Governor Secretary Commissioner Director March 9, 2023 Barnstable Conservation Commission 200 Main St Hyannis MA 02601 Dear Commissioners: The Division of Marine Fisheries (MA DMF) has reviewed the Notice of Intent (NOI) by Raymond Brooks to add a ~40’ aluminum pier extension to an existing seasonal aluminum pier at 82 Tern Lane within Lake Wequaquet in the Town of Barnstable. The project was reviewed with respect to potential impacts to marine fisheries resources and habitat. Lake Wequaquet has been identified by MA DMF as diadromous fish passage, migration, and/or spawning habitat for alewife (Alosa pseudoharengus), blueback herring (Alosa aestivalis), and American eel (Anguilla rostrata). MA DMF offers the following comments for your consideration: • A time-of-year (TOY) restriction should be observed on all in-water work to protect sensitive life stages of the above listed diadromous species. No in-water work should take place from April 1st – June 15th of any year to protect spawning habitat [1].
