The proposed wastewater treatment system will require a Groundwater Discharge Permit be approved by the Department of Environmental Protection (DE) ) since the total flow on site exceeds 660 gallons per day per acre . The proposed RUCK CFT denitrification wastewater treatment system has been designed as a shared system to provide tertiary treatment for the wastewater from the Edgewater Financial Group affordable residential development located on Cammett Way in Barnstable, MA. The quality of the final effluent is designed to be below 10 milligrams per liter of Total Nitrogen prior to discharge by the soil absorption system. The RUCK CFT shared system has a design flow of 9, 240 gallons per day. The final effluent is designed to meet the requirements of discharging less than 30 milligrams per liter of Biological Oxygen Demand and less than 10 milligrams per liter of Total Suspended Solids . These concentrations are the tertiary treatment standards for wastewater in a Zone II as defined by the DEP. DESCRIPTION The proposed shared RUCK CFT system at the Edgewater Financial Group affordable residential development in Barnstable, MA. will serve a total of 28 homes in a proposed planned residential development . The specific soils and groundwater conditions will be described in a geohydrology report at a later date . The soils are classified in the "Soils Survey of Barnstable County, Massachusetts" for Barnstable County as Merrimac Series . The soils are very deep, excessively drained sands on outwash plains . The shared RUCK CFT system has three (3) components : a collection system, a shared RUCK CFT system and a soil absorption (leaching) system. All three (3) components are illustrated in design detail on the. enclosed engineering plans . The following paragraphs are intended to amplify what is shown on the engineering plans . All of the homes are connected by a sewer system to the shared RUCK CFT system located on Parcel A. The collection system consists of a gravity sewer line and manholes located in the road layout . - 4 - The following briefly describes the proposed shared RUCK CFT system. The wastewater is piped to two 10, 000 gallon anoxic J chambers located on Parcel A. The total capacity of the anoxic chamber is 2160 of the design flow. After the anoxic chamber, there is an 8, 000 gallon dosing chamber that pressure doses the two main RUCK Filters . In the dosing chamber, there is a pair of submersible pumps that dose the RUCK filters in an alternating fashion. The RUCK filters are stratified, modified, vented filters . The filters are designed using proprietary equations . The capacity of the filters is over 9, 240 gallons per day. The surface area is proportional to the expected Biological Oxygen Demand, the expected Total Suspended Solids and the permeability of the sands . Four vents are installed over each RUCK filter. Three vents for each filter are at three feet above grade . These vent locations will be adjusted in the field. One vent pipe for each filter is mounted on the small service building and ends above the roof . The RUCK filter effluent is piped to a mixing chamber. The mixing chamber is separated into three compartments . The first compartment has a recycle pump located in it, which will operate four times daily, recycling an eighth of flow each time back to the initial anoxic tank. The next compartment in the mixing chamber is where a carbon source is added. Once the carbon source is added to the RUCK effluent, denitrification starts . Denitrification occurs in the mixing tank as well as in the two detention tanks . The effluent drains from the mixing tank into two 10, 000 gallon detention tanks with media. The detention tanks provide for 48 hours detention. The effluent from the detention tanks drains to a 8, 000 gallon intermediate dosing chamber where two pumps alternately dose the denitrified effluent to a polishing RUCK filter. The polishing RUCK filter is designed to add more denitrification and to lower the final TSS and BOD to acceptable levels . After the polishing RUCK filter, the final effluent is piped to a dosing chamber that doses a series of trenches . In the dosing chamber, there are two pumps to distribute the effluent to a soil absorption system. These pumps alternate and each dose a series of seven trenches . The application rate for the trenches is 2 . 5 gallons per square foot per day. The trenches are vented to a manifold with a vent located three feet above the finished grade . A small service building is proposed. The building will house the control panels and the carbon source, a soap like compound. A chemical feed pump pumps a soap-like compound into pipes connected to the mixing chamber. The pumps are controlled by a panel located above the pumps . The panel includes a series of timers to operate the pumps . The chemical feed pump has a dial control on the front face. The soap-like compound is discharged under pressure into the pipe connected to the mixing J chamber. The controls will be fitted for remote monitoring. DESIGN CRITERIA The centralized RUCK CFT system is designed for a design flow of 9, 240 gallons per day. OPERATIONAL PROCEDURES The system is designed to run mostly unattended. The sewage pump controls are mounted inside the small service building. The control panel for the dosing chambers and the mixing tank are mounted in the small service building. All controls have hourmeters on the panels . All controls will have remote sensors for daily readings . The influent and effluent points in the flow will have remote flow and pH sensors . Readings will be collected electronically daily. The carbon source is in the rear of the small service building. A chemical feed pump will dose the soap like compound from 55 gallon drums to the mixing chamber. The carbon pumps are controlled by a series of electrical relays . There are settings in the interior of the control box which have been set by the engineer. These controls normally will not be altered except by the engineer. If the final effluent contains elevated levels of BOD, then the carbon pumps may need to be adjusted. The fresh water pumps draw fresh water from a tank and flushes the soap like compound into the mixing chamber. A spare Chemical feed pump is kept on hand. A spare 55 gallon drum of carbon source is kept on hand. SEPTAGE REMOVAL The initial anoxic chambers are 10, 000 gallon septic tanks . The depth is 11 feet deep. In the initial tank, when sludge reaches 5 feet deep or half the liquid depth, the tank should be pumped. All septage pumping and hauling shall be performed by a licensed septage hauler. The tank should not be pumped dry but two inches of effluent should be left in the bottom of the tank. The septage is expected to be disposed of at the Municipal Treatment Plant . The other tanks should be checked annually. whenever the depth of sludge approaches the four feet depth or half the liquid depth, the tank should be pumped. The same procedures described above applies to the other tanks . e The septage hauler must file a report with the Board of Health and DEP. The report shall include the following: 1 . Date 2 . Amount pumped 3 . Pumping Service 4 . Location of the plant at which the septage was dumped The residential association shall pay the hauler. PERSONNEL Initially, the operators will be Thomas Karalekas and Timothy Santos of Holmes and McGrath, Inc . Mr. Karalekas and Mr. Santos are Municipal Grade 2 Certified Operators . RECORDS AND REPORTS Copies of all tests will be forwarded to DEP and the Barnstable Board of Health. Copies will be kept for three years . OWNERSHIP of the Treatment Works The subdivision is a cluster subdivision. A Homeowners Association will be established. The Final Documents creating the Homeowners Association will be prepared and fil-ed with the Department prior to final application. The documents will be prepared to meet the requirements of the Department policy entitled "Private Sewage Treatment Facilities for Multiple Lot Residential Lots" as most recently revised. The Homeowners Association will own the treatment works, the collection system and all appurtenances . There will be suitable established financial accounts and budgets for the continued maintenance and operation of the system. This Trust shall be known as BAILEY REALTY TRUST (the "Trust") and is .-intended to be.a nominee trust, so-called;.for federal and state income tax purposes and to hold,the record legal title to the Trust Estate and perform such functions as are necessarily incidental thereto. SECTION TWO TRUSTEES 2.1. In the event that there are.two.Trustees, ANY ONE TRUSTEE may execute any and.all instruments and certificates necessary to carry out the provisions-of the Trust. In the event there.are more than two Trustees,ANY TWO TRUSTEES (except as otherwise provided in Paragraph 7.2), may execute such instruments and certificates necessary to carry out the provisions of the Trust.. 2.2. No Trustee shall be required to furnish bond. No Trustee hereunder shall be y liable for any action taken at the direction of the Beneficiaries, nor for any error of judgment nor for any loss arising out of any act or omission in the execution of the Trust so long as acting in good faith, but shall be responsible only for his or her own willful breach of trust. No license of court shall be requisite to the validity of any transaction entered into by the Trustees. No purchaser, transferee,pledgee, mortgagee or other lender shall be under any liability to.see to the application of the purchase money or of any money or property loaned or delivered to any Trustee or to see that the terms and conditions of this Trust have been complied with. Every agreement, lease, deed, mortgage,note or other instrument or document executed or action taken by the person or persons appearing from the records of the Registry of Deeds to be Trustees, as required by paragraph 2.1, shall be conclusive evidence in favor of every person relying thereon or claiming thereunder that at the time of such delivery or of the taking of such action this Trust was in full force and effect,that such execution and delivery or taking of such action was duly authorized, empowered and directed by the Beneficiaries. 2.3. Execution, delivery or recording of such certificate shall not be a condition.precedent-to the validity of any transaction of the Trust. SECTION THREE BENEFICIARIES 3.1. The term "Beneficiaries" shall mean the persons and entities listed as Beneficiaries in the Schedule of Beneficiaries and in such revised Schedule of Beneficiaries, from time to time hereafter executed and delivered as provided above and the respective interests of the Beneficiaries shall be as stated in such Sche dule. 3.2. Decisions made and actions taken hereunder(including without limitation, amendment of this Trust, appointment and removal of Trustees, directions and notices to Trustees and execution of documents) shall be made or taken, as the case may be, by all of the Beneficiaries. 2 r 3.3. Any Trustee may without impropriety become a Beneficiary hereunder and exercise all rights of a Beneficiary with the same effect as though he or she or it were not a Trustee. The parties hereunder recognize that if a sole Trustee and a sole Beneficiary are one and the same person,legal and equitable title hereunder shall merge as a matter of law. SECTION FOUR .POWERS OF TRUSTEES 4.1. The Trustees shall hold the principal of this Trust and receive the income therefrom for the benefit of the Beneficiaries and shall pay over the principal and income pursuant to the direction of all of the Beneficiaries and without such direction shall pay the income to the Beneficiaries in proportion to their respective interests: 4.2.- Except as hereinafter provided in case of the termination of this Trust, the Trustees shall have no power,to deal in or with the Trust Estate except as directed by all- of the Beneficiaries. When,as, if and to.the extent specifically directed by all of the Beneficiaries,the Trustees-shall have the.following powers: .4.2.L.-TQ buy..sell, convey,assign,mortgage or otherwise'dispose of all or any part of the Trust Estate and as landlord or tenant execute and deliver leases and subleases; 4:2:2 -To-execute and deliver notes for borrowing for the Beneficiaries; 4:2.3 To grant easements or acquire rights of easements and enter into agreements and:arrangements with respect to.the Trust Estate; 4.2.4. To endorse and deposit checks in an account for the benefit of the.. Beneficiaries.. (The Trustees shall not maintain bank accounts in the name of the Trust or Trustees unless specifically authorized to do so by the Beneficiaries; however, the Trustees may maintain bank accounts in the name of the Beneficiaries for any purpose authorized by the Beneficiaries.); and 4.2.5 To lend money to Beneficiaries and/or Trustees of the Trust. Any and all instruments executed pursuant to such direction may create obligations extending over any periods of time, including periods extending beyond the date of any possible 3 f termination of the Trust: A direction to the Trustees by the Beneficiaries may be by a Durable Power of Attorney. 4.3. Notwithstanding any provisions contained herein, no Trustee shall be required to take any action which will, in the opinion of such Trustee, involve the Trustee in any personal liability unless first satisfactorily indemnified. 4.4. Any persons extending credit to, contracting with or having any claim against the Trustees shall look only to the fimds and property of this Trust for payment of any contract,or claim, or for the payment of any debt,-damage,judgment, or decree, or for any money that may otherwise become due or payable to them from the Trustees, so that neither the Trustees nor the Beneficiaries shall be personally liable therefor. If any Trustee shall at any time, for any reason(other than for willful breach of trust),be held to be under any personal liability as such Trustee, then such"Trustee shall be held harmless and indemnified by the Benef ciaries,.jointly and severally;-against all_loss,costs, damage, or expense by reason of such liability. SECTION FIVE TERNIINATION, 5.1. This Trust may be terminated at any time by notice in writing from any Beneficiary,-.provided-that-'such termination shallbe effective only when a certificate thereof signed by the.Trustees, shall be recorded with the Registry of Deeds. Notwithstanding:any other provision of this Declaration of.Trust, this Trust shall terminate in any event NINETY.(90) years from the date hereof, if not earlier terminated by action of a Beneficiary. 5.2, In case of any termination of the Trust, the Trustees shall transfer and convey the specific assets constituting the Trust Estate, subject to any leases, mortgages, contracts or other encumbrances on the Trust Estate, to the Beneficiaries as tenants in common in proportion to their respective interests hereunder, or as otherwise directed by all of the Beneficiaries; provided, however, the Trustees may retain such portion thereof 4 as is in their opinion necessary to discharge any expense or liability, determined or contingent, of the Trust. SECTION SIX AMENDMENTS 6.1. This Declaration of Trust may be amended from time to time by an instrument in writing signed by all of the Beneficiaries and delivered to the Trustees, provided in each case that the amendment shall not become effective until the instrument of amendment or a certificate setting forth the terms of such amendment, signed by the Trustees, is recorded with the Registry of Deeds. SECTION SEVEN RESIGNATION AND SUCCESSOR TRUSTEE 7.1. Any Trustee hereunder may resign at any time by an instrument in writing signed and acknowledged by such Trustee and delivered to all remaining Trustees and to each Beneficiary.. Such resignation shall take effect on the later of the.date specified therein or the date of the recording of such instrument with the Registry of Deeds. 7 2: The.mental or physical in of a Trustee shall be determined by the successor Trustees designated hereunder or if there is more than one Trustee,by the other Trustees. Upon the recording of such instrument, the legal title to the Trust Estate shall, without the necessity of any conveyance, be vested in said succeeding or additional Trustee or Trustees, with all the rights,powers, authority and privileges as if named as an original Trustee hereunder. 5 7.3. In the evenf that there is no Trustee, either through the death or resignation of a sole Trustee without prior appointment of a successor Trustee or for any other cause, a - person purporting to be a successor Trustee hereunder may record in the Registry of Deeds an affidavit,under pains and penalties of perjury, stating that he or she has been appointed by all of the Beneficiaries a successor Trustee. Such affidavit when recorded together with an attorney's certificate under M.G.L. c. 183 Section SB, stating that such attorney has knowledge of the affairs of the Trust and that the person signing the affidavit has been appointed a Trustee by all of the Beneficiaries, shall have the same force and effect as if the certificate of a Trustee or Trustees required or permitted hereunder had been recorded and persons dealing with the Trust or Trust Estate may always rely without further inquiry upon such,an affidavit as so executed and recorded as to the matters stated herein. .SECTION EIGHT GOVERNING LAW 8.1. The proposed wastewater treatment system will require a Ground Water Discharge Permit be approved by the Department of Environmental Protection since the total flow on site exceeds 660 gallons per day. The proposed RUCK CFT denitrification wastewater treatment system has been designed as a shared system to provide tertiary treatment for the wastewater from the Edgewater Financial Group affordable residential development located on Cammett Way in Barnstable, MA. The quality of the final effluent is designed to be below 10 milligrams per liter of Total Nitrogen prior to discharge by the soil absorption system. The RUCK CFT shared system has a design flow of 9, 240 gallons per day. The final effluent is designed to meet the requirements of discharging less than 30 milligrams per liter of Biological Oxygen Demand and less than 10 milligrams per liter of Total Suspended Solids . These concentrations are the tertiary treatment standards for wastewater in a Zone II as defined by the DEP. All of the homes are connected by a sewer system to the RUCK CFT shared systems located on Parcel A. The sewer system consists of a gravity sewer line and manholes located in the road layout . The following briefly describes the proposed shared RUCK CFT system. The wastewater is piped to two anoxic tanks, each a 10, 000 gallon septic tank, located on Parcel A. After the anoxic tanks, there is a proposed 10, 000 gallon equalization tank. From the equalization chamber, effluent is pressure dosed on the top of two RUCK filters . Each of the two pumps doses the RUCK filters in an alternating fashion. The RUCK Filters are stratified, modified, vented sand filters . Four vents are installed over each RUCK filter. Three vents for each filter are at grade. One vent pipe for each filter is mounted on the small service building and ends above the roof. Once the effluent flows through the RUCK filter, the effluent is then piped to a mixing chamber. The mixing chamber is separated into three compartments . The first compartment has a recycle pump located in it, which will operate four times daily, recycling an eighth of flow each time back to the initial anoxic tank. The next compartment in the mixing chamber is where a carbon source is added. Once the carbon source is added to the RUCK effluent, denitrification starts . Denitrification occurs in the mixing tank as well as in the two detention tanks, which follow the mixing tank. These tanks are designed to provide an environment for maximum denitrification: From there the effluent flows to a intermediate dosing chamber where two pumps then alternately distribute the denitrified effluent to a polishing RUCK filter. The polishing RUCK filter is designed to add more denitrification and to lower final TSS and BOD to acceptable levels . After the polishing filter, the final effluent is pressure dosed to a series of seven trenches . The trenches are vented with a vent located three feet above the finished grade. Surface vents are proposed to be located at suitable locations to provide minimal visual impact . A small service building is proposed. The building will house the control panels and the carbon source, a soap like compound. The controls will be fitted for remote monitoring. The small service building will be half the size of a garage. SYSTEM MONITORING The Department of Environmental Protection requires that the RUCK CFT system be monitored daily for the following constituents; flow and pH. The system will be monitored monthly for BOD5, TSS, Total Solids, TKN, NO3-N, NO2-N, ammonia, sodium, Total Phosphorus as P, Dissolved Phosphorus, and yearly for Volatile Organic Compounds . Testing shall begin one month after the system is put into operation. The system shall be open to inspection and sampling by the Department of Environmental Protection and the local Board of Health at all times . 2 i Laboratory analysis of all samples and sample collection shall be done using methods approved by the Department of Environmental Protection or the local Board of Health. For each sampling event, samples shall be taken as follows: 1 . ) effluent from the anoxic chamber and 2 . ) effluent from the final dosing chamber. Samples from the anoxic chamber shall be taken 12" below the bottom of the scum layer such that none of the scum is collected in the sampling vessel . Any scum or other solids shall be filtered from a sample before nitrogen analysis is performed. Chain of custody documents shall be maintained for all samples and sample events. Laboratory results shall be provided to the Department of Environmental Protection and the Board of Health. OPERATION AND MAINTENANCE MANUAL The RUCK CFT system will be operated by a certified treatment plant Operator. A conventional operation and maintenance manual will be prepared that describes proper procedures for the successful performance of the RUCK CFT system located on Cammett Way for Edgewater Financial Group in Barnstable, MA. The manual will include the component manufacturer's instructions and maintenance procedures in the manual . The manual will describe operating steps and necessary maintenance of the various components of the system. The manual will include the following sections: 1 . A description of the system 2 . A list of critical telephone numbers. 3 . A description of the computerized controls . 4 . A description of the spare parts needed to be kept on hand 5. A detailed description of methods to check the various components of the system including checks of the sludge depths in the anoxic chamber. 6. A procedure on testing procedures . 7 . A procedure for cleaning parts, such as the soap feed. 3 w 8 . A procedure for arranging for periodic pumping of the components as required. 9. Detailed instructions on reporting requirements . 10. A description of the logs of maintenance and testing events . 11 . A safety plan. The operating and maintenance manual will be completed in draft form when the plans are submitted to the Board of Health. HOMEOWNERS FACT SHEET Each lot owner will be distributed a fact sheet describing the treatment system serving their house and information with respect to each owner' s responsibilities with respect to wastewater treatment . Those responsibilities are similar to the to the responsibilities every homeowner should observe for a conventional Title 5 system. The fact sheet will include the paragraphs dealing with the disposal of materials into the system. For illustration purposes, the following would be typical : "Do not dispose of non-biodegradeable materials such as sanitary napkins, disposable diapers, and other such material into your system. You should not dispose of cooking oil, fat, or grease in your system. " "The system is not designed to treat cleaning solvents, pesticides, acids, disinfectants, gasoline, oils, and kerosene. The system is not designed to accept waste from a garbage disposal. " The system has not yet been submitted to DEP. We will submit the plans to DEP for conceptual approval of the process. this system is duplicative design of the RUCK CFT system at lunenburg MA. that system operates under a Ground Water discharge Permit. the design flow in Lunenburg is 12, 500 gallons per day. Jansson, Chairman Town of Barnstable Zoning Board of Appeals 230 South Street Hyannis, MA 02601 RE: Chapter 40B/Off of Cammett Way, Marstons Mills Dear Mr. Jansson: The Town of Barnstable Board of Health held a public meeting on February 20, 2001 and reviewed the proposed 29 single family home Chapter 40B project, to be located off of Cammett Way, Marstons Mills. The Board of Health members expressed serious concerns about the lack of financial planning and financed ability to replace the septic system and RUCK components, when/if the system fails or when/if the discharge fails to'meet the Wastewater Discharge permit effluent standards. Also, the proposed density greatly exceeds that which is normally allowed with the groundwater and well protection district. As you are aware 87 bedrooms are porposed on only 7.8 acres of land. The applicant has applied for a groundwater 1 discharge permit from the Massachusetts Department of Environmental Protection to construct Ruck System at this site.
