l.. The variance requested is from the Regulation No. 10 adopted
February 21, 1975 , requiring that grease traps be provided at
all bakeries. The applicant proposes to build a convenience
store with a bakery/deli counter . However , the applicant will
primarily. be selling bakery products rather than manufacturing
bakery products on the location. The applicant purchases
bakery products which have *been manufactured and frozen at
another location. The only baking activity which will be
conducted on the property is the thawing and final baking, of
the goods. Bakery goods will be sold only on a take-out basis
and there will be no in-store consumption of bakery products
or other food products. There will be no washable utensils
used by customers as any customer needing a utensil will be
given a plastic utensil to be taken from the premises.
2. The applicant proposes to install an under-the-sink
grease trap to be maintained by the applicant on a
regular basis. The applicant has a similar convenience
store with -bakery/deli counter operating in the Town of
Sandwich, and experience shows that this type of an
operation uses only 138 gallons of water per day. For
these reasons, the applicant requests that the Board of
Health grant the variance from Regulation No. 10
requiring a grease trap be installed between the store
location and the on-site septic system being provided by
the developer .

Dear Mr. Wallace:
Your request for a variance from the Board of Health Regulation #10, at the proposed
Wallace Food Mart to be located at 214-232 lyanough Road, Hyannis, is not granted.
You proposed to bake foods and prepare sandwiches at this store. You stated that a similar
convenience bakery/deli store operating in the Town of Sandwich uses an average of 138
gallons of water each day. This exceeds the flow calculated and approved for the existing
onsite sewage disposal system connected to the building. Also, a proposed food service
operation conflicts with the use approved for this building.
Please be advised that this building can only be utilized for retail (dry goods) stores and
as a one 25 seat restaurant, according to the letter addressed to Paul Lorrusso dated May
30, 1990. Unit #1 was apparently set aside for a restaurant.
Therefore, your proposal to operate a bakery/deli convenience store in this building cannot
be approved, and your request for a variance from Regulation #10 cannot be granted.

You are granted permission to construct an addition to the building at 1214 - 1232 lyanough
Road, Route 132, Hyannis, Ma., with the following conditions:
(1) The addition shall be constructed in strict accordance to the site plan dated February
16, 1990 designed by Stephen Allyn Wilson, Professional Engineer.
(2) The building can only be utilized for retail (dry goods) stores and as a one 25 seat
restaurant. The following uses are not authorized: (1) any offices, (2) manufacturing,
(3) dentist offices, (4) gymnasiums, (5) fitness centers, (6) any other use other than
retail (dry goods) stores and one restaurant of 25 seats.
(3) You shall receive the approval of the Zoning Enforcement Officer and/or the Zoning
Board of Appeals. The proposed addition to the structure may violate the zoning
in the area. Pursuant to G.L.C. 40A, S.7, "... No permit or license shall be granted
for a new use, building, structure or land which use would be in violation of any zoning
ordinance or bylaw".
This conditional approval is granted because the designing engineer demonstrated that
the total daily flow from the building will be less than the previous total daily flow.

The Cape Cod Commission (CCC) has received an ENF for the Liberty Square Expansion project
in Hyannis, Massachusetts. The ENF was noticed in the Environmental Monitor on February 6,
1991.

It is my understanding that this project required the filing of an ENF for two reasons: (1) the
expansion requires a new MDPW curb cut permit due to the likely increase in traffic,and (2) the
project includes the leasing of State-owned right-of-way to the applicant. As Executive Director of .
the Commission, I recommend additional review and analysis of this project to address the traffic
impact issues and to modify the proposed lease area. The transportation staff offers the following
comments:
The expansion of this site is expected to generate an additiona11,400 vehicle trips per day.
Primary access to the site is via a driveway at the Route 132Bearses Way intersection along with a
secondary access onto Old Route 132. Currently,the Route 132Bearses Way intersection
operates at a very poor level-of-service on a year-round basis due to the existing heavy traffic flow
on both roadways. ..
The transportation staff has analyzed this intersection as part of its MDPW sponsored study of
Routes 28 w d 132 in Barnstable. The most significant intersection delays are on the eastbound
Route 132 approach,where the roadway narrows to only a single lane. Problems at this
intersection are exacerbated by vehicles waiting to turn left into the driveway that serves the Liberty
Square site.
Conceptual improvements,needed immediately, include four 12-foot through lanes and opposing
left turn lanes at the Route 132Bearses Way intersection. Long term improvements also include
the separation of the travel lanes on Route 132 by a center median. From information submitted by
the applicant and conceptual drawings from the Town,it appears that the proposed lease area may
extend within the area of proposed widening. This encroachment may require an undesirable
realignment of the Route 132 improvements or even preclude the necessary improvements
altogether. Therefore,we recommend the proponent modify the proposed lease area to extend no
further than the existing edge of the parking area. Prior to granting the lease,the proponent should
present a conceptual plan that shows the leased area with parking,the edge of the existing roadway
pavemerit and the proposed improvements in sufficient detail to ensure the proposed improvements

can be implemented.
Prior to the issuance of the MDPW curb cut permit, steps must be taken to ensure that left turns
into the site from Route 132 will not occur until the intersection improvements are complete. The
first steps should include the replacement of the left-turn arrow painted on the pavement with a
through arrow and the installation of"no-left turn" signs. The applicant should commit to
additional actions, as necessary, should illegal left-turns occur. These additional actions may
include making the Route 132 driveway an exit only with entrance via Old Route 132.
Furthermore,we agree the applicant should be responsible for a full engineering design of the
needed improvements between the end of the Town portion of Route 132 to the Phinney's Lane
intersection.
In summary,there are issues to be resolved prior to the granting of the lease and the issuance of the
MDPW curb cut permit. Due to the complexity of this project,we strongly recommend a site visit
and meeting between the Town of Barnstable,the MDPW, MEPA and the Cape Cod Commission.

On January 10, 1990, a permit was issued for "remodeling" at the above referenced site.
The Health Department granted permission contingent upon the understanding there would
be no construction of any additional area to the existing building(s).
However, today I observed construction of walls which are approximately 20 to 30 feet
outside of the original footprint of the original building Cn the north and east sides of
the building) Also, the Board of Health: members did not approve any additions to the
building.
Please issue a cease and desist order for the construction of the addition until after such
time the applicant receives the approval of the Board of Health.
