I am going to have Kim repost the agenda on Monday with the Shellfish ra ng maps removed from the agenda, un l a
public hearing can be held and a representa ve from MEA can come in and answer ques ons on who to part in the
ra ng, what does the ra ng sheet look like ……etc. The Commission held a public hearing in 2011, but did not in 2017
when reviewing the Popponese maps. I already called Amy and they will pull informa on together and be happy to
a end at a future public hearing.

Tom –
I notice that the adoption of new shellfish maps for the 3 Bays area is an agenda item for the
Commission’s 3/7/23 meeting.
I’m sure at the moment I am the last person you would like to take advice from, but I think you need to
hold a public hearing on the maps before the Commission can adopt them.
If you look at Ch 237-8(A) of the Town Wetlands Protection Ordinance, it says that the Commission may “…
promulgate performance standards, design specifications, policy guidelines and other rules and
regulations…” only after “…public notice and public hearing…”. I believe the shellfish maps, which are relied
upon under your Pier Regulations fall either into the “policy guidelines” or “other” category. I know that a
public hearing was held before the 2011 maps were adopted.
Having been chairman of the Commission years ago, I know public hearings can be time consuming and
problematic. But it probably is best, considering the way the Commission relies on the maps, to spend the
time to adopt them properly.
Don’t hesitate to call if you want to discuss the process.
I would request that Darcy distribute this email to the rest of the Commissioners.
