The building and pump islands are currently located within the. front yard setback. The use is a I so nor,--conforming. Presently, the Highway Business .--one requires a Special Permit for a gas station . Attorney Ford stated that as -he gas station existed prior io the zoning : ancge, it is a non-conforming use. In addition , the gas station is non-conforming due to the fact `hat the property is now located within a Groundwater Protection Overlay District that does not allow underground fuel storage tanks or the storage of hazardous materials such as would be stored in a gas station. The applicant is planning to remove the existing gas station building and rep'.ace it at another location on the site. in addit'on, about 470 sp, ft. of this new buildings will be a "Mini Mart" that will sell prepackaged food products . All structures on the site will comply with the current setback regulations. The applicant is also planning to install a ter ( 10) foot wide green strip along 'Test Main Street in accordance with the Zoning Bylaw. The applicant is proposing to remove the exist;rig pump islands, building and all five (5) underground fuel tanks. The tanks wi11 be replace by three (3) new tanks that are in accordance with the current Health and Fire Department rpgl..l 1 at i on.zi. There will be three ( 3) new pump islands with a total o six (h) pumps. The applicant has stated that the new arrangement of pump islands should fac' lita?:e traffic_ Flow. The islands will be covered by a canopy. Mr. Borback of Atlantic Design presented the traffic study for the site. The study reviews the potential traffic impact of the project and Mr. Borback stated that with irnpier.ientation of the recommendations contained in the study, there wil ' be no adverse impact on traffic conditicns as related to the proposed project. Mr. Borback also commented on t:he easterly access drive. The Site Access section of the traffic study calls for a recommended width of twenty-four (24) feet for the drive and a maximum width of thirty-two (32) feet . The Site Plan Review Committee had also expressed concern with the eas er 'y access drive. Attorney Ford stated that the Size Plan Review Committee would like to see a width of twenty- four (24) feet For the drive. FINDINGS 0= FACT: Based upon the information provided, the Zoning Hoard of Appeals made the Following findings of Fact : 1 . The Board has heard evidence that the existing structure and gasoline pumps are non-conforming; 2 . The new traffic plan and orientation wouic7 be an improvement for the traffic flow; 3 . The installation of the new approved underground tanks would benefit the site as it is near a wetland and in a Groundwater Protection Overlay District; 4, in accordance with Section 5-3. 3 of the Zoning Bylaw, the Sit.= Plan Review Committee has approved a Site Plan fo- the project ; 5 . The applicant is installing a ten ( 10) foot wide buffer strip in accordance with Section 3--3.6 (6) o` the Zoning Bylaw; and 6. There is adequate parking on the site. Assessor's Map/Parcel: Map 290, Parcel 101-001 Zoning: Highway Business and Residence B Zoning Districts Recording Information: Special Permit No. 1990-031 - Book 7228, Page 039 Property Deed - Book 21628, Page 233 Division Plan to be recorded - Plan Book pate _ Relief Requested and Background: In 1990, the Zoning Board issued Special Permit 1990-031 to.Marathon Enterprise, Inc:., for property addressed 125 West Main Street, Hyannis, MA.. The permit was issued to allow for the expansion and alteration of a nonconforming use of a gas station in the Groundwater Protection Overlay District and for a conditional use, a "Mini Mart", for retail sales in the Highway Business Zoning District. The special permit was issued to that lot that existed which is a 7.8-acres lot. The site of the proposed redeveloped gas station was, however, limited to the northwestern corner of the 7.8-acre lot within the first 200 feet off West Main Street. It is fully within the Highway Business Zoning District. In Appeal 2010-010, the applicant sought to modify the special permit to have it apply to a proposed new lot of 1.86-acres to be created frorn the existing larger lot. That lot is encompassing only that area of the lot developed and used as the gas station and mini mart. The proposed new lot is shown on a 2005 Approval Not Required (ANR) plan that was endorsed by the Planning Board but which has not been filed with the Registry of Deeds. Procedural & Hearing Summary: This appeal was filed at the Town Clerk's office and at the office of the Zoning Board of Appeals on March 30, 2010. A public hearing before the Zoning Board of Appeals was duly advertised and notice sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened April 28, 2010, at which time the Board found to grant the modification of Special Permit No. 1990-031 subject to conditions. Board Members deciding this appeal were, James F. McGillen, William H. Newton, Michael P. Hersey, Craig G. Larson, and Board Chair, Laura F. Shufelt, Attorney Michael D. Ford represented the applicants. He gave a brief history of the site noting that the special permit specified was applicable to the entire 7.80 acre lot. He noted that most of the lot is in the Residence B Zoning District and only a small portion in the Highway Business Zoning District. i Town of Barnstable,Zoning Board of Appeals—Decision and Notice Appeal No. 2010-010—Sousa&SOUSa-Modification of Special Permit 1990-031 The entire site is also within a designated Groundwater Protection Overlay District. Most of the gas station is developed in the Highway Business and to allow the nonconforming aspects to apply to that unused land area zoned for residential use is not in keeping with the overall intent of zoning. It could lead to a nonconforming use being located in a residential area in close proximity to abutting homes. Attorney Ford noted that the proposed new lot for the gas station and mini mart meets all bulk regulations for the Highway Business Zoning District. He also noted that he had reviewed the proposed staff conditions and as most only apply to the recording requirements, the applicant has no objection to the conditions. He noted that the Board has the authority to modify the permit as Chapter 40A Section 14, Powers of the Board of Appeals, authorizes the Board to modify previously issued permits. The Board asked about the monitoring wells. Attorney Ford stated that he was not award of the exact location of the monitoring wells but would commit that if any exist they would be there for the. gas station and the obligations of the station owner to monitor those wells would have to be maintained. The public was invited to speak. Richard J. Murphy of 30 Arbor Way, Hyannis asked ahout the future use of the 5.92-acre Lot #2. It was noted that the land was mostly within the Residence B Zoning District and as there was only 4.25-acres of upland, the, use under existing ZGrlrng Would be for 4 singlr-family homes. It was also noted that the land could be used for exempt use (churches, schools and certain institutions), and a Chapter 40 B permit for affordable housing could also be sought. William H. Hoagland of 10 Arbor Way, Hyannis also commented on concerns for the wetlands and wildlife that inhabits the undeveloped portion of the lot. Findings of Fact: At the hearing of April 28, 2010, the Board unanimously made the following findings of tact: l. Joseph J. Sousa and Lorraine A. Sousa have applied for a Modification of Special Permit No. 1990- 031 issued to Marathon Enterprise, Inc., for a conditional use of a convenience store and to alter a nonconforming use of a gas station. The modification is sought to alter the area upon which the special permit applies from a 7.88-acre lot to a new lot of 1.86 acres. The new lot is shown as Parcel 1 on a plan submitted. The subject property is shown on Assessor's Map 290 as parcel 101-001, addressed 125 West Main Street, Hyannis, MA. It is in the Highway Business and Residence B Zoning Districts. 2. On June 6, 1990, the Zoning Board issued Special Permit 1990-031 to Marathon Enterprise, Inc. The permit was issued to allow for the expansion and alteration of a nonconforming use of a gas station in the Groundwater Protection Overlay District and for a conditional use, a "Mini Mart", for retail sales in the Highway Business Zoning District. 3'. Today, the applicant is seeking to modify the special permit to have it apply only to a proposed new lot of 1.86-acres to be created from the existing larger lot. The proposed new lot is shown on. a 2005 Approval Not Required (ANR) plan endorsed by the Planning Board on March 23, 2005. 4. The relief being requested in the interest of the public as it would be conforming to the zoning of the property. Division of the lot fulfills the spirit and intent of the zoning ordinance and does not represent a detriment to the public good or the neighborhood. 2 Town of Barnstable, Zoning Board of Appeals- Decision and Notice Appeal No. 2010-010-Sousa &Sousa-Modification of Special Permit 1990-031 Decision: Based on the findings of fact, a motion was duly made and seconded to grant Appeal No. 2010-010 to Modify Special Permit No. 1990-031 subject to the following conditions:: 1. Special Permit No. 1990-031 is hereby modified to now apply to a new lot of 1.86 acres to be created from the original 7.88-acre lot. That new lot is shown as Parcel 1 on a plan submitted and entitled Plan of Land prepared for Joseph J. Sousa Barnstable, (Hyannis) Mass. as drawn by CapeSury and dated March 12, 2005 and endorsed by the Planning Board of the Town on March 23, 2005. 2. Our concerns are twofold. First, we feel the two-story building will drastically alter the pristine landscape that exists in extremely limited supply in the heavily congested area of West Main Street. The woodlands offer passersby and area residents a welcome and refreshing break from the Melody Tent crowds and the bumper-to-bumper traffic. Secondly, and more troubling, is the aforementioned traffic. West Main is subject to dangerous vehicle travel patterns because the narrow road is dotted with strip malls, groceries, a high school, endless entrances and exits. In addition, the narrow road is a major ambulance and fire truck route. The area in question is also a stone's throw from the west end rotary, a danger in itself, with motorists rarely stopping at the stop sign or yielding to traffic in the rotary. In the past year alone, cars have barreled through the rotary, literally into the liquor store, at least three times. At Sports Port, adjacent to the Hastings Meadow entrance, a car narrowly missed a pedestrian when it crossed onto the sidewalk and hit the store's front lot display last year. Pedestrians walk the gauntlet on West Main. Vehicles travel far too fast for the existing conditions on West Main. The road is heavily traveled in any season, with speed enforcement sadly neglected. Add 400- plus students to the mix, with accompanying vehicles and pedestrian traffic, and you get an increasingly dangerous situation. As you are aware, currently the Gas Station property has two curb cuts on West Main Street. The Approved Site Plan for the School Property shows the most easterly curb cut on the Gas Station Property being closed and the Gas Station Property being connected to the new driveway access to West Main Street to be built on the School Property. (See Approved Site Plan dated 3/9/2011, as revised.) The result is the elimination of one curb cut on West Main Street servicing the Gas Station Property and the addition of a curb cut jointly servicing both properties. Since there are no changes proposed to the Gas Station Property other then the curb cut modifications, there is no net increase in the number of curb cuts onto West Main Street, and the proposed curb cuts modifications have been approved by the Town Site Plan Review Committee, it is your opinion that the closing of that curb cut onto the Gas Property and the connection of the Gas Property to the new access road, all as shown on the Approved Site Plan for the School Property, does not require any modification of the Special Permit 1990-031 or 2010-010. As such, you have determined that no zoning relief would be required for this access modification. If I have accurately stated your decision as Building Commissioner with respect to this matter, I would ask that you acknowledge, where indicated, a copy of this letter and return it to me for my files.
