The following variance was requested: Section 322-3 of the Town of Barnstable Code: To operate a food service establishment without a minimum 1,000 gallon capacity grease trap. Before the hearing before the Board of Health held on March 12, 2013, you submitted a three page menu, including a proposal to heat (or re-heat) and serve various types of foods including chicken pot pies, breakfast burritos, quiche, and stews. Back on March 12, 2012, you were granted a variance to serve coffee, store- bought muffins, cakes, bars, pies, pastries, and breads. You testified that there would be no cooking and/or food preparation onsite. The Board wrote to you, in the Board of Health decision letter dated March 25, 2012, condition number three (3) which specifically reads as follows: `cooking of any foods and or food preparation, is not authorized. Only coffee can be prepared. Store bought .muffins, pies, and breads may be re-heated in the microwaveoven onsite.' On or about July 3, 2012, a pre-operation inspection was conducted by Health Inspector Donna Miorandi, and this food establishment, Caf6 Crumb, was approved to open. However, during an inspection on January 2, 2013, it was discovered that there were additional food items offered for sale on the menu, including soup, beef Q:\WPFILES\CafeCrumbGrease TrapVarianceDenial20l3.doc i i i stew, angus beef burrito, chicken pot pie, and breakfast burritos. Also, additional heating or cooking equipment was observed within the food establishment, including a soup warmer. Your proposal to heat, cook, prepare and serve additional food items which may result in a discharge of grease into the onsite sewage disposal system, without providing a properly designed grease trap, cannot be approved. Variances may only be granted when, in the opinion of the Board of Health, the applicant has demonstrated that (a) enforcement of the particular provision would be manifestly unjust and (b) the same degree of protection could be achieved without strictly adherence to a particular provision or regulation. You did not demonstrate manifest injustice and you did not provide sufficient information relative to how you would provide the same degree of protection to the onsite sewage disposal system. Therefore your request for a variance is not granted. The owner wants to include in the back of the shop a small area to sell takeout coffee and pastries. Nothing will be cooked on site and there will be no seating. I was asking Tom if he looks at that as straight retail from a flow standpoint and he wasn't sure. He was questioning the need for additional flow for"takeout", but there is no Design Flow criteria defined in Title 5 for takeout only (especially when it's incidental to the main retail use).
