On or around 7/8/2019,1 received creditable evidence a violation of the Barnstable Zoning
Ordinance §240—41 Specifically, Obstruction of the view of a driver of a vehicle
Summary of Action to Abate Violation:
In order to abate this violation and to avoid further enforcement action by this office, commence
immediately upon receipt of this notice the following action: Remove all obstructions more than 3
feet in height above the plan of the established grade of the street including within the street lines at
points which are 20 feet in distance from their point of intersection measured along street lines.
And, if aggrieved by this notice and order, you may file an appeal with the Town Clerk of
Barnstable, specifying the ground thereof within thirty (30) days of the receipt of this order
(in accordance with Chapter 40A Section 15 of the Massachusetts General Laws). If, at the
expiration of the time allowed, action to abate this violation has not commenced, further
action as the law requires will be taken.

David Parrella was present for his application. Kelly Mortin and Anita & John Parker abutters to the
property were present at the meeting. Chair Anderson explained that they approved the demolition of
the green house with small building attached at last meeting. Mr. Parrella explained will be constructing
a 1600 square foot 3 bedroom Saltbox. He explained it will be wood roof and siding, simulated divided
light windows with grills in the inside and outside, black shutters, grey clapboard in front, and red brick
chimney. The building will be approximately in the same location as existing building — 10 feet off Bone
Hill Road and will meet zoning. Mr. Parrella explained they pruned a large elm tree in front of the house.
We will be putting a boxwood hedge in back patio. Anita Parker questioned the landscaping near the
driveway. Mr. Parrella explained that they removed two small trees to do a perk test. Pruned all the lilac
bushes and removed all the dead wood. Mr. Parrella stated will need to do some more pruning of the
trees. He explained in the front of the house will be doing some plantings. The stairs will be made of
reused granite. Mr. Parrella explained that the left of the driveway will be planting grass. He further
stated that will be making a gravel driveway. Mrs. Parker commented that there was a lot of shrubbery to
the south of the driveway that was taken out. Mr. Parrella stated that there was only a large pile of privet,
but not a hedge. Bearse clarified for the record that the pruning that has been done will be the only
shrubbery that you will remove, except anything dead you come upon. That no other trees will be cut
done and Mr. Parrella agreed. Bearse added that you will maintain the lilac bushes that are along 6A
and Bone Hill Road.
A motion was made by Nilsson and was seconded by Stahley that the OKH approves the
Certificate of Appropriateness for David & Cynthia Parrella at 15 Bone Hill Road to build a three
bedroom home with one car attached garage as submitted. So moved

Change of location of previously approved home site
Attorney Michael Ford, Edward Kelley and Peter Johnson were present to represent the applicants.
Attorney Ford stated what is before you is a request to relocate the house that was previously approved
by the Cape Cod Commission (CCC) at a different location on the same lot. The foundation on the new
location is already in. Attorney Ford explained that the Austin's went through a Hardship Exemption
application of the District of Critical Planning Concern (DCPC) level of the CCC. He further explained as
a result from that made a decision to relocate the house-to accommodate a request from the
Commission that the septic system be located as far as away from the pond as they could possibly
locate it. -The Commission staff was actually looking for it to be relocated 300 feet away from the pond.
Attorney Ford stated they wanted to keep the septic system in relation to the house, so that they would
not have to do a pump system. He explained that Mr. Kelley was familiar with the clay and topography of
site —so he recommended a_ynew design to have gravity feed system rather then a pump system.

The town found out the Old Kings Highway did not approve of this, and put a stop work order on i
Attorney Ford submitted a letter from the Applicants John Austin and Christine Froula. Chair Anderson
asked Attorney Ford if he wanted to read it into the record. Attorney Ford responded no that he wanted it
for the record and he already explained what was in the letter. Chair Anderson asked when you realized
that this had to be relocated —why didn't some come back and say before the foundation went in—we
feel it is a better location. Mr. Kelley responded that everyone was under the opinion that the CCC had
the last say. Chair Anderson stated that the CCC does not overrule the Old Kings Highway. Stahley
stated we have made it very clear in everyone of our meeting that if any substantial changes to the plan,
we would like those changes presented. He feels it was self- imposed hardship. Attorney Ford agreed
that they should have come back with the change.
