A person who constructs more than one home in a two-year period shall not be considered a homeowner. Such "homeowner"shall submit to the Building Official on a form acceptable to the Building Official, that he/she shall be responsible for all such work performed under the building permit. (Section.109.1.1) The undersigned"homeowner"assumes responsibility for compliance with the State Building Code and other applicable codes,bylaws,rules and regulations. The undersigned"homeowner"certifies that he/she understands the Town of Barnstable Building Department minimum inspection procedures and requirements and that he/she will comply with said procedures and requirements. Signature of Homeowner Approval of Building Official Note: Three-family dwellings containing 35,000 cubic feet or larger will be required to comply with the State Building Code Section 127.0 Construction Control. HOMEOWNER'S EXEMPTION The Code states that: "Any homeowner performing work for which a building permit is required shall be exempt,from the provisions of this section(Section 109.LI -Licensing of construction Supervisors);provided that if the homeowner engages a person(s).f6i hire to do such work,that such Homeowner shall act as supervisor." Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible: - To ensure that the-homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. On the last page of this issue is a form currently used by several towns. You may care t amend and adopt such a form/certification for use in your community. The Board of Appeals found .Feb...._._ .._-._........._..... . __._..._. ._. , Mr. Laird F resented his petition before the,Board and said that he resides in a small house on a private way and :he and :his wife- wish to construct a kitchen. addition in an area measuring 14ft. x 14ft. which is now a courtyard. The plan submitted with the filing was explained to the Board and Mr. Laird said that this is the�`only area in which -.the kitchen can reasonably.. be constructed. The only other alternative would be to lose one of tthe .bedrooms in their small home. The petitioner would also like to add a glassed-in, unheated porch to one side , of the existing dwelling The petitioner is seeking a variance to intrude into the frontyard setback by 3 ft. with the addition of the kitchen, and this would then leave 20 ft. from the frontyard property line instead of the required 30 ft.-: There -would be a 3 ft. intrusion into the sideyard setback with the addition .of the porch since this would be 12 ft. from the sideyard line rather than the re- quired 15 ft. This house is located at 26 Beale Way; does...not now conform to the frontyard setback .requirements and is legally non-conforming. No one spoke in favor of or in objection to the petition and the Board took the matter under advisement. - The Board voted unanimously to grant the .petitioners a variance from sideyard and frontyard setback requirements to allow the construction of a kitchen addition and glassed-in porch at 26 Beale Way, Barnstable in a residence F-2 zoning district. . The Board found that the shape of this lot determined the location of the proposed new construction and compliance with the requirements of Sec. 10 of Chapter 40A. M.G.I. and Sec. Q: 2(c) of the town's zoning by-laws relative to the granting of Board further found that allowing the new construction would a variance. The oa 9 upgrade this property and would not be detrimental to the neighborhood nor in derogation of the spirit and intent of the zoning by-laws.
