Many homeowners who use this exemption are unaware that they are assuming the responsibilities of a supervisor(see Appendix Q, Rules&Regulations for Licensing Construction Supervisors,Section 2.15) This lack of awareness often results in serious problems,particularly when the homeowner hires unlicensed persons. In this case,our Board cannot proceed against the unlicensed person as it would with a licensed Supervisor. The homeowner acting as Supervisor is ultimately responsible. To ensure that the homeowner is fully aware of his/her responsibilities,many communities require,as part of the permit application, that the homeowner certify that he/she understands the responsibilities of a Supervisor. The parcel which consists of 4.57 acres has been subdivided into three (3) lots. A proposed A/N/R Plan of those lots is enclosed herewith. (An earlier subdivision had been approved by the Barnstable Planning Board but the enclosed represents a somewhat modified A/N/R Plan). The subdivision creates three (3) separate lots each of which exceeds the minimum area required. When you reviewed the matter earlier this year you were of the opinion that my client would need to obtain a variance in order to maintain the existing wood dwelling shown on Lot 1. The dwelling constructed in 1920 is a pre-existing non-conforming structure because it does not meet the front yard setback requirement. At our hearing last night the Zoning Board of Appeals disagreed with your opinion. The Board believes that the structure can be maintained as a matter of right so long as Lot 1 meets the minimum lot size requirement and the structure continues to conform to the side yard setback. Thomas Perry Page 2 June 5, 2003 The Zoning Board of Appeals has asked me to request a letter from you conforming that you agree that the structure shown on Lot 1 on the enclosed plan may be maintained as a matter of right in that it will not'have lost it status as a lawful pre- existing non-conforming structure as the result of the subdivision.
