Peter and Doreen Evans 960 Main Street Cotuit, Ma 02655 Dear Mr. and Mrs. Evans: You are granted a variance from 310 CMR, 15.11, of Title 5, of the State Environmental Code, to use a. retaining wall in lieu of additional fill, to meet the slope/break out requirement for.the on-site sewage disposal system leaching pit at 960 Main Street, Cotuit, Ma. You are also granted a conditional variance from 310 CMR 15.03 (7), of Title 5, of the State Environmental Code, to install a leaching pit 22 feet from a subsurface drain, in lieu of the required 25 feet at 960 Main Street, Cotuit, Mass., with the following conditions: (1) All stormwater runoff shall be contained on site. (2) The subsurface pipe leading from the catch basin into Cotuit Bay shall be disconnected and plugged, or removed. (3) You must receive the approval of the Conservation Commission. (4) The designing engineer must be on site and supervise construction of the septic system and certify in writing to the Board of Health that his design has been strictly adhered to prior to the issuance of a Certificate of Compliance. (5) You must receive written certification every three (3) years that the system has been cleaned by a licensed septage hauler. (6) The septic system must be installed in strict accordance to the submitted plan. (7) Variance expires November 15, 1988. The variance is granted because the existing septic system consisting of a cesspool and two leach pits is located closer to the slope and to the existing catch basin than the proposed location. The existing septic system consists of a converted cesspool and two leach pits , the last of which was installed in 1985 . 2 . The structure served by the septic system is to be converted from use as three apartment units to a single family residence with five bedrooms , no more than at present . 3 . The area available for the septic system is at the top of a coastal bank . Provisions exist for containment of runoff from building , and pavement areas through a catch basin and drain discharging . at the base of the slope . Portions of this drainage system will be relocated to conform with 310CMR regulations . 4 . The proposed renovation will bring the septic system, into compliance with Town of Barnstable requlations relative to system capacity . 5 . The proposed leach pit cannot be located at a distance of 86 ft horizontally from the slope at the northern boundary of the property , an..d because of proximity to existing retaining walls cannot reasonably be constructed at a lower elevation . The pit will , however , have approximately the same slope setback as previously allowed for system renovation in 1985 . 6 . The existing catch basin will be relocated to approximately 19 ' from the proposed septic tank and the drain relocated to the required 25 ' from leach pits . 1 .r a - 2 - Although the leaching capacity of the existing system appears to be adequate in light of the proposed intensity of use , I believe that the additional capacity which would be provided by the installation of an additional leach pit and the increase in effectiveness of treatment afforded by the larger septic tank will provide greater assurance of meeting the long term wastewater treatment and disposal needs of the site and the public health concerns of your Board . D) Site Clearing: A minimum of thirty percent (30%) of the total upland area of any lot shall be retained in its natural state,_ with only limited selective cutting of trees and clearing of understory shrubs and groundcover allowed. 7) WP Well Protection Overlay District Regulations: The WP Well Protection Overlay District consists of the area within a two thousand foot (2, 000 ' ) radius upgradient of exist- ing and proposed public supply wells, and lying wholly within a 'GP Groundwater Protection Overlay District. r A) Permitted Uses: The following uses are permitted in the WP Well Protection Over- lay District: a) Any use allowed in the underlying zoning districts, except those specifically prohibited in Section 3-5. 2 (7) (B) herein: B) Prohibited Uses: The following uses are prohibited in the WP Well Protection Over- lay District: a ) Any use prohibited in the underlying zoning districts. b ) All uses prohibited in section (6) (B) herein. h ' 14 c) Parking and/or storage of transport vehicles for fuel, in- cluding but not limited to oil , coal and gas. d) Parking and/or storage of transport vehicles for toxic and/or hazardous substances. e) Any use which uses, generates or stores toxic or hazardous substance, totaling at any one time, more than fifty (50) gallons liquid volume or twenty-five (25) pounds dry weight. The Town-'s entire drink:ina_ water supply is derived from groundwater, and the United States Environmental Protection Agency has designated all .of Cape Cod a= a "sole source aquifer" requiring special care and protection. The groundwater system is integrally connected with surface waters, lakes, streams and coastal estuaries, which constitute important recreational and economic resources of the Town. Con- tamination of the aquifer and related surface water resources pose a serious threat to the health, safety and financial well- being of the Town. 1 -2 Purpose The purpose of this article is to protect the public health, safety and welfare by maintaining quality groundwater through the regulation of the volume of certain wastewater discharges. t:a 14 c) Parking and/or storage of transport vehicles for fuel , in- cluding but not limited to oil , coal and gas. d) Parking and/or storage of transport vehicles for toxic and/or hazardous substances. e) Any use which uses, generates or stores toxic or hazardous substance, totaling at any one time, more than fifty (50) gallons liquid volume or twenty-five (25) pounds dry weight. 'n 15 SECTION 2 GENERAL PROVISIONS -1 Prohibition No person, company, corporation, entity, trust or firm shall in- stall a new individual on-site sewage dispoal system which will produce more than three hundred thirty (3:30) gallons per day of wastewater discharge unless in compliance with the standards es- tablished by Section 3 herein. 2 Certification of Compliance/When Required A certificate of compliance with this article shall be received from the Board of Health or its designee prior to the commence- ment of any activity regulated by Section 2-1 herein. SECTION :3 STANDARDS =:-1 MaXimum Allowable Wastewater Discharge Within zones of contribution to existing and proposed public. supply wells, as determined by SEA Consultants, Inc. , Poston, MA. , in their report entitled "Ground Water and Water Resource Protec- tion Plan, Barnstable, Massachusetts, " dated September, 1985, which is on file with the Town Clerk, the maximum allowable was- tewater discharge from new individual on-site sewage disposal systems shall not exceed three hundred eighty (:380) gallons per acre per day. -2 Additional Limitations/Certain Areas In addition to the standards of Section 3-1 herein, within two thousand (2, 000) feet of existing and proposed public supply wells the maximum allowable wastewater discharge from a new in- dividual on-site sewage disposal system shall not exceed two thousand (2., 000) gallons per day, unless downgradient from said e::•::isting and proposed public supply wells. 3-:3 Flow Rate Determinations To determine compliance with Sections 3-1 and 3-2 herein, was- tewater flow rates shall be determined according to Title V of the State Environmental Code, subject to the interpretation of the Board of Health. 3-4 New System Defined For the purposes of this article, the phrase "install a new in- dividual on-site sewage disposal system" shall not include the maintenance, repair and upgrading of an existing individual on- site sewage disposal system. l R t 16 SECTION 4 ADMINISTRATION This article shall be administered by the Board of Health or its designee by verifying compliance with the provisions established herein. Within ten ( 10) working days of receipt of a request for a certificate of compliance, the Board of Health or its designee shall notify the applicant therefor as to the approval or disap- proval of the request. Upon determination that all provisions of this article are being met, a certificate of compliance shall be issued. However, in instances where an upgrading of an existing individual on-site sewage disposal system is proposed, the Board of Health may require from an applicant evidence that the proposed upgrading will not adversely affect the groundwater qua ity. SECTION 5 ENFORCEMENT The provisions of this article shall be enforced by the Board of Health or its designee, which may, according to law, enter upon any premises at any reasonable time to inspect for compliance. SECTION 6 VIOLATIONS Written notice of any violation of this article shall be given by the Board of Health or its designee specifying the nature of the violation and a time within which compliance must be achieved. SECTION 7 PENALTIES Penalty for failure to comply with any provision of this article shall be three hundred dollars ($300.00) per day of violation. SECTION 8 SEVERABILITY Each provision of this article shall be construed as separate. If any part of this article shall be held invalid for any reason, the remainder shall continue in full force and effect. ARTICLE 4. To see if the Town will amend Chapter III, Article III of its bylaws by striking from Section 3-1 .6 (7) (F) (b) the words ""Water Table Contours and Public Water Supply Well Zones of Contribution" , prepared by the Cape Cod Planning and Economic Development Commission, dated 1982, "and inserting in place thereof the following: "Town of Barnstable Public Supply Well Zones of Contribution" prepared by SEA Consultants, Inc. in their study entitled "Groundwater and Water Resource Protection Plan, Barnstable, Mas- sachusetts, " dated September, 1985. e NOTES: 1. Sandwich , Ma . 02537 re . 87-040 , Evans , 960 Main Street , Cotuit Tony : On Oct . 30 , I recieved a call from Tom McKean of the Barnstable Board of Health regarding the ref , project . Mr . McKean informed me that after consulting with Dale Sodd , the town ' s coastal coordinator , it has been determined that retaining the drain at the Evans ' property , discharging into Cotuit Bay was illegal . He stated that unless a revised plan showing the drain to be abandoned , and supplemental information showing the point of discharge of the present drain , reached his office prior to the hearing scheduled for November 4 , that the hearing would be canceled . . We have made the revisions as requested and understand that you will see that the plan arrives at the Board of Health in time . In place of the existing drainage system , we have shown a stone trench of two feet wide , one foot deep and thirty five feet long placed at the corner of .the parking lot .
