West Barnstable, MA 02668 Dear Mr. Woodman: The Board of health unanimously voted to grant you permission to utilize the building unit #13, Perseverance Drive, Barnstable, for cleaning automobiles with the following conditions: ( 1) You shall receive the approval of the Zoning Enforcement Officer, Joseph Daluz. (2) The flooring in the urea to be utilized for automobile cleaning shall be bermed to prevent wastewater effluent from entering the ground. The property is located within a zone of contribution to public water supply wells (GP District) . Health Inspector Jerome Dunning went the site and verified there is a fiberglass boat business. Attached are copies of correspondence sent to the Building Department regarding this property during the past two years. We would appreciate it if we could receive a response as to what action will be taken, if any. If an inspector is sent to unit 7, please be aware of the large dog; Health Inspector Jerry Dunning was quite surprised by the 280 pound attack dog which charged toward him. Owner of the building is Skip McAndrews. In Unit 5 I spoke to a gentleman by the name of John Pollock who was doing "bondo" work on a vehicle. The "bondo" is a polyester resin which is a hazardous waste. In addition, there was antifreeze in an open contain- er and signs of spillage on the floor of the unit. Unit 5 and 6 have had complaints of this type of activity as well as spray painting of vehicles. Dana Woodman, New England Auto Reconditioning is doing business in the Groundwater Protection Overlay District and believe this is a zoning violation for this business at this location. Mr. Woodman was granted permission by the Board of Health to do business on Perserverance Drive, Barnstable with certain requirements. (see attached) . He currently is also in violation of Article 39, Town of Barnstable 's Control of Toxic and Hazardous Materials. Upon inspection of the property on January 29, 1992 there was also evidence of people living upstairs in the unit. Attached are copies of Zoning Board of Appeals documents. Mr. Donahue stated that the PetitlnnAr was seeking permission to construct a building for offices anu storage in a Residence Al area. The parcel of land is located immediately to the rear of the building housing Emerson Aug Co. and Merchants Bank & Trust Co. of Cape Cod. The locus is abutted on the east by King's store and the parking lot, and on the west by the Corcoran Supply Co. The rear of the parcel fronts on King's Way. It was the opinion of the Attorney that this parcel surrounded on three sides by other business uses would not be suitable for the purpose for which it was zoned. There is no access from the locus to King's Way and the Petitioner does not propose to establish any; the access would be from Iyanough Road. The Petitioner plans to erect a steel prefabbed.building placed on cement slabs.-2 Approximately 25% of the new building would be used for office space and 75% for the storage of equipment and parking of trucks. It is anticipated that the office facilities would be rented to various contractors who would keep and store their equipment on the premises. Mr. Donahue further stated that the lot is approximately 160, in depth of which the front northerly 309 could be used purposes, or business It was the opinion of the Board that the use of these premises for the construction of a building to include offices and storage would not be detrimental to the surrounding area. The Corcoran building on the east is basically the same type of building, .yped for the same purpose and extending almost to Kings Way. The depth of King's store on the west would be of equal depth to the proposed building. The Board finds that 23jroRose -parcel is not suitable for rooidential purposes and that a sufficient hardship exists' to warrant the granting of a variance. The Board finds that there are conditions especially affecting this parcel not affecting the Zoning district in which it In located generally; and that a literal enforcement of the provisions of the by-law would involve substantial hardship; and that relief may be granted without substantial detriment to the public good and without derogating from the intent or purpose of the by-law.
