Parcel 157 is improved with two structures; a 1,902 sq. ft. single-family residence and a 904 sq.ft. converted garage apartment. Parcel 158 is improved with an 876 sq. ft. single-family re`sidencel. The plot plan submitted by the applicant shows the square footage of the main building on Parcel 157 to be 1,273 sq. ft. and the converted garage to be 1,349 sq.ft., and the single-family residence on Parcel 158 to be 533 sq. ft. Currently, there are three apartment units on Parcel 157; two units in the main building and one unit in the converted garage. The applicant does not reside on the property. Parcel 157 is located in an HB Highway Business Zoning District which only permits offices and banks. According to the Building Division, a two-family residence is permitted on this lot but three residential units are not allowed (see attached copy of July 15, 1997 letter). According to the petitioner's application, this use has existed on the property for over 27 years. At the request of the Building Division, the applicant is now applying for zoning relief to allow three residential units on Parcel 157. Specifically, the applicant is applying for a Special Permit pursuant to Section 3-3.6(3)(A)-Conditional Uses. Any use permitted in B Districts not permitted in Section 3-3.6(1) is allowed in HB Districts as a conditional use with approval of a Special Permit by the Zoning Board of Appeals. Multi-family dwellings(apartments)are permitted in B Districts subject to the provisions of Section 3-2.1(1)(J)(a)through (h). Zoning History: Parcel 157 was originally zoned B Business when zoning was first established in this area of town in 1953 (ATM 3/3/53,Art. 91). At that time, multi-family dwellings were a permitted use. In 1983,this area was rezoned to a Highway Business District. Uses permitted in the B District were allowed in HB Districts only by Special Permit from the Zoning Board of Appeals. A zoning amendment passed May 7, 1988, made offices and banks the only Principal Permitted Uses in the HB Highway Business Zoning District. A review of ZBA records indicates that no Special Permit or Variance was ever approved to allow multi- family dwellings on the property. The current use of Parcel 157 is, therefore, non-conforming. Procedural Summary: This appeal was filed at the Town Clerk's Office and at the Office of the Zoning Board of Appeals on April 28, 1998. A public hearing before the Zoning Board of Appeals was duly advertised and notices sent to all abutters in accordance with MGL Chapter 40A. The hearing was opened June 17, 1998, at which time the Board found that: 1. Parcel 157,zoning relief is not required. It is a pre-existing non-conforming use of the property. 2. Parcel 158 is a single family use in a single family district. The applicant requested and the Board granted a Withdrawal Without Prejudice. Hearing Summary: Board Members hearing this appeal were Gene Burman, Ron Jansson, Richard Boy, Gail Nightingale, and Chairman Emmett Glynn. Attorney Douglas Murphy represented the applicant, James Shea,who was present. Attorney Murphy submitted a memorandum to the file. Mr. Murphy explained that he was hoping it would not be necessary to go forward with this appeal. The application was filed by Mr. Shea without the benefit of counsel. Mr. Shea owns property on West Main Street and Woodland Avenue and both locations are included on the application. However, the Woodland Avenue property should not have been included. Attorney Murphy discussed the property located at 350 West Main Street which is surrounded by commercial uses. He explained that in 1970, he was a broker and (ironically)he sold this property to Mr. Shea. Consequently, Mr. Murphy has firsthand knowledge of the layout of the home and confirmed there were three dwelling units at that time and in the same configuration as they are now. The use has been on-going. The Board and Attorney Murphy discussed the relief requested,which is a Special Permit. Attorney Murphy is of the opinion that no relief is necessary based on the facts presented. He stated the use is a legal pre-existing, non-conforming use. Gloria Urenas reported the Building Commissioner told her that he"does not concur"with Mr. Murphy but has no problem if"the Board concurs with Mr. Murphy". The Building Commissioner is relying on a 1971 field card that lists the house as a single family dwelling. The premises have existed since at least 1971 as two buildings-three dwellings. The buildings are located in a HB Highway Business District and are a lawful pre-existing non-conforming use. Submitted to the file was a listing sheet from 07/29/71 which delineates the property at that time. Also submitted were Barnstable Water Co. receipts from 1971 listing three separate units;Apt.#1 Rear;Apt.,#2 Front; and Garage Apt. Mr. Shea addressed the Board. He reported the property now is the same as it was when he bought it in 1971. All three units have been continuously rented to year round tenants. Public Comments: No one spoke in favor or in opposition to this appeal. Findings of Fact: At the Hearing of June 17, 1998, the Board unanimously found the following findings of fact as related to Appeal No. 1998-81, Parcel 157: 1. The property in issue is owned by James Shea, who purchased the property in the later part of 1971. It is located at 350 West Main Street, Hyannis, as shown on Assessor's Map 269, Parcel 157. The property is currently in the HB Highway Business District. 2. By way of background, I represent James M. Shea who is the owner of the above property shown on Barnstable Assessor' s Map 269 as Parcels 157 and 158 . I have personal knowledge of the status and state of the premises in 1971 when Mr. Shea purchased them from Theodore M. Taylor, Jr. and his wife, Miriam G. Taylor, as I was, the real estate broker who, over an extended period of time, assisted in negotiating the sale. When I listed the property in July of 1971, I made a personal inspection of the entire property and also the Assessor' s records . According to my files compiled at the time, the 1970 Assessor's records disclosed that the property at 350 West Main Street (consisting of . 25 acres, more or less) had two structures assessed thereon: a dwelling at $4, 150 . 00 and a dwelling/garage at $3 , 200 . 00 which together with a land value of $1, 500 . 00 resulted in an assessment of $8, 850 . 00 . The premises at 24 Woodland Avenue (directly to the rear of the 350 West Main Street property) (consisting of .42 acres, more or less) was assessed for two dwellings at $1, 850 . 00 and $950 . 00, respectively which together with the land assessment of $900 . 00 created a total assessment for this parcel of $3 , 700 . 00 . Ralph Crossen, Building Commissioner June 16, 1998 Page 2 My business records also indicate that the Woodland Avenue property was the subject of Water Accounts No. 4947, No. 4947A and that the 350 West Main Street property was the subject of a Water Account No. 3034, No. 3034A and No. 3034B. The rear unit of the main house at 350 West Main was I believe occupied by Mr. Taylor and the garage/apartment by his mother-in-law. Copies of the statements received from the Barnstable Water Company indicating these account numbers are enclosed herewith. My research has also indicated that the Taylors' acquired the 350 West Main Street property by Deed dated December 31, 1964 and recorded in the Barnstable County Registry of Deeds in Book 1285, Page 534 and that they subsequently acquired the property at 24 Woodland Avenue from Carl 0. Liimatainen under date of February 28, 1967 . My recollection of the circumstances of the premises were that the lot commonly known as 350 West Main Street (the rear unit of which was identified as 20 Woodland Road) contained one building right on West Main Street containing two separate living units and to the rear of the primary building was a detached, free-standing garage apartment . I believe that the garage apartment was occupied by Mr. Taylor' s mother-in-law until January or February of 1972 but of this I am not certain. The lot directly behind that which fronted on West Main Street contained two buildings . The first was a two-story, bungalow-style house (a single-family dwelling) . Adjacent but detached from that and on the same lot was a converted garage apartment . My research at the time of taking the listing and effecting the sale disclosed that premises adjacent to West Main Street were the subject of a 200' deep business "B" zone at all times pertinent to Mr. Shea' s acquisition. At the time of his acquisition in 1971, apartments were permitted as a matter of right, subject to certain numerical limitations applicable to apartments, henceforth constructed, under Section M of the By-law. I have taken a drive by the premises prior to preparing the enclosed Affidavit and by my recollection, the structures presently in existence on the two lots in question are structures that existed in the configuration they existed at the time Mr. Shea acquired the property in 1971 when it was zoned Business . The exception to the physical layout is that the garage apartment that existed on the Woodland Avenue lot in 1971 is no longer there . In discussion with Mr. Shea, I understand that there was a fire which Ralph Crossen, Building Commissioner June 16, 1998 Page 3 virtually destroyed this unit and it was removed and never replaced. I hope that the foregoing, together with the enclosed Affidavit will be sufficient to enable your Department (and in particular, Mr. Gillis and Ms. Uranus) to conclude that the current multiple dwelling use at 350 West Main Street which, at the time Mr. Shea acquired it, was located in a "B" Business Zone and which is now located in an "UB" Urban Business zone, constitutes a lawful, pre-existing, non-conforming use which does not require any zoning relief in order to continue . Likewise, I would understand that the premises at 24 Woodland Avenue, now constituting a single-family dwelling in a residence district, does not require any zoning relief . It appears to me that no zoning relief should be mandated nor should the property owner be required to proceed through a Zoning Board of Appeals process in order to maintain the current state of uses and structures on the premises . Although I do not know the present residence of Mr. and Mrs . Taylor, and cannot verify this, I do believe the configuration the premises were in when Mr. Shea purchased them in 1971 had existed for several years prior to that . If you concur in the foregoing analysis and in particular the conclusion as to the righteousness of continuing the current structures, use and occupation of the premises, would you please advise me so that I may withdraw Mr. Shea' s presently pending Petition for a Special Permit which is scheduled for hearing with the Zoning Board of Appeals at 7 : 15 p.m. June 17, 1998 . Staff Review: Although multi-family dwellings(apartments)are allowed in B Districts, they are subject to the provisions of Section 3-2.1(1)(J)(a)through (h) of the Zoning Ordinance(a copy of which is attached). As it exists now, the subject property does not conform to subsections a), b), e)and 0. However, prior to 1982, the provisions governing apartment dwellings were different than the current provisions. The Board will recall a similar case (Appeal Nos. 1997-101 & 102)that dealt with this issue. In that case it was decided that prior to 1982, the requirements governing apartment dwellings did not apply to buildings that already existed but only to apartment buildings"hereafter built". Please see the attached Decision and Notice for Appeal No: 1997-101 and memorandum from the Legal Department dated October 21, 1997. In order to determine which requirements apply to the subject property, it must be determined when the current use of the property was first established. The present use of Parcel 157 may be a legal pre-existing nonconforming use, but the applicant has decided not to pursue this avenue and instead has decided to apply for a Special Permit pursuant to Section 3- 3.6(3)(A). Staff suggests the applicant submit evidence(affidavits)that the present use of the property has existed for as long as the applicant purports(over 27 years). The Board may find that the present use is pre- existing nonconforming and that no zoning relief is required. If the Board does find to grant the requested relief, staff suggests it apply only to Parcel 157. The property is located an area with a mix of different uses, including single-family residential, multi-family residential, commercial and office. Several apartment complexes are located along this portion of West Main Street. The lots immediately adjacent to the east, west and south have commercial buildings on them. Single-family residences are located to the north. Considering the number of multi-family dwellings located in this area of town, the applicant's proposal would not be out of character with the surrounding land uses. Special Permit Findings: Section 3-3.6(3)-Conditional Uses in HB Highway Business Zoning Districts, provides that any use permitted in the B Business Zoning District may be permitted as a Conditional Use subject to the following: a) Such uses do not substantially adversely affect the public health, safety,welfare, comfort or convenience of the community. The standards for granting a special permit also require the following findings of fact to be made by the Board (Section 5-3.3(2)): • that the application falls within a category specifically excepted in the ordinance for a grant of a Special Permit, (multi-family dwellings(apartments)in a Highway Business Zoning District are a Conditional Use allowed by a Special Permit Pursuant to Section 3-3.6(3)(A) of the Zoning Ordinance), • that a site plan has been reviewed and found approvable in accordance with Section 4-7 (detached single-family and two-family dwellings are exempt from this provision)and, • that after evaluation of all the evidence presented, the proposal fulfills the spirit and intent of the zoning ordinance and would not represent a substantial detriment to the public good or the neighborhood affected. By way of background, I represent James M. Shea who is the owner of the above property shown on Barnstable Assessor' s Map 269 as Parcels 157 and 158 . I have personal knowledge of the status and state of the premises in 1971 when Mr. Shea purchased them from Theodore M. Taylor, Jr. and his wife, Miriam G. Taylor, as I was the real estate broker who, over an extended period of time, assisted in negotiating the sale . When I listed the property in July of 1971, I made a personal inspection of the entire property and also the Assessor' s records. According to my files compiled at the time, the 1970 Assessor' s records disclosed that the property at 350 West Main Street (consisting of . 25 acres, more or less) had two structures assessed thereon: a dwelling at $4 , 150 . 00 and a dwelling/garage at $3 , 200 . 00 which together with a land value of $1, 500 . 00 resulted in an assessment of $8, 850 . 00 . The premises at 24 Woodland Avenue (directly to the rear of the 350 West Main Street property) (consisting of .42 acres, more or less) was assessed for two dwellings at $1, 850 . 00 and $950 . 00, respectively which together with the land assessment of $900 . 00 created a total assessment for this parcel of $3 , 700 . 00 . Ralph Crossen, Building Commissioner June 16, 1998 Page 2 My business records also indicate that the Woodland Avenue property was the subject of Water Accounts No. 4947, No. 4947A and that the 350 West Main Street property was the subject of a Water Account No. 3034, No. 3034A and No. 3034B. The rear unit of the main house at 350 West Main was I believe occupied by Mr. Taylor and the garage/apartment by his mother-in-law. Copies of the statements received from the Barnstable Water Company indicating these account numbers are enclosed herewith. My research has also indicated that the Taylors' acquired the 350 West Main Street property by Deed dated December 31, 1964 and recorded in the Barnstable County Registry of Deeds in Book 1285, Page 534 and that they subsequently acquired the property at 24 Woodland Avenue from Carl 0. Liimatainen under date of February 28, 1967 . My recollection of the circumstances of the premises were that the lot commonly known as 350 West Main Street (the rear unit of which was identified as 20 Woodland Road) contained one building right on West Main Street containing two separate living units and to the rear of the primary building was a detached, free-standing garage apartment . I believe that the garage apartment was occupied by Mr. Taylor' s mother-in-law until January or February of 1972 but of this I am not certain. The lot directly behind that which fronted on West Main Street contained two buildings . The first was a two-story, bungalow-style house (a single-family dwelling) . Adjacent but detached from that and on the same lot was a converted garage apartment . My research at the time of taking the listing and effecting the sale disclosed that premises adjacent to West Main Street were the subject of a 200' deep business "B" zone at all times pertinent to Mr. Shea' s acquisition. At the time of his acquisition in 1971, apartments were permitted as a matter of right, subject to certain numerical limitations applicable to apartments, henceforth constructed, under Section M of the By-law. I have taken a drive by the premises prior to preparing the enclosed Affidavit and by my recollection, the structures presently in existence on the two lots in question are structures that existed in the configuration they existed at the time Mr. Shea acquired the property in 1971 when it was zoned Business . The exception to the physical layout is that the garage apartment that existed on the Woodland Avenue lot in 1971 is no longer there. The rear unit of the main house at 350 West Main was I believe occupied by Mr. Taylor and the garage/apartment by his mother-in-law. Copies of the statements received from the Barnstable Water Company indicating these account numbers are enclosed herewith. My research has also indicated that the Taylors' acquired the 350 West Main Street property by Deed dated December 31, 1964 and recorded in the Barnstable County Registry of Deeds in Book 1285, Page 534 and that they subsequently acquired the property at 24 Woodland Avenue from Carl O. Liimatainen under date of February 28, 1967. My recollection of the circumstances of the premises were that the. lot commonly known :as 350 West Main Street (the rear unit of which was identified as 20 Woodland Road) contained one building right on West Main Street containing two separate living units and to the rear of the primary building was a detached, free-standing garage apartment. I believe that the garage apartment was occupied by Mr. Taylor's mother-in-law until January or February of 1972 but of this I am not certain. The lot directly behind that which fronted on West Main Street contained two buildings. The first was a two-story, bungalow-style house (a single-family dwelling) . Adjacent but detached from that and on the same lot was a converted garage apartment. My research at the time of taking the listing and effecting the sale disclosed that premises adjacent to West Main Street were the subject of a 200' deep business "B" zone at all times pertinent to Mr. Shea's acquisitions. At the time of his acquisition in 1971, apartments were permitted as a matter of right, subject to certain numerical limitations applicable to apartments, henceforth constructed, under Section M of the By-law. I have taken a drive by the premises prior to preparing the enclosed Affidavit and by my recollection, the structures presently in existence on the two lots in question are structures that existed in the configuration they existed at the time Mr. Shea acquired the property in 1971 when it was zoned Business. The exception to the physical layout is that the garage apartment that existed on the Woodland Avenue lot in 1971 is no longer there. By way of background, I represent ,Tames M. Shea who is the owner of the above property shown on Barnstable Assessor' s Map 269 as Parcels 157 and 158 . I have personal knowledge of the status and state of the premises in 1971 when Mr. Shea purchased them from Theodore M. Taylor, Jr. and his wife, Miriam G. Taylor, as I was the real estate broker who, over an extended period of time, assisted in negotiating the sale. When I listed the property in July of 1971, I made a personal inspection of the entire property and also the Assessor's records . According to my files compiled at the time, the 1970 assessor' s records disclosed that the property at 350 West Main Street (consisting of .25 acres, more or less) had two structures assessed thereon: a dwelling at $4 , 150. 00 and a dwelling/garage at $3,200 . 00 which together with a land value of $1, 500. 00 resulted in an assessment of $8,850 .00 . The premises at 24 Woodland Avenue (directly to the rear of the :350 West Main Street: propexty) (consisting of 42 acres, more or, liess) was assessed for two dwellings at $1, 850.00 and $950 . 00, respectively which together with the land assessment of $900 . 00 created a total assessment for this Parcel of g31700 .0Q , i JUH-17-1998 a9:01 FROM MURPHY & MURPHY TO 79OS230 P.03 Ralph Crossen, Building Commissioner June 16, 1998 Page 2 My business records also indicate that the Woodland Avenue property was the subject of Water Accounts No. 494", No. 4947A and that the 350 West Main Street property was the subject of a Water Account No. 3034, No. 3034A and No. 30342. The rear unit of the main house at 350 West Main was I believe occupied by Mr. Taylor and the garage/apartment by his mother-in-law. Copies of the statements received trom the Barnstable Water Company indicating these account numbers are enclosed herewith. My research has also indicated that the Taylors' acquired the 350 West Main Street property by Deed dated December 31, 1964 and recorded in the Barnstable County Registry of Deeds in Book 1285, Page 534 and that they subsequently acquired the property at 24 Woodland Avenue from Carl C. Liimatainen under date of February 28, 1967, My recollection of the circumstances of the premises were that the . lot commonly known as 350 West Main Street (the rear unit of which was identified as 20 Woodland Road) contained one building right on West Main Street containing two separate living units and to the rear of the primary building was a detached, free-standing garage apartment. I believe that the garage apartment was occupied by Mr, Taylor' s mother-in-law until January or February of 1972 but of this I am not certain. The lot directly behind that which fronted on West Main Street contained two buildings. The first was a two-story, bungalow-style house (a single-family dwelling) . Adjacent but detached from that and on the same lot was a converted garage apartment. My research at the time of taking the listing and effecting the sale disclosed that premises adjacent to West Main Street were the subject of a 200, deep business . ,B,, zone at all times pertinent to Mr. Shea's acquisition. At the time of his acquisition in 1971, apartments were permitted as a matter of right, subject to certain numerical limitations applicable to apartments, henceforth constructed, under Section M of the By-law. T'- I have taken a drive by the premises prior to preparing the enclosed Affidavit and by my recollection, the structures presently in existence on the two lots in question are structures that. existed in the configuration they existed at the time Mr. Shea acquired the property in 1971 when it was zoned Business. I hope that the foregoing, together with the enclosed Affidavit will be sufficient to enable your Department (and in particular, Mr. Gillis and Me . Uranus) to conclude that the current multiple dwelling use at 350 West_ Main Street which, at the time Mr. Shea acquired it, was located in a "B" Business Zone and which is now located in an "US" Urban Business zone, constitutes a lawful, pre-existing, non-conforming use which does not require any zoning relief in order to continue. Likewise, I would understand that the premises at. 24 woodland Avenue, now constituting a single-family dwelling in a residence district, does not require any zoning relief. It appears to me that no zoning relief should be mandated nor should the property owner be required to proceed through a Zoning Board of Appeals process in order to maintain the current state of uses and structures on the premises . Although I do not know the present residence of Mr. and Mrs. Taylor, and cannot verify this, I do believe the configuration the premises were in when Mr. Shea purchased them in 1971 had existed for several years prior to that. If you concur in the foregoing analysis and in particular the conclusion as to the righteousness of continuing the current structures, use and occupation of the premises, would you please advise me so that I may withdraw Mr. Shea' s presently pending Petition for a Special Permit which is scheduled for hearing with the Zoning Board of Appeals at 7 : 15 p.m_ June 17, 1998 .
