Subject: Appeal No. 2023‐005
Please forward to members of the Zoning Board of Appeals. Thank you.
Dear ZBA Members,
The setback relief/modification permit sought by TJA "Clean Energy" (for its solar
project at 810 Wakeby abutting and above Wellhead/Watershed Protection
Conservation Restriction Land, 830 Wakeby Rd.,) of the required 100’ reduced to 16’
should not be granted. In order to to protect precious public water resources.
The extreme contamination of major wells in Barnstable and throughout the Cape and
the expensive/desperate measures to mitigate contamination, require remaining water
resources be protected to the utmost of our ability.
New solar bylaws were written specifically with Tja’s industrial scale solar project in
mind, to protect the public and remaining water supplies. The 100’ setbacks were not
randomly applied, they were very conscientiously applied. As a 'best possible' effort
measure, considering TJA is suing the town.
Granting setback relief for a project consisting of large quantities of highly toxic
chemicals will greatly endanger those resources. They are currently serving an est.
30,000 people.
The size of the solar project dictates the profitability, of course, so when Tja council
refers to the “usefulness”, please read “profitability”.
Eversource will purchase this 15,000 panel array at 810 Wakeby, and will spray
glyphosate over the entire 21 acres. Every year.
One drop of glyphosate diluted by water to fill 2 Olympic sized pools causes cancer
cells to grown en vitro. Glyphosate stays in the ecosystem for 22 years. Underlying
wells, our homes, children will be covered in glyphosate. Every year.
Remember Bayer’s $10 Billion settlement for cancer victims due to RoundUp, active
ingredient~ glyphosate.
There are no laws to prevent glyphosate use on privately owned property.

7. and land uses that result in the rendering impervious of more than 15% or 2500
square feet of any lot or parcel, whichever is greater, unless a system for artificial
recharge of precipitation is provided that will not result in the degradation of
groundwater quality.
15,000 solar panels will require cement bases, covering the majority of arable soil.
“According to cancer biologist David H. Nguyen, PhD, toxic chemicals in solar panels
include cadmium telluride, copper indium selenide, cadmium gallium (di)selenide,
copper indium gallium (di)selenide, hexafluoroethane, lead, and polyvinyl fluoride.
Silicon tetrachloride, a byproduct of producing crystalline silicon, is also highly
toxic.”
“Ray Weiss, a professor of Geochemistry at the Scripps Institution of
Oceanography, explains that a number of solar panels release nitrogen trifluoride
(NF3), a chemical compound 17,000 times worse for the atmosphere than carbon
dioxide. As recently as 2015, he explained that many manufacturers were still
struggling to figure out how to contain its release into the atmosphere”
Solar Panels Produce Tons of
Toxic Waste—Literally

The following links to articles describing a Morris, IL warehouse fire consisting of
stored solar panels and lithiumion batteries. Some of the highlights important to know
are:
Chemical foams were used unsuccessfully to quench the fire. Twenty eight tons of
cement did put out the fire after four days of hoping it would burn itself out. More than
four thousand people were evacuated. Toxic smoke and soot covered all evacuated
areas. First responders had NO idea of how to deal with the fire. Water exacerbates
these types of fires.
I doubt the Morris, IL warehouse was as large as 21 acres.
New bylaws prohibit storage batteries for industrial projects in all zones in the town of
Barnstable. But there are at least twelve batteries and transmitters scattered
throughout the Tja project plan...150’ from our homes.
Please review the following links to understand the how easily toxic substances can
leach into the groundwater at 810 Wakeby Rd. and abutting 830 Wakeby. State laws
do not yet take all the possibilities into consideration, at least MGL Ch 40A, S3 allows
for potential protection. We must take every measure to limit the damage.

If you’d like to see what threatens water wells in Wareham, Carver and Plymouth this
site has extensive information:

can’t rely on any nearby water resources.
The seventeen families that abut 810 Wakeby urge you not to grant relief from 100’
setbacks.
Thank you for your attention.
