Good Morning Dennis,
I have received a complaint about the subject property and need to make you aware of it. The gate on the right
side of the front of the house is not secure. According to the complainant(a neighbor), the yard is overgrown with
weeds, there is a moldy smell coming from the house, and it is described as a disaster. some of these issues will
be addressed by the Health Department I require that the all gates are secure. I will be performing a property
inspection sometime this afternoon.
Any help you could provide is appreciated. If you are no longer providing services on this property please let me
know who is responsible.

I performed a property inspection at the subject address this afternoon (about 1:00, 10/15/15). My observations:
1.) The house is secure. All windows and doors are locked. No broken windows, no broken doors. The interior
of the
house, observed through the windows and doors, appears as though it may have been cleaned since a
previous visit.
2.) The pool fence is secure. The open "gate"to the right of the house is actually an open piece of privacy
fence. This
is not part of the pool enclosure.
3.) There is no trash in the yard.
Other non building issues:
4.) There is standing water on top of the pool winter/safety cover and vegetation is growing on or thru the safety
cover.
5.) There are weeds present on the property. Several small trees have fallen or are falling inside the right fenced
side
yard. The grass doesn't appear to be overly tall.
6.) Very few areas of peeling paint(observed on the pack area of the house). Most exterior paint is in
acceptable
condition.
7.) The only mold smell I noticed was near the sunroom on the back of the house. This area is partially open to
the
outside because of a screen door. Noticed a little smell from the large deck behind the house, in the fenced
back
yard.
Some issues may be the responsibility of the Health Department but may require Chapter 54 to be in force.
I have received an email from the company the maintains the property and they have stated that they will take
care of it right away. I do periodic inspections on nearly all the Foreclosed/Vacant properties in our town as time
permits, usually every month or two.

The foreclosed property is located at 151 Carriage Lane and, according to our records, is currently being serviced
by Wells Fargo Bank. An inspection last December by the building department revealed two violations which
were corrected in December. Our office sent an e-mail to Wells Fargo Bank on October 6, 2015 to ascertain the
bank's plan/intention to bring the property back to productive use. We have not heard back from Wells Fargo

I will supply the letter that you have requested. I do believe that I have answered the inquiry with the statements
in my last email to Dennis. Perhaps the bank finally read the REO letter from Ruth that was sent on March 18th,
20141
The property history: My first visit to the property was on February 10, 2014, as part of the follow up of the
properties that had been flagged and sent REO letters during December 2013. At that time the property was
occupied and I did not inspect it. There was a follow up REO letter sent via email on March 18,2014, by Ruth. My
second visit was on June 03, 2014. At that time the property was vacant and needed some attention to secure as
well as needing to be registered with the town under Chapter 224. 1 contacted the JDS Realty Group by phone (a
notice was on the front door) in an attempt to inform them of the banks responsibility to register. I emailed Dennis
from JDS on June 13, 2014, and included links to Ordinance Chapter 224 and Chapter 54. No registration was
received. I visited the property again on September 03, 2014, and posted a"Notice of Violation"which stated that
the property was in violation with TOB Ordinance Chapter 224. Later Dennis from JDS contacted me and we
talked/emailed about the need to secure the property (yard and pool). The Bank finally complied on November
10, 2014, by providing us with a registration and surety check. I visited the property again on November 24, 2014,
to see if it was secured. My email to Dennis on November 25, 2014, outlined what needed to be done. I received
an email from Dennis at JDS on December 01, 2014, requesting an inspection of the property. I inspected the
property on December 01, 2014 and emailed Dennis of JDS on December 1, 2014, approving the measures that
were taken and stated that"I believe that the property is now secured properly and in compliance with Chapter
224.
Will a short email be suitable or would you like a letter stating that the property is now compliant? Please let me
know so that I can get it to you today or Monday.

A property inspection on Wednesday, November 24, 2014 revealed the following violations:
The pool barrier has been compromised. The two obvious gates are locked but there is another
gate that is open and needs to be secured. Also, there are areas where the wood railing intersects
the metal fence and the space between them is greater than 4". I'm sure that these areas can be
secured with a little common sense.
Both gates into the fenced yard are wide open and the fence/gate intersection on the right side is
broken. It doesn't make sense to leave these gates wide open or the fence separated from the gate
because of the deteriorated decking on the back of the house. The property owner/mortgagee
should be aware of this.
These areas must be secured per the requirements of the Town of Barnstable Ordinance Chapter

A property inspection on Wednesday, November 24, 2014 revealed the following violations:
The pool barrier has been compromised. The two obvious gates are locked but there is another gate that
is open and needs to be secured. Also, there are areas where the wood railing intersects the metal fence
and the space between them is greater than 4". I'm sure that these areas can be secured with a little
common sense.
Both gates into the fenced yard are wide open and the fence/gate intersection on the right side is broken.
It doesn't make sense to leave these gates wide open or the fence separated from the gate because of the
deteriorated decking on the back of the house. The property owner/ mortgagee should be aware of this.
These areas must be secured per the requirements of the Town of Barnstable Ordinance Chapter 224.

There were two violations on the subject property:
1.) The registration and surety were not received on this property as required per
the town ordinance, Chapter 224, as of September 03, 2014.
2.) The swimming pool barrier was compromised and the yard was not secured.
Item 1 was complied with on November 17, 2014, when the registration and surety
were received and processed by me.
Item 2, An inspection of the subject property was requested by Dennis Oliveira of
JDS Realty Group on December 01, 2014 to confirm their compliance with
Chapter 224. 1 inspected the property and found the yard secured by locked gates
which also secured the pool area.
In summary, as of December 01, 2014, the subject property is in compliance with
Chapter 224 and no violations exist.
Periodic property.inspections continue after compliance with Chapter 224 on
Foreclosed or Vacant Properties to verify continued compliance with Chapter 224
and the Massachusetts State Building Code 780 CMR.

This letter serves as a follow-up to our previous contact with you regarding Wells Fargo's REO property
at;151 Carriage Lane, Barnstable MA that has been identified by the Distressed Property Identification
and Revitalization Program of the Massachusetts Attorney General. We are writing to determine what
your ongoing intentions are as to this property and when you expect it to return it to productive use.
Specifically, consistent with the requirements of Section 224-4 of the Code of the Town of Barnstable,
we request that you provide documentation no later than March 26,2014 of the following;
(a)Updated name, address and telephone number of the local entity or entities responsible for the
property, as registered with the Town under Chapter 224.
(b) Removal from the property,to the satisfaction of the Fire Chief, of hazardous material as that term is
defined in MGL c. 21 K, as that statute may be amended from time to time.
(c) Securing all windows and door openings to ensure that the building is secured from all unauthorized
entry continuously in accordance with the United States Fire Administration National Arson Prevention
Initiative Board Up Procedures or provide twenty-four-hour on-site security personnel on the property.
(d) Posting of"No Trespassing" signs on the property.
(e) Evidence that you are ensuring that structures are maintained in sound condition.

(f) Maintenance of lawns and shrubs free from excessive overgrowth.
(g) Maintenance the property in accordance with the Barnstable Zoning and General Ordinances. A
copy of Chapter 54 of the Town of Barnstable General Ordinances concerning the maintenance of

(h) Evidence that the property is being actively marketed for resale.
(i) Evidence of the maintenance of all fences around swimming pools or install fences as required by
Chapter 210 of the Barnstable General Ordinances and the maintenance of existing fences or install
fences around spas.
(j) Provision to the Fire Chief and Building Commissioner with the name, local address,telephone
number and e-mail address of a responsible person, who can be contacted in case of emergency and
cause the name and contact number to be marked on the front of the property as may be required by the
Fire Chief or Building Commissioner.
(k) Proof of liability insurance on the property to be furnished to the Building Commissioner.with a
copy of said certificate of insurance.
If you have properly filed your registration form and maintenance and security plan with the Building
Commissioner, as is required under Chapter 224,please provide a copy of same to this office. The only
