Dear Mr. Sanicki:
You are granted a variance, on behalf of your client John McShane, from 310
CMR, 1503 (7), of the State Environmental Code Title 5, to install an onsite
sewage disposal leaching pit and reserve leaching pit four (4) feet from the
property in lieu of the required 10 feet at Lot 24, Oakwood Street, Cotuit, with
the following conditions:
(1) The septic system must be installed in strict accordance to the submitted
plan.
(2) The designing engineer must be onsite and supervise construction of the onsite
sewage disposal system and must certify in writing to the Board of Health that
his design has been strictly adhered to prior to the issuance of a Certificate
of C'ompliance.
(3) The dwelling cannot have more than three (3) bedrooms. Sewing rooms, dens,
lofts, mudrooms, enclosed porches, finished cellars and similar type rooms are
considered bedrooms according to the Department of Environmental Quality
Engineering.
(4) It shall be recorded on the deed that the onsite sewage disposal shall be pumped
every three (3) years and written certification submitted to the Board by a licensed
septage hauler.
(5) The dwelling must be connected to public water.
(6) The variance expires December I5, 1988.
The variance was granted after the Board members visited the site. Robert
Gatewood, Conservation Agent, was also present at the site to show the Board
members the location of the edge of wetlands. Mr. Gaatewood stated that the
previous delineation of the edge of wetlands made by A.M.Wilson Associates
was accurate.
The Town of Barnstable Board of Health requires all onsite sewage disposal systems
to be located so that a distance of not less than one hundred (100) feet will
intervene. between the leaching facility and the edge of wetland. The present
engineered onsite sewage disposal plan shows a one hundred (100) foot separation
between the leaching pit and the edge of wetland. It is the opinion of the Board
that this proposed location is more desirable and less detrimental to the wetland

referenced two lots.
A site meeting was conducted on October 16, 1987 with Mr. R. Gatewood,
Barnstable Consevation Agent, at which time Mr. Gatewood indicated concurrance
of the wetlands as delineated on the plan which was marked by A. Wilson Associates.
Upon -notification of the Board of Health meeting we will notifiy the abutters
as required.

DATE: October 19, 1987
On October 16, 1987 I evaluated the wetland line as delineated by A.M. Wilson
Associates and as given on plans of Cape and Islands Surveying, Inc. In my
opinion, the delineation is accurate.
I suggest that the Board of Health consider offsetting the leaching facilities
for the proposed dwellings the prescribed distance from the edge of wetlands
(i.e. 100 feet) .
The Conservation Commission, as you are aware, must play an eventual role
in the fate of proposed development on the foregoing parcels. Among those
interests which this board serves, I suggest that erosion control (bank stability)
and attendant potential adverse effects to the wetland will be germane to
the Commision's review. (This assumes full compliance with Title V provisions. )
