Dear Mr. Mycock•
The Department of Environmental Protection, Bureau of Waste
Site Cleanup, (the "Department") has determined that the property
, at 488 - 504 South Street in Hyannis, Massachusetts (the "Site") ,
is a confirmed disposal site within the meaning of the
Massachusetts. Oil and Hazardous Material Release Prevention and
Response Act (M.G.L. , C. 21E) . The assessment and cleanup of
disposal sites is governed by M.G.L. , C.21E, and by 310 CMR 40. 000,
The Massachusetts Contingency Plan (the "MCP") . The Department
confirmed this location as a disposal site on November 27, 1990. ,
BACKGROUND
The Department has reviewed two (2) environmental site
assessment reports for the Site that were prepared on behalf of- Mr.
David Columbo by Certified Engineering & Testing Company and are
dated November 19, 1987, and July 8, 1988. An additional report
prepared on behalf of Mr. David Columbo by Service Station
Maintenance Corporation dated May 1990, for property located .
adjacent to and downgradient of .the Site was also reviewed by the
Department. The reports indicate that volatile organic compounds
(VOCs) are present in the soil- and above Massachusetts standards
in ground water at the Site.
STATUTORY LIABILITIES -
The -Department has reason to believe that you, as owner of the
Site, are a potentially responsible party (a "PRP") with liability
under M.G.L. , C. 21E, Section 5, for response action costs.
. Section 5 makes the following parties liable to the Commonwealth:
current owners or operators of a site where oil or hazardous

materials are located; any person who owned or operated a site at
the time hazardous material was stored or disposed of; any person
who arranged for the transport, disposal, storage or treatment of
hazardous material to or at a site; any person who transported
hazardous material to a transport, disposal, .storage or treatment
site from which there is or has been a release or threat of release
of such material; and any person who otherwise caused or is legally
responsibile for a release or threat of release of oil or hazardous
materials at a site.
This .liability is strict, meaning it is not based on fault but
solely on your- status as an owner, operator, generator, transporter
or disposer. It is also joint and several, meaning that you may
be liable for all response action costs incurred at the site,
regardless of the existence of any other liable parties.
You may be liable for up to three (3) times all response
action costs incurred by the Department. Response action costs
include the cost of direct hours spent by Department employees
arranging for response actions or overseeing work performed by PRPs
or their contractors, expenses incurred by the Department in
support of those direct hours, and payments to the Department's
contractors. For more details on cost liability, see 310 CMR
40. 600: Cost Recovery.
The Department may also assess interest on costs incurred at
the rate of twelve percent (12%) , compounded annually. To secure
payment of this debt, the Commonwealth may place liens on all of
your property within the Commonwealth. To recover the, debt, the
Commonwealth may foreclose on these liens or the Attorney General
may bring legal action against you.
In addition to your liability for up to three (3) times all
response action costs incurred by the Department, you may also be
liable to the Commonwealth for damages to natural resources 'caused
by the. release. Additionally, penalties may be imposed under
M.G.L. , C. 21E, Section 11 and. other laws for each violation of
M.G.L. , C.' 21E or other laws, or under M.G.L. , C. 21A, Section 16,
for violations of C. 21E, and other statutes, regulations, orders
or approvals.
The Department encourages PRPs to take response actions at
sites. By taking the necessary response actions, you can avoid
liability for costs incurred by the Department's contractors in
performing these actions. If you , do not - take the necessary
response actions, or fail to perform them in an appropriate or
timely manner, the Department is authorized by M.G.L. , C. 21E to
have the work performed by its contractor.

DETERMINATIONS
The Department has made the following determinations:
This Site has been classified as a non-priority disposal site.
Notice of such classification will be published in a newspaper that
circulates in the potentially affected community(ies) .
Because the Site is a non-priority site, you may apply for a
waiver of Department approvals. If a waiver application is
approved by the Department, most response 'actions may be completed
at the Site without further Department approvals. Waiver
applications may be obtained by writing to the Waiver Unit,
Department of Environmental Protection, Bureau of Waste Site
Cleanup, One Winter Street, 5th Floor, Boston, MA 02108 .
Please be advised that additional information would be
necessary in order to complete the Phase I - Limited Site
Investigation in accordance with the MCP. This information
is specified in 310 CMR 40.543 (2) (a) (1,3,4 and 5) .
Furthermore, you and your agents must continue to evaluate the
need for a Short Term Measure (STM) as defined in 310 CMR 40. 542,
and notify the Department immediately if an "imminent hazard"
exists at the Site. You must submit a proposal to perform the STM
if one is deemed necessary. No STM may be commenced without prior
Department approval. This evaluation must continue throughout the
remedial response action for this Site.

CHANGE OF DESCRIPTION OF PREMISES:
In accordance wtih Chapter 138 of the General Laws, as amended,
DAVE COLUMBO & DOUGLAS TROTT d/b/a ROADHOUSE CAFE has petitioned the

Deter Sirs:
My wife and I operate a Natural Food Store in Hyannis, at
601B Main Street called Wholly Earth Foods, and-we are anticipating
changing our location, and setting up our food service (take-out)
in a building and out-building at 488 South Street, Hyannis.
Enclosed is a floor plan for our Bakery and retail store. The retail
part of it will be in the separate building, which we will prepare fa_r:tha,t:.
purpose. The interior walls will be finished with sheetrock and wood,:;
(polyeurethane firu;sh), incandescent lighting fromthe ceiling will be used in
both the store and the kitchen. The numbers on the plans refer to explanations
below.
We sell natural foods, grains, beans, flours, teas, dried fruits-, yogurt,
ice cream, vegetables and fruits. We also bake our own Whole wheat breads and
pastries and prepare snacks, juic8s, sandwiches, and soups to go. These we
would sell in the retail store in the outbuilding. All the food preparation
would take place in the kitchen, except cutting sandwiches and serving juices
and baked goods, and serving icecream.
We would be -liming in the house connected to the kitchen. The house
would have a separate kitchen and separate bathroom,and as I show'on the kitchen f
plan, would be connected by one door. We do not intend to employ any other
people in our operations, we wish to provide the services we now provide
at our present location.
Store items:
I. Front doors wooden, windows, and provisions for screens in season,
self closing type.
2. Largesliding "barn door" for delivery purposes only, wood with a window
again with provisions for screens.
3. Concrete floor, painted. No floor drain because of the size of the area,
and its retail use. (In scrubbing the floors of both kitchen and store
we find sponge mopping better than flooding, considering the size of the
area we have here, this seems a more useful approach to cleaning.)
4. Refrigerator case for vegetables and fruits: a 2 deck Hussman case with
remote compressor directly behind it outside on a covered masonry pallet.
maintains 40-450 temp.
5. Daity Refrigerator: self-contained Shmidt unit for cheeses, yogurt, and
juices. maintains 380 temp. 0n top a covered pastry display.
6. Wood (chopping block) top work table for cutting sandwiches, serving juices.,
and cutting cheeses, etc.
7. Six hole ice cream freezer, self-contained. (Service scoops dipped in
quant. Am. sole. then rinsed)
8. Sealed produce scale on wooden sales counter

All opening windows in the store are screened to the outside.
The loft to he used for storage of dry goods.
Kitchen items;
I. Doorway has cement Step and screen door on the outside (su mter) and
a storm door in winter. Main door is wood and glass, self closing.
2. Stainless steel sink: 2 bucket 18" each for washing pots and pans,
drains through a gre-use trap under the drain board.
3. All windows are screened to the outside, and with a vent fan in
upper portion of right hand window.
4. Formica topped work counter.
5. One toilet and wash sink for W wife and I. (no employees). In basement
the gas hot water heater is commercial type /2.s-gal capacity.
The kitchen is connected to and uses town water and town sewage. Again,
because of the size of the kitchen, I do not feel a floor drain would fascilitate
cleaning, especially in a small bakery operatidn.
Food service would be entirely on paper dispos4l"le-service, and for
take-out only.
And finally, we cart our own garbage to the town dimnp.

OUTSIDE CAFES
The Board of Health may grant variances from any of its
regulations providing the applicant for such variance can
prove satisfactorily to the Board that the granting of said
variance would not be inconsistent with accepted public
health practices and would not create nuisances to public
health or to the environment.
The following are some of the criteria that must be met
prior to the Board's consideration of a variance from
Regulation 14, Town of Barnstable Health Regulations:
(a) The dining area must be set back ten ( 10) feet
'from the property lines, sidewalks and all public
access ways (parking lots, etc. ) . A divider, such
as a small fence, shrubs, etc. , must mark the
designated setback.
✓(b) The dining area must be part of the restaurant
property whether leased or owned. The dining area
must be mentioned on the described premises as in
the case of a Common Victualler's License.
(c) Sufficient restrooms, both for customers and
employees, must be furnished counting the
additional outside seating as required by the
State Plumbing Code and Town of Barnstable Health
regulations.
4d) A self-contained drainage system designed to
eliminate odors will be required for all outside
dining areas. Conveniently located hose bibs with
vacuum breakers must be available for washing down
the dining area.
�(e) Provisions must be made by the applicant to
protect against the entrance of rodents, flies,
roaches, and other vermin, into the outside dining
area and into the parent establishment.
All entrance and exit doors used by food service
personnel and customers, must be screened and
provided with air curtains meeting National
Sanitation Foundation standards.
All windows or openings used for the transfer of
food will be screened and provided with air
curtains. An entrance separate from the
customer's entrance will be provided for the
transportation and serving of food outside. Food
cannot be stored or kept outside. All food must
be prepared inside the facility's kitchen and kept
inside until served.
V/(f) Trash dumpsters shall be situated no closer than
50 feet from an outdoor dining area. If such a
dumpster is in the line of sight from the dining
area, it must be hidden from view by a stockade or
other such fencing. The area around the dumpster
and stockade must be kept clean and free of
litter. Dumpsters must be kept closed with
adequate covers designed to prevent entrance of
rodents and vermin and completely free of odors.
The patio or other dining area surface must be of
�(g) such
construction or material as to be readily
cleanable and not be susceptible to inordinate
.amounts of dust, mud, or debris. (Brick, tile,
concrete, or similar washable surface would be
examples of acceptable material) .
V(h) Table tops must be so designed and of such
material and workmanship as to be smooth, non-
porous, easily cleanable and durable; and shall be
in such repair as to be readily maintained in a
/ clean and sanitary condition.
V (i) Silverware, used for outside dining, must be
handled in such a way that contamination of the
eating surfaces by the hands of the food handlers
is negligible. (Rarely enforced by Managers) .
(j) Seating capacity shall be determined by the Board
of Health after submission of plans and visual
inspection.
V/ (k) A menu shall be submitted to the Board at the time
of application for a variance
(1) Food service personnel must continuously police
the dining area for paper and other trash.
Placemat clips, cup holders and other such devices
must be utilized to prevent blowing paper.
Covered trash receptacles must be provided in
close proximity to the dining area, and must be
kept from overflowing.
(m) Strict clean-.up practices must be adhered to.
waitresses, waiters, and/or buspersons must be
employed to clean up after each patron as in
Indoor dining. Each establishment must abide by
all regulations contained in Article X, Minimum
Sanitation Standards for Food Service
Establishments, of the Commonwealth of
Massachusetts, Department of Public Health
Sanitary Code.
(n) outside food handlers must have easy access to
handwash sinks, clean cloths, and to facilities
where sanitizing solutions can be easily prepared
and disposed of.

(o) Hair nets or other effective hair restraints, such
as hats covering all exposed hair, shall be worn
by all outside food or drink handlers. Beards and
mustaches must be neatly trimmed.
THE ABOVE CRITERIA ARE NOT INCLUSIVE AND ARE ONLY FURNISHED
AS MINIMUM STANDARDS THAT MUST BE MET PRIOR TO
CONSIDERATION. THE BOARD RESERVES THE RIGHT TO DENY
VARIANCES FOR ANY OTHER CONDITIONS THAT MAY APPLY TO
SPECIFIC LOCATIONS. ANY VARIANCE GRANTED BY THE BOARD MAY
BE REVOKED FOR SANITARY VIOLATIONS AFTER AN OPPORTUNITY FOR
A HEARING IS PROVIDED THE PERMIT HOLDER.

capacity calculated by the kitchen flow rate of 15 gallons
per seat. You are therefore granted permission to operate
an outside cafe' at the Roadhouse Cafe' located at 488 South
Street, Hyannis, with the following conditions:
( 1) All the Board of Health Outside Cafe Criteria (A-0)
shall be strictly adhered to.
(2) No more than 32 seats are authorized outdoors.
(3) No more than a total of 165 seats are authorized at the
food establishment.
(4) Air curtains and screens shall be installed at all
doorways and appertures which will be used in serving
food and/or drinks to patrons outdoors.
(5) The grease trap shall be pumped on a monthly basis.
This variance is granted because the applicant testified
that he will comply with all the Board of Health Outside
Cafe' Criteria (A-0) as required. Also, the existing grease
trap has a capacity of 2000 gallons. It will be the opinion
of the Board of Health that the grease trap is of adequate
capacity if it is pumped on a monthly basis.
