Dear Mr. Bartell:
The Board of Health has reviewed this definitive subdivision plan in Cotuit makes the
following recommendations:
The developer must provide public water to each and every lot in this subdivision. Public
water lines and all connections must meet specifications and/or rules and regulations
of the local water department.
Each septic system shall be located within the prescribed boundaries of each individual
lot.
The developer shall have recorded on the deed that variances from Title- 5, Minimum
Requirements for the Subsurface Disposal of Sanitary Sewage;,or the Town of Barnstable
Health Regulations whichever is more stringent, will not be granted on any lot in this
subdivision.
A percolation test must be made on each lot at leaching site, before a Disposal Works
Construction Permit will be issued. Maximum ground water elevations must be determined
by using data available from the United States Geological Survey - Probable High
GroundWater Levels on Cape Cod, Mass. Each proposed septic system must conform strictly
to 310 CMR 15.00, the State Environmental Code, Title 5, and Town of Barnstable Rules
and Regulations.
All tree stumps, brush and building debris removed when clearing lots or roads must be
disposed of at a licensed solid waste disposal facility. Chipping brush and tree stumps
is an acceptable alternative. Burial on site is prohibited.
The applicant must receive an Order of Conditions from the Conservation Commission,
if applicable.

Dear Mr. Wilbur,
We are in receipt of plans dated May 18, 1990, for the Steven Gould
Subdivision off Main Street, Cotuit. These plans do not show Cotuit public
supply 'well #3, located on the property adjacent to Mr. Gould's lot, nor do
they show the 400' well protection radius. The Board of Water Commissioners
met with Mr. Gould on July 18, 1990, to discuss these plans. A rough com-
parison of our maps with Mr. Gould's plan indicates that at least one-half
of Mr. Gould's proposed Lot 2, and a portion of the cul-de-sac on the pro-
posed road layout, lie within the 400' well protection radius.
Due to the apparent extent of encroachment upon the well protection area,
we are requesting that the Planning Board require Mr. Gould to submit revised
plans showing Cotuit Well #3, the 400' well protection radius, and the well
protection overlay district as it affects his proposed lots and roadway.
We would also request that revised plans show the topography of the proposed
lots as well as any drainage planned for the proposed road.
Although we realize it is not within the purview of your Board to consider
building plans, we have serious doubts that the proposed. Lot #2 will be able
to accomodate a house, driveway, septic system and reserve leaching area all
outside the 400' radius of the well. We also have concerns about the potential
encroachment of lawn area from the future dwelling into the 400' well protection
radius.
At this time, we would request that the Planning Board not rule on this sub-
division until they receive revised plans as outlined above and until the Cotuit
Water Commissioners can review these plans and make a formal determination as to
our position on the subdivision.

9. (a) The applicant further agrees that before final approval of the definitive plan, the applicant will
cause to be filed with the Board a bond in form satisfactory to the Board, conditioned on the
completion of all required improvements in the time and manner prescribed, in a penal sum
sufficient, in the opinion of the Board, to cover the cost of such work, and executed by the ap-
plicant as principal and a surety company authorized to do business in the Commonwealth
and satisfactory to the Board as surety, or secured by the deposit with the Town Treasurer of
cash or negotiable securities in an amount equal to the penal sum established by the Board.

(b) The applicant requests the Board to approve the definitive plan on condition that no lot in the
subdivision shall be sold and no building shall be erected or placed on any lot until the re-
quired improvements necessary to adequately serve such lot have been completed to the Sa.tis-
faction of the Board.

At a duly posted meeting of the Barnstable Planning Board held August
13 , 1990, it was voted to DENY WITHOUT PREJUDICE the above captioned DEFINITIVE

1 ) The applicant made no written request for waivers ; the Planning
Board had insufficient information to grant waivers ; it is within the
Planning Board' s jurisdiction to not grant waivers, in compliance with
Section 2-D- 1 of the Town of Barnstable Subdivision Rules and
Regulations ; and the subdivision plan failed to meet the requirements
of the Town of Barnstable Subdivision Rules and Regulations Section 4-
B (2) b - offset of proposed road with existing Coolidge Street;
Section 4-B (2) j - minimum width of road layout, fifty (50' ) feet ;
Section 4-B (2) a - design of streets , minimum width of pavement i
twenty-two (22) feet ; Sections 4-E and 5- I - sidewalks ; Sections 4-F j
and 5-J - curbing and berms; construction specifications Section 5-G -
road foundation; and Section 5-H - roadway surface; " "
2) The review, dated 07/23/90, made by the Cotuit Fire District Water
Department , in accordance with Section 3-C-4 of the Town of Barnstable

At a duly posted meeting of the Barnstable Planning Board held August
13 , 1990 , it was voted to DENY the above captioned PRELIMINARY
subdivision plan ##730, for the following:
1 ). The time period, as required in Section 81-U of the MGL
Chapter 41 , Subdivision Control Law, within which the Planning Board
had to take action on the application, would have expired before the
next regularly scheduled Planning Board meeting and the applicant
and/or his representative were not present at the 08/ 13/90 meeting to
request an extension of that time;
2) The Planning Board had insufficient information to grant the
preliminary application.
