The public water lines and all connections must meet specifications and/or rules and regulations of the local water department. • Each septic system shall be located within the prescribed boundaries of each individual lot. • The developer shall have recorded on the deed that variances from Title 5, minimum Requirements for the Subsurface Disposal of Sanitary Sewage, or the Town of Barnstable Health regulations whichever is more stringent, will not be granted on any lot in this subdivision. • A percolation test must be made on each lot at leaching site, before a Disposal Works Construction Permit will be issued. Maximum groundwater elevations must be determined by using data available from the united states geological Survey - Probable High Groundwater Levels on Cape Cod, Mass. Each proposed septic system must conform strictly to 310 CMR 15.00, the State Environmental Code, Title 5, and Town of Barnstable Rules and Regulations. • Any lawn area created must be covered by at least four(4) inches of loam. • `I tree stumps, brush and building debris removed when clearing lots or roads must be disposed of at a licensed solid waste disposal facility. Chipping brush and tree stumps is an acceptable alternative. Burial on site is prohibited. • The applicant must receive an Order of Conditions from the Conversation Commission, if applicable. • Prior to Board of Health approval of each building permit, the sewage system and water supply must conform to 310 CMR 15.00, the State Environmental Code, Title 5, or Town Health Regulations, whichever is more stringent. • This subdivision is located within a groundwater protection district. Therefore, all existing State codes and local health regulations regarding nitrogen loading limitations apply. Due to the size of the lots and the size of the open space in this subdivision, no more than three (3) bedrooms total are authorized at each lot. Barnstable Dear Mr. Speakman: You are granted variances from the State Environmental Code, Title V, and from local health regulations to construct an onsite sewage disposal system at 68 Lombard Avenue, West Barnstable, Massachusetts. The variances granted are as follows: 310 CMR 15.104: To utilize sieve analysis test results in lieu of the requirement to conduct percolation tests. Town of Barnstable Part XII, Section 2.00: To install an onsite private well 145 feet away from the future reserve area Town of Barnstable Part XH, Section 2.00: To install an onsite well on a lot of only 28,500 square feet in size. These variances are granted with the following conditions: 1. No more than three (3)bedrooms are authorized at the dwelling. Dens, study rooms, finished attics, sleeping lofts, and similar-type rooms are considered bedrooms according to the MA Department of Environmental Protection. The floor plans must be submitted to the Health Division office for review prior to obtaining a building permit. 2. Sieve analysis must be conducted to determine if the fill material meets the standards contained in Title V. speakman/wp/q r ti l 3. The designing registered sanitarian shall supervise construction of the onsite sewage disposal system and certify in writing to the Board of Health that the system was installed in strict accordance with the submitted revised plans dated June 16, 1998. Percolation tests could not be performed in the fine sand because it would have been a life threatening safety hazard to conduct these tests at such a depth, ten feet below ground.
