A= 226-149 Dear Mr. O'Dea, You are granted variances on behalf of your clients, Gregory and Julianne Pinto, to construct an onsite sewage disposal system at 63 Ocean Avenue, Centerville, Massachusetts. The following variances were granted: 310 CMR 15.211: To construct a soil absorption system five (5) feet away from the foundation, in lieu of the ten (10) feet minimum setback required. 310 CMR 15.221:. To provide sixty (60) inches of soil cover over top of the soil absorption system, in lieu of the maximum three feet of soil cover allowed. Section 360-1 of the Town of Barnstable Code: To construct a soil absorption system 50 feet away from a coastal bank, in lieu of the 100 feet minimum separation distance required. Section 360-1 of the Town of Barnstable Code: To install a septic tank 62 feet away from a coastal bank, in lieu of the 100 feet minimum separation distance required. These variances were granted because the physical constraints at the site severely restrict the location of the septic system due to its close proximity to wetlands and a coastal bank. Grgporv&Julianne Pinto, Trustees JDC Ocean Avenue Realty Trust 63 Ocean Avenue, Centerville Dear Board, Please find attached a variance request form, engineered plan, floor plans, 7-page cliecklist, signed letter from the property owner and a copy of die abutter letter. The project site consists of approximately 8.3 acres of land in Centerville. The property is developed wide a single-family dwelling dating back to die early 1900's, and a detached garage. The existing septic system was upgraded in 2007 wide counter variances to die building foundations. The overall project as currently proposed is to include improvements to dwelling, garage, and site to include new foundation and additions to existing dwelling, proposed patios and walkways, renovation/reconstruction of garage wide room above, and all associated appurtenances. Aldiough, in theory, the project could have been proposed trying to maintain the existing septic,we believe it could be more difficult to protect die existing septic during die foundation work than would be to just assume replacement. The variances being requested are as follows: 310 CMR 15.211 Setbacks S.A.S. to Slab 10' Required 5' Provided 310 CMR 15.221 General (7) Depth of Components 36" Depdh Max. Up to 60" Depdh Proposed I f T.O.B. 360-1 Setbacks to Water Bodies - Coastal Bank 100' Required 50' Provided to S.A.S. 62' Provided to Septic Tank We would note that we believe die Tide V variances would have been eligible for Counter approval, and that die proposed local variance for separation of die S.A.S. to die Coastal Bank is not substantially different than die existing conditions. We would also note that the proposed S.A.S. has been adjusted to increase die separation to die dwelling to die point that a variance is no longer required to that foundation. I will not be at the staff meeting next week. Here are my comments: -Variance on plans should be changed to up to 72" of cover over SAS (not 60") -State counts systems in parallel like this as a field/bed with only bottom area credit. They could apply for the 25% reduction in size or see if the State or Board are ok with counting sidewall. I am giving the plans back to Sharon, if there are questions, I marked the items with red pen. Asides from that, I have no problem with the plans.
