Lot 7 also does not appear buildable due ko a high percentage of lowland. In addition, the following conditions must be Piet: The developer must furnish the Board a statement from a Registered Engineer that the installation of private sewage systems on each lot will not adversbly affect surface or sub- surface .publ,ic or private water resources of (1) all lots in subdivision; (2) The adjacent land (whether developed or not; (3) A defined aquifer reciiarge area. Town water will be required on each 16t. if impossible to obtain town water from appropriate Crater district, a letter to + that effect must be obtazllea. Each dwelling,shall connect, to the Totm Sewer when it is available. Wells and septic systet is shall be located within the prescribed boundaries of each individual _lot, and indicated on .plot plan. A percolation test must be made on. each .lot, at leaching site, before a buildifig permit will be issued. Each proposed_ -' septic system must conform strictly to Article XI of the Massachusetts- State Sanitary Code and Toum of Barnstable Rules and Regulations. I Mr. Joseph R. 'la.ns were oriented to ground layout, and locations of 3 proposed ponds were identified on the site. Visits to each of the three present i cranberry boos were made, and a, series of small-bore drillings was made unrlyng to in each to determine the character of the denedla..ndsitssbeddprobeddepthswith water. The Little River- itself was also exa,mi the drill in several locations. Finoing s: i high fresh marsh and cranberries; �,owPr ;2 ; Vegeta.ti. Nearly no peat in any of seven borings made some small pine seedlings. Y on both sides of the proposed stream relocation, a.t. 20-30' intervals in two lines running east and west across the upper (northern) and lower Ditches contained running water all around ( southern) parts of the bogs. .' edges. Water table was 1211-16" below surface of bog. Fine saturated sands underlie the whole bog area, and present bed. of Little River. Pine see-_iIn;� several ,years old also occur. Soil is all gravelly sand to :;.ept}: o ' 1'". Sa.nks of river are stable with native vegetation. This is the wil';.est area of the three examined bogs. Conclusions: 1. The bog .a.reas will support fill without any necessity of preliminary excavation. 2. Ground water will not be impeded or diverted away from seeking Little River as its outlet. 3. Sewage pollution can be avoided by sufficiently filling low lots above present ground water level and not allowing sewage 4 beds to be within the required setback distance from the banks of the proposed 'ponds or of Little River. 4. There are no public wells below this point on the water table, and private wills well not be unduly affected, as they tap ground-water sources prior to their emergence into the Little River. 5. Some wildlife habitat would be destroyed by the project as now envisioned , 6. The tight ground-cover vegetation will be destroyed by filling, but can presumably be re-established. 7. The open space itself will not be significantly reduced except along the steep bank on the easterly side of the central bog, where extensive filling must take place to overcome objections of the Board. of Health, if indeed that Board will allow building there at all, y 8. Pond areas, dikes and. bank heights as proposed will absorb abrupt flowa.�Ye of Little River, thus minimizing flood possibilities G either at the site or below the site. 9. Ponds ca.n be constructed so as to minimize any silt reaching the salt-marsh at the mouth of Little River. Recom-mendations: The project, in my opinion, cannot be disallowed under present .Barnstable and. State laws; however, conditions such as those suggested here ca.n be imposed, in addition to those 8 imposed by statute form. A. That a.11 flat open exposed surfaces of fill be covered with vegetation-supporting soil and some vegetation as soon as practicable after deposition. B. That all banks sloping into the proposed ponds be so treated to , prevent 'surface. erosion into them, preferably by being planted with native vegetation, and that no banks be cement-walled or lined (other than flume areas) . `V 4 C. That the ponds be duo first, filled, then allowed. to settle before final diversion of Little River into the proposed new channels takes place. 0. That the acre-footage storage capacity of the proposed ponds for flood control purposes be computed as lying above the present water-table level in the soil, and not in any way be dependent upon a depth of the proposed ponds below the present water-table level. L. That access to all ponds from the roadways be guaranteed at specific points by common landings or lands. ` F. That no surface drainage from the proposed roads be allowed to enter directly into any proposed pond or into Little River, but that sufficient leach pits be provided to accommodate all reasonable storm drainage. I The applicant in my opinion, should be encouraged to leave the steep central portions in native, undisturbed vegetation as a "common lands", perhaps with a. restriction running in favor of the Town through its Conservation Commission, because said interest, if given, is tax deductible- on the federal level and requires a. separate lower assessment at the local level. Title,can remain with owner(s), if parts of several lots are involved. In the event the roadside lots along the middle bog do not qualify for approval by the Board of Health regardless of filling level proposed, they too should be considered for conservation restrictions, title to remain with the owner(s) in a, common Lands Association of the eventual lot owners, as mentioned above.
