including replacing concrete in spalled areas, sealing cracks, and replacing missing curbs.

b. Identify provisions of the Wetlands Protection Act or regulations which may exempt the applicant
from having to file a Notice of Intent for all or part of the described work (use additional paper, if
necessary).
310 CMR 10.53(3) specifically authorizes the issuing authority to approve limited projects, including
maintenance of boat ramps. Several factors are listed for consideration: magnitude of the alteration;
removal, fill, dredging or altering of land bordering waters; availability of reasonable alternatives to the
proposed activity; extent to which adverse impacts are minimized; and the extent to which mitigation
measures are provided. Since the boat ramp repair project will not alter the existing site, nor involve
any fill or dredging, and there are no reasonable alternatives to the repair project, we request the
Conservation Commission’s finding that this boat ramp repair project does not require an NOI.
