Dear Mrs. Ojala:
You are granted variances to install an onsite sewage disposal system at 52
Hallets Lane, Marstons Mills.
,The variances granted are as follows.-
Part XI, SECTION 12.00: To it-8tall a private drinking water well only 120 feet
away from an abutter's leaching facility.
Part XI, SECTION 12.00: To install a private drinking water well only 132 feet
away from an onsite sewage disposal system'
These variances are granted the following conditions.
(1) The floor plans shall be revised to show a five (5) feet opening, without
any doors, to the "loft office."
(2) No more than two (2) bedrooms are authorized. Dens, study rooms,
finished attics, sleeping lofts, and similar rooms which afford privacy are
considered bedrooms according to MA DEP.
(3) The septic system shall be installed in substantial accordance's with the
submitted plan dated January 29, 2001.
(4) The applicant shall record a property worded deed restriction at the
Barnstable County Registry of Deeds, restricting the property to two (2)
bedrooms maximum. A copy of the recorded deed restriction shall be
submitted to the Public Health Division works construction permit.
(5) The existing cesspools shall be removed or collapsed and filled with clean
sand.

These variances were granted because there is no reasonable area on this lot
where the required 150-feet separation (between a well and leaching facility)
could be met. The existing dwelling will be razed and cesspools will be filled or
removed. There is no increase in the wastewater discharge flow proposed.

As I told you in our prior telephone conversation,. we cannot close on this

restriction until after we have a building permit and have purchased the property.

Dear Board Members:

The enclosed is a request for a variance from the local regulation Part XII, Section
III (12) -well to leaching facility setback regulation, requiring 150' separation
permits distance between private wells and leaching facilities.
The following variance is requested: reduction in separation between proposed
(locus') leaching facility and proposed (locus')well (150' to 132') and reduction in
separation between existing abutting leaching facility and proposed (locus')well
(150' to 120').
Due to site constrictions (size of lot, lay of the land, presence of abutting wells and
septic systems and proximity to wetlands), there is no reasonable area on the lot
where the 150' separation between well and leaching facility can be met. The
existing dwelling will be razed and cesspools fille&removed with a new 2 bedroom
Title 5 system proposed in its place. There is no increase in the number of
bedrooms over what exists.
We feel that by granting this variance, the same degree of environmental protection
can be attained without the need for strict adherence to the Barnstable Board of
Health Well Protection Regulation.

You are granted variances to install an onsite sewage disposal system at 52
Hallets Lane, Marstons Mills.
The variances granted are as follows:
Part XI, SECTION 12.00: To install a private drinking water well only 120 feet
away from an abutter's leaching facility.
Part XI, SECTION 12.00: To install a private drinking water well only 132 feet
away from an onsite sewage disposal system:'
These variances are granted the following conditions:
j (1) The floor plans shall be revised to show a five (5) feet opening, without
any doors, to the "loft office."
(2) No more than two (2) bedrooms are authorized. Dens, study rooms,
finished attics, sleeping lofts, and similar rooms which afford privacy are
considered bedrooms according to MA DEP.
(3) The septic system shall be installed in substantial accordance's with the
submitted plan dated January 29, 2001.
(4) The applicant shall record a property worded deed restriction at the
Barnstable County Registry of Deeds, restricting the property to two (2)
bedrooms maximum. A copy of the recorded deed restriction shall be
submitted to the Public Health Division works construction permit.
(5) The existing cesspools shall be removed or collapsed and filled with clean
sand.

These variances were granted because there is no reasonable area on this lot
where the required 150 feet separation (between a well and leaching facility)
could be met. The existing dwelling will be razed and cesspools will be filled or
removed. There is no increase in the wastewater discharge flow proposed.

Dear Board Members:

The enclosed is a request for a variance from the local regulation Part XII, Section
III (12) -well to leaching facility setback regulation, requiring 150' separation
permits distance between private wells and leaching facilities.
The following variance is requested: reduction in separation between proposed
(locus') leaching facility and proposed (locus') well (150' to 132') and reduction in
separation between existing abutting leaching facility and proposed (locus') well
(150' to 120').
Due to site constrictions (size of lot, lay of the land, presence of abutting wells and
septic systems and proximity to wetlands), there is no reasonable area on the lot
where the 150' separation between well and leaching facility can be met. The
existing dwelling will be razed and cesspools filled/removed with a new 2 bedroom
Title 5 system proposed in its place. There is no increase in the number of
bedrooms over what exists.
We feel that by granting this variance, the same degree of environmental protection
can be attained without the need for strict adherence to the Barnstable Board of
Health Well Protection Regulation.
