The variances granted are as follows: 310 CMR 15.211: The soil absorption system will be located five (5) feet away from the side property line, in lieu of the ten (10) feet minimum separation distance required. 310 CMR 15.248: No reserve area provided as required. Section 397-2, Town of Barnstable Code: The soil absorption system will be located 106 feet away from an onsite private well, in lieu of the 150 feet minimum separation distance required. The variance is granted pending the following: *Soil evaluations and percolation tests shall be conducted in the proposed disposal area in compliance with the "Emergency Construction Notes" described on the submitted plan and four feet of continuous suitable soil shall be found.
