Bednark, has appealed to the Board of Appeals from a decision of the Building Inspector and petitions for a variance from Section J. Appendix A - Intensity Regulations - Barnstable Zoning By-Law as revised July 30, 1974, to allow construction of single family dwelling on lot with insufficient frontage and square footage at Chickadee Lane, Centerville in an RF-1 Zoning District. Attorney Robert J. Donahue represented Petitioner. Petitioner owns lots 44, 40, 39 and 38 on Exhibit Ct. Zoning District line runs almost through Petitioner's lot lines, so that lot 44 is conforming in a 20,000 square foot area end the combination of lots 38, 39 and 680 square feet of lot 44 is conforming in a 43,560 square foot area. Only lot 40,for which this variance is sought, is undersize. Lots were protected from a 1965 zoning change under apporved subdivision until 1969. Petitioner purchased lotel 39 and 44 in 1967, lot 40 on January .8, 1971 and lot 38 on Jauary 22, 1973. Each lot was purchased separately and was protected as buildable at time of purchase. However, lot 40 lost its separate ownership protection when purchased by Petitioner (owner of abutting lot 19) after statutory protection time had expired. Twenty-five of the forty-four lots inthis subdivision are smaller than lot 40 and of those twenty-five, all but four have,;houses on them and those four are under separate ownership and, therefore, buildable. It would not be detrimental to a neighborhood already substantially developed on lots smaller than lot 40 to allow building on lot 40. It would be a hardship to force Petitioner to build on a combination of lots 38, 39 and 40, approximately 60,000 square feet, as this lot would be the largest in the subdivision and 22 times greater than any other lot. The Board found an unusual set of circumstances in as mach as lot 44 is in one soning district and 38,39 and 40 are in another zoning district. Lot 44 meets all requirements of its zoning district. Petitioner is wiping out the lines between lots 38 and 39 and adding a small portion from lot 449 making one lot with sufficient area to meet the requirements of the zoning area. Lot 40, an abutting lot, was purchased at a much later date, namely January B. 19711, than lots 39 and 44. The Board examined the proposed lot 38, 39 and part of 44 and lot 40 with an eye toward dividing lot 39 to make two lots under the zoning requirements, but found that, due to a wetland situation on lot 38, a combined lot of 38 and part of 39 could not meet the requirement of 00% upland.
