Dear Mrs. Megargee:
Thank you for appearing at the Board of Health meeting held on November 1,1994.
You testified that the occupants of 39A Louis Street, Hyannis, will vacate your dwelling
on or before November 7, 1994. You also provided documentation that the thermostat
was repaired.
You are directed to rectify the remaining violations of 410.500 and 410.501 .prior to
occupancy of the unit. The unit shall not be occupied until after you receive written
certification from the Health Division that the violations contained in the order letter to
you dated September 21, 1994 were corrected.
You were also ordered by the Board of Health to ensure that the basement is not used for
habitation. This means that it cannot be used as an office, recreation room, bedroom, den
or any similar use which would allow occupants to utilize the basement for habitation
purposes because of the following conditions:
(1) There is no second means of egress provided.
(2) No operational smoke detector.

(3) The floor-to-ceiling height in the basement area is more than 50%below
grade and is subject to chronic dampness.
Finally, please ensure that the unit is not rented to a greater number of occupants than
what is allowed by 105 CMR 410.400, of the State Sanitary Code. Attached is a copy of
this provision.

NOTICE TO ABATE VIOLATIONS OF 105 CNR 410.00, STATE SANITARY
CODE II, MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
The property owned by you located at 39 Louis Street,
Hyannis, was inspected on August 22, 1994 by Edward Barry,
Health Inspector for the Town of Barnstable, because of a
complaint. The following violations of 105 CNR 410.00,
State Sanitary Code II, Minimum Standards of Fitness for
Human Habitation were observed:
410.501A1:The top portion of the bottom sash of the front
window has glazing missing.
410.500: The basement window sashes are rotted.
410.402: The two bedrooms in the basement are below grade
level and are subject to chronic dampness.
410.500: The floor of the stairs landing is spongy.
410.500: Mold on window sills observed in the living room
and in the bedroom. Mold on walls in bedroom.
410.253: The wall switch in living room malfunctions. Wall
thermostat inoperative. Light fixture in ceiling
of bathroom is not firmly mounted and it
malfunctions.
410.500: No door knob provided on the front door.
You are directed to correct these violations within fourteen
(14) days of receipt of this notice.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, these
violations must be corrected regardless of any request for
a hearing.
Please be" advised that failure to comply with an order could
result in .a fine of not more than $500. Each separate day's
failure to comply with an order shall constitute a separate
violation.

Re; Fire at 39 Louis Street, Hyannis, MA on October 15, 1994.
On October 15, 1994 at 9:09 p.m., the Hyannis Fire Department called me at home and
requested my presence at 39 Louis Street, Hyannis. A fire was extinguished in the cellar
which was being illegally used for sleeping purposes.
Both the main floor and cellar were filthy, and there was garbage and debris on the floors.
Two of the three smoke detectors in the house did not have batteries in them. It is the
responsibility of the tenant to provide batteries as stated under the Rental Ordinance
section 4-3.
Under the Massachusetts Housing Code, both cellar bedrooms were illegal as there was
only one means of egress.

NOTICE TO ABATE VIOLATIONS OF 105 CMR 410.00, STATE SANITARY
CODE II MINIMUM STANDARDS OF FITNESS FOR HUMAN HABITATION
The property owned by you located at 39 Louis Street,
Hyannis, was inspected on August 22, 1994 by Edward Barry,
Health Inspector for the Town of Barnstable, because of a
complaint. The following violations of 105 CMR 410.00,
State Sanitary Code II, Minimum Standards of Fitness for
Human Habitation were observed:
410.501A1:The top portion of the bottom sash of the front
window has glazing missing.
410.500: The basement window sashes are rotted.
410.402: The two bedrooms in the basement are below grade
level and are subject to chronic dampness.
410.500: The floor of the stairs landing is spongy.
410.500: Mold on window sills observed in the living room
and in the bedroom. Mold on walls in bedroom.
410.253: The wall switch in living room malfunctions. Wall
thermostat inoperative. Light fixture in ceiling
of bathroom is not firmly mounted and it
malfunctions.
410.500: No door knob provided on the front door.
You are directed to correct these violations within fourteen
(14) days of receipt of this notice.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, these
violations must be corrected regardless of any request for
a hearing.
Please be advised that failure to comply with an order could
result in .a fine of not more than $500. Each separate day' s
failure to comply with an order shall constitute a separate
violation.

Dear Mr. Grimmer:
I am in receipt of your letter dated October 6, 1994.
The Board of Health members are aware of several State Sanitary Code violations at 39
Louis Street, Hyannis. The Board is very concerned of the fact there are persons living
(sleeping) in a basement area which does/did not meet the following requirements:
(1) No operational smoke detectors in the basement area(batteries were
missing from the detector as observed by personnel from the Health
Department on August 22, 1994, October 15, 1994 and October 18, 1994).
(2) No second means of egress provided in the basement area.
(3) The floor to ceiling height in the basement area is more than 50%below
grade level and is subject to chronic dampness.
Therefore, it is the opinion of this Board that the tenant(s) shall be removed from the
basement immediately.
