A public meeting of the Board of Health was held on Tuesday February 25, 2020. During the public meeting, the following variance was not granted from the State Environmental Code, Title V: 310 CMR 15.405 (1): To install a soil absorption system four (4) feet above the maximum adjusted groundwater table. The following variances were granted from local and State regulations: Section 360-1 of the Town of Barnstable Code: To install a septic tank 33 feet away from a coastal bank, in lieu of the 100 feet minimum separation distance required. Section 360-1 of the Town of Barnstable Code: To install a pump chamber 25 feet away from a coastal bank, in lieu of the 100 feet minimum separation distance required. Section 360-1 of the Town of Barnstable Code: To construct a soil absorption system ten (10) feet away from a coastal bank, in lieu of the 100 feet minimum separation distance required. Section 360-1 of the Town of Barnstable Code: To install a septic tank 51 feet away from a bordering vegetated wetland, in lieu of the 100 feet minimum separation distance required. Section 360-1 of the Town of Barnstable Code: To construct a soil absorption system 52 feet away from a bordering vegetated wetland, in lieu of the 100 feet minimum separation distance required. 310 CMR 15.405 M: To construct a soil absorption system ten (10) feet away from a coastal bank, in lieu of the fifty feet minimum separation distance required per the State Environmental Code Physical constraints at the site severely restrict the placement of the septic system components due to high groundwater and its close proximity to a coastal bank and wetlands. During this hearing, the designing engineer was advised to revise the plan to provide five feet vertical separation to the maximum adjusted groundwater elevation. A revised engineering plan (dated February 26, 2022) was later submitted to the Health Division showing the required five feet separation. The revised plan appears to meet the maximum feasible compliance standards within 310 CMR 15.000, State Environmental Code, Title V.
