Dear Mr. Lahteine: At a meeting of the Barnstable Planning Board held on Monday, December 21, 1987 it was voted to approve the above definitive subdivision plan. sub- ject to the Town Subdivision Rules and Regulations, the Board of Health letter to the Planning Board, and conditions therein, dated December 15, 1987, with the exception of the following two paragraphs: 1. The developer must receive an Order of Conditions from the Conservation Commission, it applicable. The developer shall not disturb the herring run enbankment area. Surface and subsurface stormwater runoff shall not drain directly into the herring run area. 2. It is recommended that each onsite sewage disposal leaching facility be located 300 feet from wetlands to reduce eurtrophication caused by phosphorous and other nutrients. Enclosure #2 - Letter of recommendations for Definitive Subdivision (RE: ` The Little River Land Corporation) to the Chairman of the Planning Board ` from the Board of Health dated December 15, 1987. Enclosure #3 - Letter of recommendations for Preliminary Subdivision (RE: s The Little River Land Company) to the Chairman of the Planning Board from the Board of Health dated September 1, 1987. There are several recommendations that were not accepted by the Planning Board (as stated in enclosure #1). It is my understanding that the reason the Planning Board did not accept these recommendations was because these recommendations were not included in the Preliminary Subdivision recommendation letter (enclosure #3). Notice that the first sentence of listed Section #1, of enclosure #1 was in fact included with the list of recommendations in the Preliminary Subdivision recommendation letter (enclosure #3). Public water lines and all connections must meet specifications and/or rules and regulations of the local water department. Each septic system shall be located within the prescribed boundaries of each individual lot. The developer shall have recorded on the deed that no variances from Title 5, Minimum Requirements for the subsurface Disposal of Sanitary Sewage, and the Town of Barnstable Health Regulations will be granted on any lot in this subdivision. A percolation test must be made on each lot, at leaching site, before a Disposal Works Construction Permit will be issued. Maximum ground water elevations must be•determined by using data available from the United States Geological Survey - Probable High Ground Water Levels on Cape Cod, Mass. Public water lines and all connections must meet specifications and/or rules and regulations of the local water department. Each septic system shall be located within the prescribed boundaries of each individual lot. The developer shall have recorded on the deed that no variances from Title 5, Minimum Requirements for the subsurface Disposal of Sanitary Sewage, and the Town of Barnstable Health Regulations will be granted on any lot in this subdivision. All tree stumps, brush and building debris removed when clearing lots or roads must be disposed of at a licensed solid waste disposal facility. Chipping brush and tree stumps is an acceptable alternative. Burial on site is prohibited. The developer must receive an Order of Conditions from the Conservation Commission, if applicable. The developer shall not disturb the herring run enbankment area. Surface and subsurface stormwater runoff shall not drain directly into the herring run area. The developer shall have recorded on the deed that underground fuel and chemical storage tanks cannot be installed or maintained on property within this sub-division. Pior to Board of Health approval of each building permit, the sewage system and water supply must conform to 310 CMR 15.00, the State Environmental Code, Title 5, and Town Health Regulations. It is recommended that each onsite sewage disposal leaching facility be located at least 300 feet from wetlands to reduce eutrophication caused by phosphorous and other nutrients. The United States Environmental Protection Agency's National Eutrophication Survey states that 0.25 lbs. per year of total phosphorous enters wetlands from every person served by onsite septic systems within 300 feet of freshwater wetlands (US EPA 1983).
