Mr. Parrella is interested in purchasing Lots 1 , 2, 16, 17, 18 and 19 in the above-entitled subdivision, and has placed the same under agreement. However, our problem is that the transaction is feasible from a financial standpoint only if there are six buildable lots. If this proves not to be the case, the Purchase and Sales Agreement provides that Mr. Parrella is not obligated to purchase the land. There is no town water available at this location. Accordingly, a determination as to the applicability of your 40,000 square foot regulation is necessary. It would appear that these lots are grandfathered under the 1974 regulations, and that the regulations are inapplicable. I would, however, very much appreciate a written opinion from the Board of Health on this matter. Mr. Parrella would be in an extremely difficult position if he were 'to complete this transaction, and later learn that the regulation is deemed applicable. I enclose herewith a copy of the subdivision plan for your use. I would be happy to meet with you should you require any further information. Please note that Ross Lane and East Osterville Road are not yet constructed and the lots appear still to be under Planning Board Covenant, even though the covenant has not been recorded. It appears that there may have been some misunderstanding here, and I would appreciate very much an opportunity to meet with yourself and Mr. Parrella to discuss this situation further. By way of background, I enclose herewith the following documentation, which I do not believe you have had the opportunity to review: 1 ) Board of Health letter to Mr. Trafton dated 10/23/73 2) Board of Water Commissioners letter to Mr. Trafton dated 8/17/76 3) Board of Health letter to me, dated 1 /22/85 4) A copy of the subdivision plan recorded in Barnstable Deeds, Plan Book 287, Page 27. Please note that the subdivision is located approximately 1 ,250 feet southerly of the Old Falmouth Road along the Lambert Mill Road. I note from the "Cape Cod Planning and Economic Development Commission - 1982 - Barnstable - Yarmouth - Water Table Contours and Public Water Supply Well Zones of Contribution" map that these lots appear not to be within the zone of contribution. It is my information and belief that the town water ma.in location (near the iintersection of Lambert Mill Road and Osterville - West Barnstable Road) is at present no closer to the subdivision than it was in August of 1976. It lis also my information that none of the people who have built .on Thatcher Holway Road have been required to bear the expense of town water main installation. Mr. Donald F.
