Dear Members of the Planning Board,
Setbacks protect human lives and public water.
Atlantic Designs' plans for TJA's solar plant at 810 Wakeby reveal a fatal flaw, when at last available to the public for the ZBA hearing on March 8.
The plans show 30’ and 16’ setbacks at the sole egress of 810 Wakeby Rd. that is only 94.77’ wide, where 150' and 100’ setbacks should be according to
bylaws. A home on one side and town owned wellhead protected land on the other side of the sole egress. (The wells currently supply 30,000 people in
Barnstable.)
Solar ordinance requires setbacks of 150’ and 100’, clearly impossible to achieve within 95’.
As you know, TJA sued the town to rewrite the solar ordinances to better accommodate and enable its project. Six months of revision by the Legal and
Planning Depts., approved by the Planning Board was not enough for Tja. They want more concessions that take away the slim protections the bylaws offer
the public now.
The wings of one bird short circuited two cables at a solar plant in CA, igniting a fire that burned 1,127 acres before it could be extinguished. “Happens all the
time” says Fire Chief.
The abutters to 810 Wakeby fervently hope the ZBA keep the 150’ and 100’ setbacks as written in our bylaws.

The town of Bridgewater, after 5 years enduring lawsuits filed by Tja, won their liberty based on Planning Board’s observations that the berm/screening
misrepresented on plans would in fact, when implemented in reality, encroach upon a wetland. TJA was caught in their deliberate attempt to deceive
Bridgewater's Planning Board.
Case dismissed as the result:
TJA’s request for setback modification by ZBA was continued to April 12. Their decision may eliminate the need for the Planning Board to meet on the
matter of a special permit for TJA.
