James Kauffman State Fire Marshall 1010 Commonwealth Avenue Boston, MA 02215 Re: Sullivan Gasoline Station Dear Mr. Kauffman: Charlotte S.tiefel, UST Coordinator, Barnstable County Health and Environmental Department, requested EPA's assistance in obtaining compliance regarding underground storage tanks at Sullivan Gasoline Station, 905 Main Street, W. Barnstable, MA, currently doing business .as Cape Discount Tire. A letter regarding this case had been sent to the State Fire Marshall's Office by the Town of Barnstable Health Department. (See attachment. ) In response to this request, a preliminary leak detection inspection was conducted on August 11, 1993 at the Sullivan Gas Station to determine the compliance status of the tanks, by Jonathan Walker, U.S. EPA, Boston, accompanied by Charlotte Stiefel, Barnstable County Health and Environmental Department, and myself. This inspection consisted of a brief interview with Mr. Arthur Sullivan, owner of the property and preliminary observations regarding the current use of the site, which are discussed below. Since Mr. Sullivan did not have his measuring stick on the property and was busy with tire customers at the time, we were unable to conduct a full inspection. Consequently, we decided to postpone the full inspection until a later time when Mr. Sullivan would be more prepared to meet with us. j Prior to 1988, the property was a Citgo Oil gasoline station with three 10, 000 underground storage tanks. We observed what appeared to have been a concrete island for 2-3 pumps/dispensers which was now used for a vegetable produce stand. We also observed that the pump pipes for the dispensers had been capped; and the vent piping remained. According to Mr. Sullivan, there are . currently three/6,280 gallon capacity underground storage tanks on the property. He believes that there are less than 300 gallons total gasoline left in the �s,oq three tanks. We asked Mr. Sullivan to take a measurement of thej� �9 J 66` T u c PRINTED ON RECYCLED PAPER s E product remaining in each tank to verify this, which he was unable to do since he did not have a measuring stick on the property, as previously stated. According to EPA regulations (40 CFR Parts 280) , temporary closure of tanks where more -than 2" of product remains in the tanks require the owner/operator to conduct monthly leak detection monitoring. Mr. Sullivan's tanks most likely contain less than 2" each. Mr. Sullivan informed us of a 21E site assessment which was conducted at the facility by potential buyers in 1988!. He referred us to Bruce McGreggor, Sun Transportation Corp.. , Hyannis, MA and Bill Conboy, J. P. Noonan Oil Co. , Bridgewater, _ MA. I contacted Mr. Conboy who faxed this information to the EPA Boston office. (A copy of the 21E preliminary site assessment is enclosed. ) Based on our review of this information and our interview with Mr. Sullivan, we are inclined to believe that the tanks do not contain more than 2" of product each. Therefore, we believe that the potential violations that exist at this property are: failure to notify and improper closure, which under our MOA with Department of Public Safety are handled by the MA. Fire Marshall's office. Since- this does not appear to be a leak detection violation, but may be a failure to notify and/or closure violation(s) , we are referring this information to your office. Box 490 Tewksbury, MA 01876-0490 Dear Mr. Mooney: I am writing to request your help in gaining compliance regarding underground fuel storage tanks at a gasoline station located at 905 Main Street, West Barnstable. The owners of the property are Marcia Sullivan and Sullivan Family Trust. Allegedly one of the members of the Trust is Mr. Elliott Wilke. The station is doing business as Cape Discount Tire. The Barnstable Health .Department ordered Mr. Arthur Sullivan to register the tanks. He refused to register his underground fuel tanks, he refused to test the tanks for tightness, and he refused to remove these tanks. The tanks have been abandoned for more than two (2) years. As of this date, the pumps have been removed, but not the tanks. In addition, I requested information from Chief Jenkins of the West Barnstable Fire Department. I received no response regarding this matter. According to inspection records, the tanks were installed in 1927 . Chief Jenkins stated to Health Inspector Donna Miorandi, that the tanks were installed in 1971.
