Headquartered in Hyannis and established in 1986, Fowler and Sons, Inc. ("the Applicant") is a locally owned and operated termite and pest control company serving all of Cape Cod. Thank you for your recent review and approval of my client's informal site plan review application to obtain a business certificate to continue to operate their business at their new location at 347 West Main Street, which is across the street from their present location at 358 Main Street. ("the Applicant") is a locally owned and operated termite and pest control c� company serving all of Cape Cod. Now operated by the founder's sons, Jim and Chuck Fowler, `'`.� eL the Applicant has been operating out of its present location at 358 West Main Street since 1991. The business, however, has outgrown its 1440 square foot present building. Jim and Chuck Fowler would like to continue to operate their family owned business out of Hyannis and have therefore put a deposit down on the property directly across the street at 347 West Main Street, now occupied by Khouri's Oriental Rugs. Their purchase, however, is contingent upon being able to continue to operate their pest control company out of the new location. The purpose of this letter is to provide you with some background on the site as well as the intended use of the property for the Applicant's new headquarters. Site Background /Present Conditions The subject property is located south of the intersection of Woodland Avenue and West Main Street. Barnstable Assessor's records identify the .65 acre lot as Parcel 97 on Assessor's Map 269. A copy of the Assessor's field card-is attached.- The property is developed with a single commercial building situated in the center of the property, constructed in 1966 and extensively renovated in 1988-89. A copy of the site plan submitted with a prior owner's Special Permit application is also attached. The conditions shown on that site plan have not changed. The area to the south,east and west of the building is paved with asphalt. The front (north) of the building is landscaped. A storm water retention pond is located in the south western portion of the property. Prior to being renovated in the late 1980's, the prior use of the property was as a gasoline service station. The surrounding area is characterized as moderately to heavily developed with , primarily commercial development along West Main Street including Anchor Outboard boat sales and service as the western abutter, two nearby gasoline service stations, Fowler & Sons present operations located across the street, and Country Garden landscape supplies also nearby. Thomas Perry, Building Commissioner April 1, 2014 Page 2 The property was purchased by its present owners in 1998. It is currently used as a retail location for Khouri's Oriental Rug Company. A copy of the recorded deed and plan of land is attached for your reference.. The property is designated as commercial "Use Code" 3250, meaning "Store— Small Retail", and it lies in the "HB "district and a wellhead protection overlay district. The company carries a large inventory of indoor rugs for sale and also provides carpet cleaning and repair services. The Board of Health was unable to confirm whether the present use has necessitated a hazmat filing. The building is approximately 4,000 square feet. Ample parking on three sides of the building is provided; there are eighteen parking spaces at the site along with a loading dock/delivery entrance area at the rear of the building. Intended Use as Fowler and Sons, Inc. Headquarters The Applicant is purchasing the building to use as its office. The Applicant anticipates no appreciable difference in their operations in the new location from how they have operated at 358 West Main Street since 1991. The Applicant is simply seeking to move its headquarters across the street from 358 West Main Street to 347 West Main Street. They have outgrown the existing space and seek to expand their operations here in Hyannis, rather than relocating to another town. The existing headquarters is approximately 1440 square feet, while the new headquarters will be housed in a 4,000 square foot building. There will be no change to its existing operations,just more room for employees to operate and have designated work stations. The primary use of the property will be as an office, a confirming, as-of-right, use in the HB district. It is useful to describe a typical day at Fowler and Sons to evaluate the use. Presently, Fowler and Sons, Inc. employs twenty-five (25) full time employees. These employees generally arrive at the office between 6:30 a.m. and 8:00 a.m. Because there is very little parking at the 358 West Main Street headquarters and no place to park on West Main Street, the employees' vehicles are typically parked up and down Woodland Avenue, a residential side street, much to the chagrin of the local residents. Of the twenty-five employees, six are full-time office employees. They remain at the office.all day fielding inquiries from customers, preparing invoices, managing accounts receivables/payables, etc. The rest of the employees are service technicians. The technicians arrive in the morning in their Fowler and Sons pick-up trucks, submit their daily paperwork, prepare for their daily schedule of inspections and treatments, and load their pickup trucks with whatever supplies are needed for the day. At their present location, there is simply not enough space for this many employees to work effectively in a 1440 square foot building. These technicians occasionally return to the office when their service routes are complete, but most go home and don't return until the next morning. All of the service technicians are typically out of the office and on the road making service calls by 8:00 a.m. For the remainder of the work day, the office is staffed by the six full time office employees. The Applicant owns twenty (20)pick.up trucks. These are driven home by the employees in the evenings after their service calls are complete. In terms of supplies, Fowler and Sons historically has never stored enough pesticides to trigger a hazmat filing with the Thomas Perry, Building Commissioner April 1, 2014 Page 3 Board of Health. The supplies that service technicians bring to service calls are delivered as needed to the office, usually within one or two business days from ordering. This allows Fowler and Sons to order in small quantities. They order just the supplies they need so that large quantities of supplies are not stored long-term on the site. Typically; there are two deliveries of treatment supplies per week. The delivery/loading.dock area at the rear of 347 West Main Street will be helpful for these deliveries. The vast majority of the supplies are.then carried by the individual service technicians directly on to their pick up trucks. There are very small quantities of pesticides and mouse bait stored on the site, but never in quantities of more than 25 gallons and never in sufficient quantities to trigger a hazmat filing with the Board of Health. Fowler and Sons does not engage in the retail sale of pesticides or treatment supplies. Fowler and Sons, Inc. has no record of complaints to the Board of Health or the Building Commissioner related to their current operations at the present location. Moreover, moving their headquarters across the street will not only allow the business to grow and thrive, but it will also alleviate a difficult morning parking situation for the Woodland Avenue residents. In short, Fowler and Sons, Inc. has been an excellent corporate citizen and a pillar in the local business community for almost thirty (30) years and seeks your approval to continue to operate their termite and pest control business at 347 West Main Street. The Petitioner has further indicated that the existing underground fuel tanks have been removed. ' Abutting owners appeared in opposition to the petition expressing their concerns that the drainage conditions in the area were already bad and that the construction of the addition would exaccerbate these conditions. Photographs were reviewed by the Board showing that a portion of the abutting properties is frequently the subject of floodin gas the property now stands. Locus is located at 347 West main Street, Map 269 Lot 97, and currently contains an existing Texaco gasoline station. Locus is in a Highway Business Zoning District. The Petitioner presented evidence that the gasoline station has existed since 1965 , and was last operated as such during the fall of 1986. At the time of construction of the gasoline station, the locus was- zoned business. The Petitioner indicated that in 1982 the Zoning was changed for this area to a Highway Business District, which would require a 60-foot front yard set back. The gasoline station is non-conforming in that at the time it was built, it was set back approximately 48 feet from West Main Street. The Petitioners ' plans indicated that the lot contains approximately 26, 988 square feet. The Petitioner seeks a special permit to enlarge and alter the pre-existing non- conforming building, and to add to the existing .building a 2,340 square foot addition as is shown in plans submitted by the Petitioner. Evidence was submitted to indicate that the westerly 50 feet of the property was the subject of a drainage easement which apparently is now running in favor of the Town of Barnstable.
