Dear Mr. Lee
I am Mary Pat Vogt. My permanent residence is 78 Bay Lane, Centerville. My property abuts 70 Bay Lane and includes a common driveway serving 4 residences.
I greatly appreciate the work and cooperation of the Wilburs, BSC Engineering, and the Conservation Department to develop an amenable solution to the recent drainage issue in preparation
of the Notice of Intent filing that will be done before the Commission on April 4.
As you know, a drainage problem was inadvertently created as a result of landscaping work done at 70 Bay Lane in September 2022. The problem seems to be the result of burying the end
of the outlet pipe from an existing catch basin that collects stormwater runoff from the common driveway. Previously, the outlet pipe flowed unrestricted to daylight. Since the pipe
end was buried, stormwater runoff overwhelms the catch basin, causing surface flooding on the common driveway.
The Wilburs have shared with me their engineering plans over the past few months, and have worked with me to address my concerns related to the long-term effectiveness of the proposed
solution. I am hopeful that the proposed drainage plan will remediate the drainage problem in the common driveway. We met and have agreed that the owners 70 Bay Lane and 78 Bay Lane
will each be responsible for and maintain its own drainage structures.
Simply to memorialize the details for both the current and future owners of both properties, I would like to request the following be included in the Order of Conditions:
The owners of 70 Bay Lane and 78 Bay Lane will each be responsible for maintenance and repairs of its own drainage components in perpetuity.
Following the completion of the proposed work and one year after, the Applicant shall confirm that the common driveway drainage issue has been completely remediated. If at any point
standing water is observed on the common driveway surface, the Applicant shall correct the problem.
The final Certificate of Compliance shall not be issued until one year has lapsed with no indication of the drainage issue persisting. If a Certificate of Compliance must be issued within
one year, I would request it be a partial Certificate of Compliance and that the above request for long-term confirmation of successful remediation be included as a condition to be satisfied
prior to issuance of a full Certificate of Compliance.
