Dear Mr. Belden: I i The Board of Health has reviewed this definitive subdivision plan in Cotuit and makes the following recommendations: I The developer must provide public water to each and every lot in this subdivision identified on the submitted plan dated April 11, 2001 identified as PL. BD. #794 in Cotuit, for Robert and Veronica Powers. Public water lines and all connections must meet specifications and/or rules and regulations of the local water department. I Each septic system shall be located within the prescribed boundaries of each individual lot. All septic systems shall be located as most distant as possible from the wetlands.within each Pot. The. developer shall have recorded on the deed that variances from Title 5, Minimum Requirements for the Subsurface Disposal of Sanitary Sewage, or the Town. of Barnstable Health Regulations whichever Is more stringent, will not be granted on any lot in this subdivision. A percolation test must be made on the lot at leaching site, before a Disposal Works Construction Permit will be issued. Maximum ground water elevations must be determined by using data available from the United States Geological Survey -Probable High groundwater Levels on Cape Cod, Mass. Each proposed septic system must conform strictly to 310 CMR 15.00, the State Environmental Code, Title 5, and Town of Barnstable Rules and Regulations. All tree stumps, brush and building debris removed when clearing lots or roads must be disposed of at a licensed solid waste disposal facility. Subsequent to the meeting Arne Oja'la will revise the plan to incorporate the following changes: 1. Fullers Marsh Road shall be banked to the west side of the road from the end of the existing pavement to the intersection of Fullers Marsh Road with Poponessett Road. Poponessett road shall be banked toward the east from it's intersection with Fullers Marsh Road for a distance of approximately 60 feet north of the intersection of Poponessett Road with Fullers Marsh road. 2. The Poponessett Road travel lane shall remain where it is presently located for the first 60 feet measured from it's intersection with Fullers marsh Road. A swale/ditch shall be constructed in the shoulder of the road on the west side of FOers Marsh Road and the east side of Poponessett Road foie a distance of approximately 60 feet from the intersection of Fullers Marsh road. The swale/ditch shall have an outlet pipe that shall extend under the road and shall discharge into a swale to be constructed in the shoulder of the southerly stub end of Fullers marsh road. 3. Poponessett Road shall be constructed in the location that has recently been cleared for the road and shall connect to the existing 10 foot traveled with a smooth transition. This section of Poponessett Road shall be graded toward the west side of the road into a swale/ditch that will be located approximately where the existing traveled way is located. 4. Ditches/swales shall be vegetated. The shoulder of the road shall initially slope steeply enough away from the traveled way to ensure that water sheds into the swales without being impeded by vegetation. 5. Pipe inlets and outlets shall be protected by stone pipe ends. The outlet pipe r shall have a stone velocity dispersion pool constructed in the downstream swale. 6. All improvements to the road are to be made within the existing road layout. 7. The gravel road shall consist of a minimum of 10 inches of road base gravel with 2 inches of'/, inch crushed stone on top of the road gravel. Gravel and crushed stone shall be rolled and compacted to 95% of maximum density. The Board found that the only frontage and and access to the subject property is Poponessett Road, an 8 foot wide gravel road. Poponessett Road is not a town road, but is a way which was in existence prior to the adoption of the Subdivision Rule and Regulations in 1962. i According to the Subdivision Rules and Regulations, Section 3-1.3(2) Standards of Adequacy, existing ways providing access to lots said not to be within a subdivision , shall be considered to provide adequate access only if there is assurance that prior to construction on any lots, access will be in compliance to the Standards of Adequacy for Existing Ways, which states that a way providing access to 2 dwellings, must have pavement of at least 14 feet in width to be considered to provide adequate access. Since Poponessett Road does not comply to the standards of adequacy for existing ways, as set forth in the Subdivision Rules and Regulations, the Board found that the plan is a subdivision. The Board felt that, to provide adequate access to the subject lot, Poponessett Road would need to be constructed and brought to compliance with the road standards outlined in the Subdivision Rules and Regulation, hence, the plan is a subdivision. The Board also found th\th e above plan meets the criteria of a subdivision plan as defined in MGL, Chapter 41. According to MGL, Chapter 41, Section 81-L, a "division of land into two or more lots shall not be deemed to constitute a subdivision within the meaning of the subdivision control law if, at the time when it is made, every lot within the tract so divided has frontage on (a) a public way or a way which the clerk of the city or town certifies is maintained and used as a public way, or(b) a way shown on a plan theretofore approved and endorsed in accordance with the subdivision control law, or(c) a way in existence when the subdivision control law became effective in the city or town in which the land lies, having in the opinion of the Planning Board, sufficient width, - = suitable grades, and adequate construction to provide for the needs of vehicular traffic in relation to the proposed use of the land abutting thereon or served thereby, and for the installation of municipal services to serve such land and the buildings erected or to be erected thereon". Since the Board found that the subject lot was located on a way that is not adequately constructed to provide the needs of vehicular traffic, and did not meet the a itional critenastated above, it conclu a the pan to be a subdivision and not entitled to an ANR endorsement, pursuant o Mec ion 81-P, states that ANR endorsement "shall not be withheld unless such plan shows a ion subdivision".
