

2011-12 Parking Plan for 427&434 Main Street
1. Maximum Number of Students at 427 Main Street Using Parking Spaces: 46
This number includes 6 additional spaces beyond the estimated number (40) reported on page 2 of
the traffic study memorandum dated April 26, 2011 submitted to the Town of Barnstable by Randy
Hart of VHB in support of the school's application for Site Plan Review. A copy of this traffic study
memorandum is included as a separate attachment to the email containing this Parking Plan.
As the parking spaces adjacent to the Red Cross building number 60 spaces plus 4 handicap spaces,
our plan is to require all 46 students noted above to park in the parking lot adjacent to the Red Cross
building. All students will apply for permission to park in this lot and will be given a parking decal in
order to track their compliance with this guideline. (NOTE: An informal count of unoccupied spaces
taken at 10:00 a.m. on September 1, 2011, the second day of school, noted 18 unoccupied spaces in
the parking area adjacent to the Red Cross building). Students will not be allowed to park in the
parking lot adjacent to Town Hall and the School Administration Building.
2. Maximum number of faculty and staff at 427 Main Street using parking spaces: 56
Our plan for faculty/staff parking is to assign parking spaces as follows:
• Sturgis Charter parking off Pearl Street 31 spaces
• Parking at 20-26 Pearl Street 10 spaces
• Parking allocated by Rockland Trust 15 spaces
Total 56 spaces
3. Maximum number of 434 Main Street(Artifacts) students using parking: 0
All of these students are in grades 9 & 10 and thus are not qualified to drive.
4. Maximum number of faculty/staff at 434 Main Street using parking spaces: 20
Our plan for faculty/staff parking for 434 Main Street is to expect these employees to park in the
large parking lot off North Street behind the school building and to enter via the back door.
5. Maximum number of hours these parking spaces will normally be used during the school year:
Hours that Faculty/Staff parking is used at both buildings: Arrival at 7:30-8:15 a.m.; Departure at
3:30-4:30 p.m.
