Dear Mr. Wilke:
The four (4) underground fuel storage tanks located at 905 Route 6A West Barnstable are
constructed of only single-wall steel and a twenty-six (26) years of age. Many tanks begin
corroding and leaking at only age 19. Therefore, it is imperative that you empty the
contents of these underground fuel storage tanks as soon as possible.
You are directed to hire a licensed hazardous waste hauler to pump-out the entire contents
of each and every underground fuel storage tank within seven (7) days of your receipt of
this letter. Please submit pumping receipts and disposal manifests to the Public Health
Division office, 367 Main Street, Hyannis.
Failure to comply with an order of the Board of Health may result in penalties as described
in the Board of Health Regulation regarding Fuel and Chemical Storage System, Part III,
Section 1.00.
Please be advised the tanks which are abandoned for more than six (6) months must be
removed. This order, when signed by the Director of Public Health, Thomas McKean,
shall constitute as an order of the Board of Health.

2 .17 ADDITIONAL PROVISIONS:
a, Performance by Buyer under this agreement is
contingent upon an affirmative vote of the
Barnstable Town Council authorizing the purchase of
the land described herein and appropriating the
purchase price therefor.
b. Seller represents and warrants to the Buyer that, to the
best of Seller's knowledge, information and belief, that
any release of hazardous materials or oils, from or near
the premises ("hazardous materials, " "oil." and "release"
as defined by Chapter 21E) have been eliminated from the
premises in accordance with all federal, state and local
environmental regulations.
Seller agrees to make available any and all documentation

it has relative to said cleanup.
Performance by Buyer under this agreement is contingent
upon the premises being in conformance with all
environmental regulations. If required by Buyer, Seller
agrees to allow Buyer access to the premises to conduct
appropriate testing for hazardous materials.
C. Seller agrees that Buyer may hold a small amount of the
proceeds, not to exceed $500 .00, in escrow pending
issuance of the 'FY2000 real estate tax bill in order
to make the tax adjustment outlined in paragraph 2 .5.

There were no records for 970 Main Street in West Barnstable.

Re: Underground Storage Tank Closure Report

Dear Mr. Wilke:
REW Environmental Consultants, Inc. (REW) has completed an Underground
Storage Tank (UST) Closure Report for the property formerly known as Sullivan -
Tire and located at 905 Main Street in West Barnstable, Massachusetts.
Pursuant to your request, REW agreed to oversee the removal of five
underground storage tanks, evaluate soil conditions and prepare a closure report
according to the Massachusetts Department of Environmental Protection (DEP)
Guidance Policy WSC-402-96, "Commonwealth of Massachusetts Underground
Storage Tank Closure Assessment Manual." This letter report is a synopsis of
the work performed and includes protocols of assessment procedures, our
observations of soil conditions, soil screening and soil chemical analyses as well
as conclusions and recommendations derived from the data collected at the time
of removal.
Property Conditions
Improvements at the property before implementing this project primarily
consisted of two wood-framed buildings, five underground storage tanks, a
hydraulic lift, a pump island along with various utilities that supported former
operations of Sullivan Tire.
Reportedly, the operations of Sullivan Tire included retailing tires, automobile
repair, and gasoline sales. Underground storage tanks in use during their
operations included three gasoline tanks, one waste oil tank and one hydraulic
oil reservoir tank. Figure 1 illustrates the location of the underground storage
tanks and buildings with respect to an orientation with Main Street.
Tank Removals

On March 6, 1997, Mike's Petroleum Service and Franklin Environmental
Services proceeded with removing the tanks as planned. Present were three
members of the Barnstable Fire Department: Chief Jenkins, Lieutenant Standish,
and Firefighter Paananen; two members of the Barnstable Board of Health; and
Barnstable Health Inspector, Donna Z. Miorandi.
Following is a general description of each tank upon removal:

Gasoline Tanks 6,820 Gallon There was no observable corrosion,
pitting, cracks or holes on the outer
surfaces. There was no evidence of
leakage.
Waste Oil Tank 60 Gallon There was no observable corrosion,
pitting, cracks or holes on the outer
surface. However, there was visible
staining on the exterior surface.
Hydraulic Oil Tank 25 Gallon There was no observable corrosion,
pitting, cracks or holes on the outer
surfaces. There was no evidence of
leakage.
Attached hereto as Addendum A is a copy of the Field Notes entitled
"Underground Storage Tank (UST) Removal/Closure" containing information
about equipment use, tank conditions, permits, transportation and disposal of
materials and waste materials along with other relevant information with respect
to this project.
Soil Head-Space Screening
REW collected soil samples along the side walls and bottoms of each tank grave
and at 20 foot intervals along the distribution and service lines between the
gasoline tanks and pump island. We also collected soil samples below the
former gasoline pumps and from soil stockpiled by Mike's Petroleum Service.
REW collected the samples to evaluate for the presence of volatile hydrocarbons
using a phtoionization detection instrument (PID).

The methodology which REW employed for headspace analysis followed
standard industry practices and protocol for placing soil samples into glass jars
sealed with tin-foil and screw covers, warming each sample to ambient
temperature, then agitating the samples to disturb volatile gases within the soil
pore space, then allowing the samples to equilibrate. REW recorded relative
HNu responses from the headspace of each sample, using a HNu Meter (Model
HW-101) equipped with a 10.2 electron volt (eV) lamp, by inserting the HNu
Meter probe through the tin-foil. Based on the highest headspace readings
and/or meter response, we submitted representative soil samples from each tank
grave for analysis.
REW screened 20 soil samples using the methodology described. Base
samples from the tank grave of the gasoline tanks represent conditions within the
capillary fringe and saturated zone. Base samples from the tank graves of both
the hydraulic reservoir and waste oil tank represent conditions above the
capillary fringe. A deeper excavation would potentially cause damage to the
existing building foundation.
The overall headspace response ranged from 3 ppm to 62 ppm after calibrating
to background. Figure 2 illustrates the sample locations for headspace
screening efforts. Attached hereto as Addendum B is a copy of the Field Notes
providing meter responses to soil sample headspace.
Soil sample headspace response indicates relatively low levels of volatile
compounds present. Although headspace response appears relatively low for
the soil samples obtained from the hydraulic and waste oil tank graves, we
consider these results to be unreliable for evaluating contamination given the low
volatile nature of the liquids. In light of this, there were no responses exceeding
the reporting thresholds of 100 ppm.
Soil Management and Backfilling
Mike's Petroleum Service placed the initial cover material from the top portion of
each tank back in the original location. There was no stockpiling of soil for
disposal under this project.
Laboratory Results
The soil chemical profile indicates relatively low levels of gasoline constituents
present in the tank grave for the gasoline tanks. Based on analyses, detectable
levels of ethybenzene and xylene did not exceed State reporting thresholds.
There were no detectable petroleum hydrocarbons or polyaromatic hydrocarbon
compounds above the method detection limit in the soil of the hydraulic reservoir
tank grave. In the soil of the waste oil tank grave there were however, detectable

levels of petroleum hydrocarbon (PHC) at 16,000 mg/kg and detectable levels of
polyaromatic hydrocarbon (PAH) compounds at 12,104 µg/kg (total). PHC
exceeds the State reporting threshold. Of the PAH compounds detected, 2-
methynaphthalene . and tetrachloroethane also exceed State reporting
thresholds.
Tabulated as Table 1 are the analytical results of the soil samples. Attached
hereto as Addendum C are the laboratory reports for the above analytical.

Conclusions
Pursuant to the project scope, REW has completed a tank closure assessment
for the property located 905 Main Street in West Barnstable, Massachusetts. On
the basis of our work, the following conclusions are drawn:
Soil conditions in the grave of the gasoline tanks exhibits.evidence
of contamination at low levels; not exceeding the State reporting
threshold and is below State cleanup guidelines. Soil
contamination is probably related to past overfills when the tanks
were in use.
Chemical analysis of soil from the grave of the hydraulic reservoir
indicates no contamination.
Soil conditions in the grave of the waste oil tank exhibits evidence
of petroleum hydrocarbon contamination above State reporting
thresholds. The State requires reporting within 120 days of having
knowledge.
Recommendations
On the basis of our work, we providing the following recommendations to
achieve potential closure at 905 Main Street in West Barnstable, Massachusetts:
Assess soil conditions in and around the grave of the waste oil tank
to delineate the extent of contamination. If the conceptual volume
of impacted soil is less than 100 yards, you should implement a
"Limited Removal Action."
Groundwater should also be assessed to evaluate the impact to
groundwater quality and to achieve complete closure.
The delineation and limited removal action should be implemented
within and before the 120 day State notification period. If we can
achieve cleanup before this deadline, you can avoid notification
and State closure fees.

Dear Mr. Wilke:
REW Environmental Consultants, Inc., (REW) is submitting a proposal with
conceptual costs to delineate petroleum-contaminated soil in the grave to the
former waste oil tank at the subject property. As conveyed to you in the closure
report, soil chemical analysis from the tank grave indicates petroleum
contamination at levels exceeding State reportable thresholds. The
Massachusetts Department of Environmental Protection requires reporting within
120 days of having knowledge except when cleanup reduces contaminants
below the reportable threshold within said time-frame. State Regulation allows a
Limited Removal Action (LRA) to achieve the cleanup by allowing the removal of
up to 100 yards of petroleum-contaminated soil.
We are proposing to delineate the extent of petroleum-contaminated soil,
remove it, and complete the dispose of it within the 120 day criteria. As
requested, we plan to utilize Mike's Petroleum Services of Sandwich,
Massachusetts for the excavation. Mike's Petroleum Services will excavate and
stockpile the soil for disposal purposes. The delineation of the contaminant
extent will be through test pits performed by Mike's Petroleum Services. REW
will analyze the base of the tank grave to evaluate the level of cleanup. We will
attempt to remove the impacted area by waste oil and stockpiule the soil on the
property for latter disposition.
Please note: Contamination appears to be limited to the tank grave of the waste
oil tank. However, the location of this grave is adjacent to the foundation
footings of the on-site dwelling. REW cannot except responsibility for the
integrity of this dwelling. Our role under this work scope is strictly to provide
guidance in the evaluation of,the soil to achieve a level of no significant risk and
have no control in the operation of the machinery. Your involvement with respect
to the excavation and the integrity of the foundation and/or coordination with
Mike's Petroleum Services will be necessary.

conceptual costs to conduct an Initial Site Characterization at the subject
property. This characterization conforms with the minimum requirements of the
Massachusetts Contingency for obtaining site information with respect to uses
and previous uses. The site characterization being proposed will collect data
relative to the following:
Hydrogeologic Characteristics
The Phase I Report shall include details of subsurface investigations conducted
at the disposal site, together with a preliminary or generalized description and
depiction of site hydrogeologic conditions, including:
1. a concise description of relevant geologic, hydrologic,
geophysical and other subsurface investigations and assessments
conducted to date at the disposal site;
2. documentation on boring advancement, well construction and
well development, including copies. of well drilling logs, within or
appended to a Report;
3. a characterization of general site topography, including slope,
presence of bedrock outcrops and surface drainage features;
4. a characterization of geologic and stratigraphic conditions,
including soil type(s), stratigraphy and evidence of filling or waste
disposal; where appropriate, the known or estimated depths to, and
description of, bedrock; and
5. a description and graphical depiction of groundwater flow
direction or potentiometric surface elevations, indicating the
location of monitoring wells.
Nature and Extent of Contamination.
The Report will provide information on the nature and extent of contamination, as
.determined by the Site investigation activities and preliminary response actions
undertaken to date at the disposal site, including:
1. evidence of releases of oil and/or hazardous material to the
environment including visual and olfactory evidence, results of field
screening and laboratory analysis, and historical knowledge;
2. the names, concentrations, and volumes (if applicable) of
released oil and hazardous material detected to date at the
disposal site:
3. laboratory data sheets, included in an appendix to the
Report;
4. information and details on the approximate horizontal and
vertical extent of contamination based on best available
information, as obtained from the site investigation of scope and
which commensurate with release and site conditions; and
5. Jnformation and details on the presence and thickness of
.non-aqueous phase liquids, if encountered.
Migration Pathways and Exposure Potential.
The Report will describe and evaluate known and potential contaminant
migration pathways and exposure points, to the extent that such information is
known, including:
1. evidence of and the potential for oil and/or hazardous
material migration by one or more of the following pathways:
a. air;
b. soil;
C. groundwater, including migration along preferential flow
pathways; and/or
d. surface water, including sediments;
2. a discussion of known and potential human exposure to oil
and hazardous material present at the disposal site, by inhalation,
dermal contact or ingestion of contaminants; and
3. a discussion of known and potential impacts of oil and
hazardous material present at the disposal site to environmental
receptors, with special attention given to the natural resource areas
referenced in the MCP.
Evaluation for Immediate Response Actions.
The Report will include an evaluation of the need to conduct an Immediate
Response Action, as described in 310 CM 40.0412.
Conclusions.
The Report will include a Conclusions containing a summary of findings and
statement with respect to the site conditions, and will indicate the outcome of
Initial Site Investigation Activities, as documented in the Report, and as
described in 310 CMR 40.0486.

The four (4) underground fuel storage tanks located at 905 Route 6A West Barnstable are
constructed of only single-wall steel and a twenty-six (26) years of age. Many tanks begin
corroding and leaking at only age 19. Therefore, it is imperative that you empty the
contents of these underground fuel storage tanks as soon as possible.
You are directed to hire a licensed hazardous waste hauler to pump-out the entire contents
of each and every underground fuel storage tank within seven (7) days of your receipt of
this letter. Please submit pumping receipts and disposal manifests to the Public Health
Division office, 367 Main Street, Hyannis.
Failure to comply with an order of the Board of Health may result in penalties as described
in the Board of Health Regulation regarding Fuel and Chemical Storage System, Part III,
Section 1.00.
Please be advised the tanks which are abandoned for more than six (6) months must be
removed. This order, when signed by the Director of Public Health, Thomas McKean,

Charlotte Stiefel, UST Coordinator, Barnstable County Health and
Environmental Department, requested EPA's assistance in obtaining
compliance regarding underground storage tanks- at Sullivan
Gasoline Station, 905 Main Street, W. Barnstable, MA, currently
doing business as Cape Discount Tire. A letter regarding this
case had been sent to the State Fire Marshall's Office by the
Town of Barnstable Health Department. (See attachment. )
In response to this request, a preliminary leak detection
inspection was conducted on August 11, 1993 at the Sullivan Gas
Station to determine the compliance status of the tanks, by
Jonathan Walker, U.S. EPA, Boston, accompanied by Charlotte
Stiefel, Barnstable County Health and Environmental Department,
and myself. This inspection consisted of a brief interview with
Mr. Arthur Sullivan, owner of the property and preliminary
observations regarding the current use of the site, which are
discussed below.
Since Mr. Sullivan did not have his measuring stick on the
property and was busy with tire customers at the time, we were
unable to conduct a full inspection.- Consequently, we decided to
postpone the full inspection until a later time when Mr. Sullivan
would be more prepared to meet with us.
Prior to 1988, the property was a Citgo Oil gasoline station with
three 10, 000 underground storage tanks. We observed what
appeared to have been a concrete island for 2-3 pumps/dispensers
which was now used for a vegetable produce stand. We also
observed that the pump pipes for the dispensers had been capped;
and the vent piping remained.
According to Mr. Sullivan, there are .currently three/6,280 gallon
capacity underground storage tanks on the property. He believes
that there are less than 300 gallons total gasoline left in the fcSTO9

product remaining in each tank to verify this, which he was
unable to do since he did not have a measuring stick on the
property, as previously stated.
According to EPA regulations (40 CFR Parts 280), temporary
closure of tanks where more than 2" of product remains in the
tanks require the owner/operator to conduct monthly leak
detection monitoring. Mr. Sullivan's tanks most likely contain
less than 2" each.
Mr. Sullivan informed us of a 21E site assessment which was
conducted at the facility by potential buyers in 1988. He
referred us to Bruce McGreggor, Sun Transportation Corp.,.
Hyannis, MA and Bill Conboy, J. P. Noonan Oil Co., Bridgewater,
MA. I contacted Mr. Conboy who faxed this information to the EPA
Boston office. (A copy of the 21E preliminary site assessment is
enclosed.) Based on our review of this information and our
interview with Mr. Sullivan, we are inclined to believe tha
tanks do not contain more than 2" of product each.

During our site visit on Tuesday,September 14, 1993,you were made aware that you are
required to notify the Commonwealth of Massachusetts and the Fire District of West
Barnstable of the existing underground storage tanks on the property of 905 Main Street
West Barnstable,MA.
Please complete the form F.P. 290 and return form 1 to the Commonwealth of
Massachusetts and form 2 to the West Barnstable Fire District by September 24, 1993.
Returning the completed F.P.290 satisfies the requirement of notification of underground
storage tanks.
According to fire department records and our conversation,the underground storage tanks
have also not been tested. Tank tightness testing is required by state regulation 527 CMR
9.05F. The tanks at 905 Main Street,West Barnstable,MA are required to be tested for
tightness immediately.
The underground storage tanks at 905 main Street West Barnstable are considered
abandoned tanks reference 527 CMR 9.02(1). Accordingly these tanks shall be removed
from the ground and disposed of at an approved tank dismantling yard six months after
they have been taken out of service at a licensed facility (527 CMR 9.07H&M.G.L.c.148
§ 38H).

I am writing to request your help in gaining compliance
regarding underground fuel storage tanks at a gasoline
station located at 905 Main Street, West Barnstable.
The owners of the property are Marcia Sullivan and Sullivan
Family Trust. Allegedly one of the members of the Trust is
Mr. Elliott Wilke. The station is doing business as Cape
Discount Tire.
The Barnstable Health Department ordered Mr. Arthur Sullivan
to register the tanks. He refused to register his
underground fuel tanks, he refused to test the tanks for
tightness, and he refused to remove these tanks. The tanks
have been abandoned for more than two (2) years. As of this
date, the pumps have been removed, but not the tanks.
In addition, I requested information from Chief Jenkins of
the West Barnstable Fire Department. I received no response
regarding this matter.
According to inspection records, the tanks were installed in
1927 . Chief Jenkins stated to Health Inspector Donna
Miorandi, that the tanks were installed in 1971. Also, Mr.
Sullivan indicated to Donna Miorandi that the capacity of
the tanks are only 40,000 gallons.

The property owned by you located at 905 Main Street, West
Barnstable, was inspected on December 10, 1991 by Edward
Barry, Health Inspector for the Town of Barnstable, because
of a complaint. The following violations of the Town of
Barnstable Board of Health Nuisance Control Regulation
Number One Regulation and the State Sanitary Code II was
observed:
410.602: Many used tires, piled and stored on the ground
outdoors behind the building and adjacent to the
building.
You are ordered to correct this violation within ninety (90)
days of receipt of this notice by removing the tires from
the site and transporting them to an approved facility
within 90 days. Also, you shall submit a written plan or a
written contract which indicates where the tires will be
disposed of. The written plan shall be submitted to this
Health Department within fourteen (14) days of receipt of
this letter.
You may request a hearing if written petition requesting
same is received by the Board of Health within seven (7)
days after the date order is received. However, these
violations must be corrected regardless of any request for a
hearing.
Please be advised that failure to comply with an order could
result in a fine of not more than $500. Each separate day's
failure to comply with an order `shall constitute a separate .
violation.
You are also subject to a $25.00 ticket. Tickets will be
issued daily until the violations are corrected.

I am writing in response to your memo dated December 6, 1991.
RE: West Barnstable Trading Company
The Health Department mailed two certified letters to Ms.
Parris to two different addresses on December 12, 1991 and
December 13, 1991, ordering her to remove all the rubbish,
garbage and abandoned debris from the ground within 24
hours. To date, the certified letter receipt card has not
been received. Health Inspector Jerry Dunning will revisit
the site and monitor the situation.
RE: Route 6A Citgo Station - Tires
Health Inspector Edward Barry has been working with Arthur
Sullivan for several months regarding the tires. Enclosed
is a copy of his typewritten report and pictures. The
bottom line is that there are thousands and thousands of
tires piled there. The only potential health hazard is the
possibility of breeding mosquitoes in stagnant water which
may accumulate in the tires. There is also a fire hazard
due to the fact that once tires begin burning, they are very
difficult to extinguish. Mr. Sullivan claims he cannot
afford to dispose of them and he has filed bankruptcy.
Please advise to what extent enforcement action should be
taken against Mr. Sullivan for removal and legal disposal 'of,
the tires.
RE: Route 6A Citgo Station - Underground Fuel Tanks/Alleged
Hazardous Waste
Health Inspector Donna Miorandi inspected the Citgo Station,
Route 6A, West Barnstable. She did not observe any
violations regarding storage, disposal, and release of
hazardous materials.

However, the three 7000 gallon single wall steel tanks at
the site were installed in 1971 and have not been tested, as
required by EPA Regulations, and State Fire Regulations.
The Board of Health Regulation Regarding Fuel and Chemical
Storage Systems concerning testing of fuel tanks is less
stringent for commercial tanks than the State Fire
Regulations. The State Regulations were revised a few years
ago and require more frequent monitoring. Therefore, the
Health Department has only enforced the testing requirements
within this Board of Health Regulation for residential tanks
and the Fire Departments have agreed to strictly enforce the
testing regulations for commercial tanks. Please advise
whether the Health Department should request the West
Barnstable Fire Department to take action.
Also EPA Regulations require all commercial tank owners to
add leak detection in 1991 to tanks which were installed
between 1970-1974. These tanks were installed in 1971.
Also, corrosion protection and overspill protection is
required. The local Board of Health Regulation has no such
requirements. Please advise whether the Health Department
should request the EPA and West Barnstable Fire Department
to take enforcement action regarding corrosion protection
and overspill protection for the underground tanks at this
property.

I visited Cape Discount Tire at 11 :45 am on Dec.10,1991 and
spoke to the owner,Arther Sullivan,about the complaint.We discussed
the problems associated with used tires and the long time
concerns of the people in West Barnstable about the large piles
of used tires on the rear of his property.According to Arther
Sullivan there is no known disposal area where the tires can be
disposed of economically.He was for a short while able to truck
them to Maine but now that is not possible.
"Oxford Energy",Stafford Springs,CT. a million dollar plant to
burn tires is in financial difficulty.The only known plant in
New England that' is a la(ge user of used tires.(Info supplied by
Arther Sullivan)
Bass River Rod and Gun Club were thinking of taking about 5,000
tires for there new gun range but have decided to go with straight sand.
Arther said he is contact with Congressman Studds about possible
exporting them overseas?

property. Mr. Arthur Sullivan told me that the property was for sale and
possibly had a potential buyer. He stated that he was going to do some-
thing about disposing of the many tires that are stored on the property.
Mr. Sullivan stated that he holds permits for 41,000 gallons in fuel storage
and that there is product in the tanks and that he does plan on selling
gasoline. The Citgo station stores motor oil, antifreeze and windshield
washer. I observed no violations of hazardous waste storage.
I also visited with Chief John Jenkins of the West Barnstable Fire District
and he states that he observed the undergound tanks going in the ground in
1971 when he was the Deputy Chief and also working at the station pumping
gasoline. Chief Jenkins states that there are 3- 7000 gallon gasoline tanks
but as of this date they do not comply with any testing since they have not
had the tanks pressure tested.
Regarding the 5 year abandonment law-there is no such law. With regard to
storage facilities such as this one the regulation states that if the tanks
are abandoned they must be removed within 6 months of the date of abandon-
ment. Residential properties utilizing tanks for consumptive use must remove
their tanks within 24 months of abandonment.

I am writing in response to your memo dated December 6, 1991.
RE: West Barnstable Trading Company
The Health Department mailed two certified letters to Ms.
Parris to two different addresses on December 12, 1991 and
December 13, 1991, ordering her to remove all the rubbish,
garbage and abandoned debris from the ground within 24
hours. To date, the certified letter receipt card has not
been received. Health Inspector Jerry Dunning will revisit
the site and monitor the situation.
RE: Route 6A Citgo Station - Tires
Health Inspector Edward Barry has been working with Arthur
Sullivan for several months regarding the tires. Enclosed
is a copy of his typewritten report and pictures. The
bottom line is that there are thousands and thousands of
tires piled there. The only potential health hazard is the
possibility of breeding mosquitoes in stagnant water which
may accumulate in the tires. There is also a fire hazard
due to the fact that once tires begin burning, they are very
difficult to extinguish. Mr. Sullivan claims he cannot
afford to dispose of them and he has filed bankruptcy.
Please advise to what extent enforcement action should be
taken against Mr. Sullivan for removal and legal disposal of
the tires.
RE: Route 6A Citgo Station - Underground Fuel Tanks/Alleged
Hazardous Waste
Health Inspector Donna Miorandi inspected the Citgo Station,
Route 6A, West Barnstable. She did not observe any
violations regarding storage, disposal, and release of
hazardous materials.

However, the three 7000 gallon single wall steel tanks at
the site were installed in 1971 and have not been tested, as
required by EPA Regulations, and State Fire Regulations.
The Board of Health Regulation Regarding Fuel and Chemical
Storage Systems concerning testing of fuel tanks is less
stringent for commercial tanks than the State Fire
Regulations. The State Regulations were revised a few years
ago and require more frequent monitoring. Therefore, the
Health Department has only enforced the testing requirements
within this Board of Health Regulation for residential tanks
and the Fire Departments have agreed to strictly enforce the
testing regulations for commercial tanks. Please advise
whether the Health Department should request the West
Barnstable Fire Department to take action.
Also EPA Regulations require all commercial tank owners to
add leak detection in 1991 to tanks which were installed
between 1970-1974. These tanks were installed in 1971.
Also, corrosion protection and overspill protection is
required. The local Board of Health Regulation has no such
requirements. Please advise whether the Health Department
should request the EPA and West Barnstable Fire Department
to take enforcement action regarding corrosion protection
and overspill protection for the underground tanks at this
property.

On Wednesday afternoon I performed a brief on-site inspection of the above
property. Mr. Arthur Sullivan told me that the property was for sale and
possibly had a potential buyer. He stated that he was going to do some-
thing about disposing of the many tires that are stored on the property.
Mr. Sullivan stated that he holds permits for 41,000 gallons in fuel storage
and that there is product in the tanks and that he does plan on selling
gasoline. The Citgo station stores motor oil, antifreeze and windshield
washer. I observed no violations of hazardous waste storage.
I also visited with Chief John Jenkins of the West Barnstable Fire District
and he states that he observed the undergound tanks going in the ground in
1971 when he was the Deputy Chief and also working at the station pumping
gasoline. Chief Jenkins states that there are 3- 7000 gallon gasoline tanks
but as of this date they do not comply with any testing since they have not
had the tanks pressure tested.
Regarding the 5 year abandonment law-there is no such law. With regard to
storage facilities such as this one the regulation states that if the tanks
are abandoned they must be removed within 6 months of the date of abandon-
ment. Residential properties utilizing tanks for consumptive use must remove
their tanks within 24 months of abandonment.

and Other Lombard Property Concerns
#l. Wes Barnstable Trading Company. At your earliest
convenience but not later than December 19, 1991 please have
an inspection of this property by Mr. Geiler, Mr. DaLuz and
Mr. McKean concerning any violations of health, junk
ordinance and issue notice to correct. It is my
understanding that the referenced property has accrued
additional material for sale and is apparently unsightly.
#2 . The Police Department is requested to investigate and
remove overnight parking of trucks at the Route 149 railroad
station on Lombard property. It is alleged that the1�
vehicles park overnight without the permission of the :
Trustee. If vehicles are found trespassing officers are
requested to take appropriate action to correct the matter.
#3. The Health Department is requested to investigate
storage of tires on Lombard property behind the Citgo
station on Route 6A (property owned by Arthur Sullivan) .
The Department is also requested to consult with the Fire
Chief in Barnstable relative to underground fuel tanks an
the 5 year abandonment law. Immediate action is requested
to ensure enforcement of appropriate laws on the storage of
hazardous wastes on Lombard property without permission of
the Trustee. Response in this respect is anticipated no
later than December 19th.
